A QUESTION OF TRUST: Should solicitors be independently regulated? UK public say “Yes” - according to research conducted by the Solicitors Regulation Authority

Lawyers cannot be trusted to regulate themselves – say public. RESEARCH conducted by the Solicitors Regulation Authority (SRA) – the body charged with investigating solicitors in England & Wales, shows there is strong support in the rest of the UK for a move to make the SRA fully independent of the Law Society of England & Wales.

And, unlike Scotland, where the Law Society of Scotland ‘fronted’ regulation model – the  Scottish Legal Complaints Commission (SLCC) – continues to be driven by former Law Society staff - the English based Solicitors Regulation Authority wants a complete break from the over arching power & influence of the legal profession’s representative body – to enable it to conduct fully independent regulation of legal practitioners.

Proposals from the UK Government to fully separate legal regulators from professional bodies have been backed by polls reporting that 82 percent of adults in England and Wales say solicitors should be regulated independently.

Research conducted by ComRes - a leading research consultancy on behalf of the SRA, has found that 86 percent of adults in England and Wales believe solicitors should be regulated—similar to doctors and more than for other professions such as dentists and accountants.

And when asked about the type of regulation, there is overwhelming support for independent regulation.

Looking at how regulation affected public trust in solicitors, 68 percent of respondents said they were more likely to trust an independently regulated profession.

When asked directly about the proposals to deliver fully independent regulation, 77 percent agreed that they support the Government's attempts to do so.

Commenting on the research, Chief Executive of the SRA, Paul Philip, said: "This research shows that the public overwhelmingly support independent regulation. Public confidence is key and, as this polling shows, people say they will have greater trust in their solicitor if they know they are independently regulated.

“I am clear that separating out regulator and representative body would not only meet public expectations, but would enhance the important role of the Law Society in making sure the voice of solicitors is heard and respected.”

The Solicitors Regulation Authority recently ran a campaign titled “A Question of Trust” – which invited the public and profession to share their views on what should happen when solicitors fall short of the professional standards set out in the SRA Handbook.

The campaign used scenarios based on real-life cases to ask how serious the issues are and what action should be taken.

The response has been impressive with thousands of people getting involved.

In total the campaign secured: More than 2,350 online survey responses, 6.5m impressions on social media, including 10,000 engagements on Twitter and 1,636 answers via our Twitter polls, Almost 4,500 visitors to our website's "Hot topics" page, where the Question of Trust toolkit for firms could be found, 3,000 attendees to our events around England and Wales.

The input from the four-month campaign will help with the development of a reference framework for our staff to use when making regulatory decisions, including whether to refer to the Solicitors Disciplinary Tribunal.

Commenting on the campaign, SRA CEO, Paul Philip, said: "This is a landmark campaign that has really engaged people. Regulation is part of the social contract between the profession and the public and it important that we calibrate and validate what we do. Thank you to the thousands of solicitors and members of the public who have helped us with this.

"We asked people about what should happen when things go wrong. I believe that clear, consistent and transparent decision making is fundamental to good regulation and we are reviewing our end to end procedures accordingly. Our new reference framework will help staff and the profession alike.

"We refer the most serious cases to the SDT. The Tribunal is rightly independent and our campaign was not about how it operates. It was about stimulating a debate on the standards the public can expect of solicitors. Of course, each case must turn on its merits and we have a right of appeal where we think the Tribunal has got it wrong.

"A Question of Trust addressed the big issues at the heart of regulation and shows that there is real public interest in the high standards expected of solicitors. Testing what we do with the profession and the public increases public confidence, not only in regulation but in the profession itself."

The Solicitors Regulation Authority is due to report further on their campaign later this year.

Responding to the SRA statement on regulatory independence, Law Society chief executive Catherine Dixon said: “We support independent regulation. Regulation is about the minimum regulatory rules which should apply to the whole market to protect consumers. This is very different from professional standards of behaviour, conduct and ethics, which should be the responsibility of the profession, as they are best placed to raise these standards.”

“There is an opportunity to put in place better and simpler regulation which applies to all legal services, as currently many legal services providers are not regulated. This means that purchasers of some legal services are not protected.”

“Currently the regulatory maze is complex. There are numerous regulators of legal services and there is an opportunity to consolidate to save cost. There is also confusion because currently there is a very broad definition of regulation, which includes regulatory rules, professional standards and conduct, ethics, entry into the profession and awarding the professional title.”

“Paradoxically, the most qualified and trained are the most regulated; the least qualified and trained are not regulated. This is a mistake. There is an opportunity to redefine what regulation should cover to ensure that it is simple and better, and applies to all legal services. Regulation should not include professional standards and conduct, nor entry into the profession and awarding a professional title. In order to drive professional standards, the responsibility needs to be with the profession. This will ensure that the reputation of the profession at home and internationally is secured and that England and Wales remains the jurisdiction of choice, and that the legal profession is seen to be independent from government, enabling it to uphold the rule of law.”

The Times newspaper reported on the research conducted by the Solicitors Regulation Authority, excerpt follows here:

It's time to have an independent body to police solicitors February 3, 2016

Should solicitors be independently regulated? The public certainly thinks so, according to a new poll this week, Frances Gibb writes. In the latest move in the current battleground between the Solicitors Regulation Authority (SRA), the profession's watchdog and the Law Society, the professional body for 160,000 solicitors in England and Wales, the SRA has published a poll showing strong support for its wish to become fully independent of the society.

The move could radically change the role and funding of the society — at present bound with the SRA. How it works is that the SRA tells the society what it needs and the society agrees the figure. The society's council then adds a sum for activities that it is authorised to conduct and together the figure determines what solicitors pay for their practising certificate fee.

Paul Philip, SRA chief executive, says: "The present arrangement is not understandable to the man or woman on the street. Most people would be surprised to know that the people who regulate solicitors are part of the body that represents the profession. In terms of public trust, you might have a question mark about that."

Meanwhile, the SRA is ready to make a strong case when ministers consult on regulation in March. "There's an inherent conflict between representing the profession and the public," Philip says. "When push comes to shove, we're part of the Law Society. If independent, we'd be less expensive and confidence in the profession would be bolstered."

SCOTLAND – Where the legal profession ensures solicitors look after their own:

In the past eight years of investigating complaints about legal services practitioners in Scotland, the allegedly ‘independent’ Scottish Legal Complaints Commission (SLCC has amassed a lengthy history of abusing clients expectations of action against wayward, rogue and corrupt Scots solicitors.

In attempts to placate calls to scrap the SLCC in current form and replace it with a fully independent regulator, the Law Society of Scotland has embarked on regular polls, one of which was widely published in the media claiming huge levels of client satisfaction with legal practitioners.

However, a media investigation by Diary of Injustice into the solicitor satisfaction survey uncovered evidence the Law Society had rigged the poll, and kept details of the SLCC’s involvement a secret, reported here: LAW POLL FIDDLE: Law Society of Scotland survey on client satisfaction used scripted replies, question rigging & involvement of ‘independent’ legal regulator SLCC was kept secret.

The full extent of how the poll had been rigged -  featured in an investigation by DOI reported here: OWNED POLL: Law Society ‘scripted’ survey criticised by Scottish Legal Complaints Commission - new data reveals few clients of dodgy lawyers ask legal regulators for help.

After the series of rigged polls, and the resignation of the SLCC’s then Chief Executive, Matthew Vickers,  the Law Society of Scotland took charge of the ‘independent’ SLCC by appointing one of their own former Directors - Neil Stevenson as the latest Chief Executive of the SLCC.

The move came after a challenging year for self regulation of Scotland’s legal profession – left reeling from the effects of the damaging BBC Scotland investigation “Lawyers Behaving Badly” -  which blew the mask off lawyers investigating their own and legal aid fraud.

A further media investigation into the Scottish Legal Complaints Commission recently revealed most of the SLCC’s key staff and investigators are in-fact families, friends & business associates of solicitors, reported here: 'Independent' Scots legal watchdog consists of solicitors’ husbands, wives, sons, daughters, cousins, friends, & employers.

Previous media investigations, reports and coverage of issues relating to the SLCC can be found here: Scottish Legal Complaints Commission - A history of pro-lawyer regulation.

Clients of Scots solicitors miss out on ‘right to know’ as UK Legal Ombudsman moves to name & shame ‘crooked lawyers’ in England & Wales

Legal OmbudsmanLegal Ombudsman for England & Wales now operating naming & shaming policy. CROOKED LAWYERS operating in England & Wales who are being investigated over complaints from clients and law firms who are considered ‘serial offenders’ in their poor treatment of clients & consumers could now be publicly identified by the Legal Ombudsman (LeO), even if the complaint is yet to be decided, according to an announcement made earlier this week by the independent regulator of complaints against the legal profession south of the border.

The policy, popularly known as ‘naming & shaming’ has taken well over a year for the LeO to implement after several consultations took place amid bitter arguments and veiled threats from the legal profession, who are worried consumers may end up seeing a different ‘warts, complaints, swindling, corruption & all’ view of lawyers other than the carefully manicured image projected by the Law Society and the UK’s legal services industry.

The LeO originally announced in November 2011 they would be going ahead with ‘naming & shaming’ in early 2012, reported by Diary of Injustice here : Scots to be ‘kept in dark’ on details of crooked lawyers while Legal Ombudsman’s ‘naming & shaming’ policy ‘will protect’ consumers in England & Wales

Earlier this week, Legal Ombudsman issued a statement & media release on its website confirming the naming & shaming policy is now operational : “As of 1 April 2012 we are collating names of lawyers and law firms subject to complaints resolved by an ombudsman's decision. Any data collected will be made publicly available at the end of July 2012 and then subsequently every quarter.”

The statement (pdf) went on to say : “In November last year, the Office for Legal Complaints (OLC), which is the board of the Legal Ombudsman, announced its decision that it is right to publish the names of lawyers in some specific circumstances, in line with the powers given to the Board under the Legal Services Act 2007.”

“The policy – which starts from 1 April 2012 – is to identify lawyers or law firms that are the subject of complaints in two different ways. The first of these is to publish, once a quarter, a table that summarises the number of ombudsman decisions each legal entity has been the subject of, what the outcome was (so remedy or no remedy), and the area of law in each case. The first quarterly information will be available on the Legal Ombudsman website in late July.”

The second is where there is a pattern of complaints, or circumstances where it is in the public interest to publish the details of a lawyer or law firm, then, pending approval from the Board, the Legal Ombudsman will publish this information immediately. This is regardless of whether there has been an ombudsman decision on the case.”

Liz France, Chair of the Legal Ombudsman’s board, said: “After careful reflection, based on the consultations we undertook, I am confident that the approach we are taking strikes the right balance. It meets our aim to be open in all we do while not providing information which is excessive to the purposes of publication – protecting consumers of legal services from detriment and helping to improving standards of service.”

Further information is available on the Legal Ombudsman’s consultations page HERE. Diary of Injustice reproted on the Legal Ombudsman’s consultation over naming & shaming here : Legal Ombudsman moving to name & shame crooked lawyers in England & Wales, crooked Scottish solicitors records to remain protected by secrecy for now

Which logoConsumer group Which? have previously given their backing to the Legal Ombudsman’s plans to identify crooked lawyers in England & Wales. A spokesperson for Which? told Diary of Injustice last year : “Which? strongly supports the principle of the LeO publishing complaints data under a strict and published policy , including in some circumstances the name of the law firm concerned. We set out our position in our response to the LeO consultation (page 51: opening up regulatory data)) pointing out that it is the expectation of Government that complaints handling bodies are as transparent as possible.”

Legal Services Consumer PanelSpeaking on the LeO’s plans to publish complaints data & the identities of law firms who perform poorly for clients, Elisabeth Davies, Chair of the Legal Services Consumer Panel (LSCP), said last year : “Research shows that UK consumers are now leaving well over 100 million comments online every year about their experience with businesses across the economy. Lawyers cannot escape this welcome emergence of consumer power, but instead should seek and then use such feedback to improve the service they offer.

She continued : “The courts will decide the fate of the Solicitors From Hell website. However, such websites fill a vacuum that exists because official complaints data about lawyers is not publically available to help consumers identify good quality lawyers. The Panel will continue to push the Legal Ombudsman to name those law firms who regularly provide poor service.”

oftThe Office of Fair Trading (OFT) also supports the Legal Ombudsman’s naming & shaming policy. The OFT stated in its submission (pdf) to the LeO’s consultation : “We appreciate that you need to balance the interests of consumers with the reputational impact on firms and individual lawyers. However, the OFT remains firmly of the view that the publication of named complaints data could incentivise legal service providers, due to reputational considerations, to maintain and/or improve the quality of service they provide to consumers. We believe that essential data would include:

* The number of complaints made against individual firms and lawyers;
* The nature of those complaints and placing them into categories to help see if a pattern develops;
* The ratio of complaints upheld against an individual firm or lawyer;
* Areas of law where complaints tend to focus;
* Which aspects of service the complaints tend to focus; and
* Whether the complaints tend to come from private or publically funded cases.

Diary of Injustice has been following the Name and Shame debate in England & Wales and it should not be forgotten the Law Society of England & Wales has, at rumoured costs of up to half a million pounds, used the courts to silence private individuals efforts to set up websites naming & shaming ‘crooked lawyers’, the most famous of which was Rick Kordowski’s Solicitors from Hell website.

While consumers of legal services in England & Wales are expected to benefit from the tough stance on naming & shaming taken by Adam Sampson, the Legal Ombudsman, there are no equivalent statutory moves being made in Scotland by the Scottish Legal Complaints Commission (SLCC) to name & shame many of Scotland’s ‘serial rogues’ from the legal profession who regularly get away with a slap on the wrist or secret shady deals done between the SLCC, Law Society of Scotland & the Legal Defence Union.

Even though the SLCC, Law Society of Scotland or the Faculty of Advocates currently refuse to name & shame their serial offenders who fail their clients, there are other routes, as Diary of Injustice reported earlier this year, here : NAME & SHAME YOUR CROOKED LAWYER : Have you been treated roughly by your solicitor ? It’s time to talk, rate, review, name & shame YOUR crooked lawyer

No one from the Scottish Legal Complaints Commission or the Scottish Government was available to comment on the lack of public information available about Scottish solicitors’ regulatory history, however a former Law Society Council member speaking to Diary of Injustice indicated any moves to name & shame ‘crooked lawyers’ in Scotland “will be fiercely resisted by the Law Society of Scotland”.

The insider also suggested any moves made in petitions to the Scottish Parliament or pleas to the Scottish Government to amend legislation to enable the SLCC to identify solicitors who are the subject of complaints “will be lobbied against by the Law Society of Scotland”.

THOSE WHO KEEP COMPLAINTS AGAINST SCOTS SOLICITORS HIDDEN FROM PUBLIC VIEW :

Philip YellandMisplaced trust with complaints : Philip Yelland. Philip Yelland, the Law Society of Scotland’s director of standards, previously director of regulation and before that head of the Law Society’s “Client Relations Office” has been in charge of regulating crooked lawyers in Scotland for over TWENTY YEARS yet from Penman to the present and beyond, most crooked Scottish lawyers have either received a slap on the wrist or no punishment at all while the client ends up financially ruined and excluded from the courts to make sure justice can never be done. Would you trust anyone like this with your complaint ? Make sure you use the media first before trusting the Law Society or SLCC with your lawyer problems.

Lawyer sued for 1 million Sunday Mail June 3 2007Law complaints regulators like the Scottish Legal Complaints Commission & Law Society of Scotland turn out to be client-haters rather than consumer protectors. Consumers, clients & readers may get a lot further in their complaints and obtain a lot more satisfaction from a media investigation of their crooked lawyers long before the Law Society of Scotland or blundering Scottish Legal Complaints Commission get round to putting pen to paper. Put simply, its more difficult for so-called regulators like the Law Society of Scotland or SLCC to let a crooked lawyer off the hook if they have already been in the newspapers a few times. Its also more difficult to let a crooked lawyer off the hook if, as usually turns out to be the case, the media reveal they have been ripping off many of their clients, not just you, or someone you know

If you have a story about a crooked lawyer, contact Diary of Injustice via scottishlawreporters@gmail.com with full details of what happened, how you were treated and what you have done about it so far.

Law Society’s database on solicitors “Too Toxic” to publish, public access to complaints info, horrific treatment of clients ‘may bankrupt’ law firms

LSWould consumers still trust lawyers if they were able to access full information on solicitors & law firms ? CALLS for the Law Society of England & Wales to share its database on solicitors with comparison websites have been resoundingly rejected by the legal profession, almost certainly on the basis of fears that clients & consumers will quickly desert law firms & solicitors across the country if consumers were to have access to the true scale of complaints against the legal profession. The claims made by campaigners & information access reformers come after it was reported last month Des Hudson, the £400K-A-YEAR Chief Executive of the Law Society of England & Wales swiftly rejected calls from the Legal Services Consumer Panel for regulators to opening up their professional registers so that the websites can provide basic information to consumers about the different services offered by law firms.

A report carried out by the Legal Services Consumer Panel looked at the barriers facing the emergence of comparison websites based on interviews with the industry. One practical barrier identified was a lack of access to professional registers held by approved regulators, meaning that comparison websites cannot obtain, in a usable form, even the basic information about lawyers, such as their contact details and areas of specialism. The report, which can be downloaded here : Legal Services Consumer Panel's report on comparison websites in legal services (pdf) recommended that approved regulators open up their professional registers for this and other purposes.

Elisabeth Davies, Chair of the Legal Services Consumer Panel, said: “Comparison websites are a welcome new feature in legal services as they could make it easier for consumers to choose lawyers and boost competition. But experience in other sectors has shown there are also risks – we are calling on website operators to demonstrate their commitment to consumer protection by signing up to some common sense good practice standards.”

She continued : “It’s staggering that so many lawyers are refusing leads generated through comparison websites. Consumers are unlikely to use these services again if they get turned away – it’s a massive own goal by the profession. There are a series of hurdles that comparison websites need to overcome before they are a major influence on consumer choice. Approved regulators could help break down these barriers by opening up their professional registers so that the websites can provide basic information to consumers about the different services offered by law firms.”

Predictably, the Law Society of England & Wales refused to share its own data on solicitors, its Chief Executive, Des Hudson who recently ended the right of clients to post their reviews & comments on experiences with solicitors on the well known website Solicitors From Hell, said the Law Society would not be sharing its data with the Legal Services Consumer Panel, or any other website not under the control of the legal profession.

One access to information campaigner from Brighton who has been involved in a long running campaign to free up solicitor’s complaints records in England & Wales told Diary of Injustice : “Clearly the Law Society of England & Wales do not want its own data on its solicitors, data which contains the appalling regulatory history of tens of thousands of solicitors & law firms across the country from falling into consumer hands, simply because if clients were to find out what their supposedly trustworthy solicitor has done to other clients, they will run a mile”

While the Law Society of England & Wales have refused to share data on their solicitors, consumers can still visit websites such as Solicitors from Hell 2 & Cowboy Solicitors from Hell to find out more about their solicitor, or perhaps post a review of their experiences at the hands of a lawyer.

Readers will of course be well aware the same problems exist in Scotland, where clients & consumers are not able to find out anything about their solicitors complaints records or how they have handled other legal work for clients. However, unlike in England & Wales, Scots consumers of legal services have no organisation such as the Legal Services Consumer Panel to call for a complete disclosure on all solicitors records to be made to the public.

The Law Society of Scotland’s own ‘too toxic to publish’ database on the Penmans, O’Donnells, Lockharts, McCabes, Danskins and more would probably shock so many Scottish clients, they too may do a runner from their lawyer’s office, and deservedly so.

Solicitors from Hell website owner goes after Law Society of England & Wales with representative class action, signatures invited

LSSolicitors from Hell owner is seeking to take on the Law Society of England & Wales in a class action. IF YOU have experienced a rejected complaint at the hands of the Legal Ombudsman (LeO) or Solicitors Regulator Authority (SRA), or even worse, if you have been awarded a fraction of the losses incurred by your legal representatives, you may well wish to join a REPRESENTATIVE CLASS ACTION against the Law Society of England & Wales which is being pursued by Rick Kordowski, the owner of the well known SOLICITORS FROM HELL (SfH) website, itself removed from the internet after the Law Society of England & Wales secured an interdict in the High Court on behalf of itself & other vested interests after concerns clients of ‘rogue lawyers’ had posted too much information about their experiences at the hands of their legal representatives, experiences so horrific they were liable to heavily impact on law firms business.

The website created by Mr Kordowski for the class action requests signatures of those who have not had a fair hearing with regard to their complaints against solicitors. Details follow :

Rickkordowski.co.uk website pageHas the Legal Ombudsman or the SRA rejected or ignored your complaint? Have you been awarded a fraction of the losses you incurred?

JOIN ME in a collective ‘representative action’ against the Law Society of England and Wales on behalf of ALL who have suffered a loss as a result of a solicitor’s actions or negligence.

I believe the Law Society’s complaint handlers have failed in their ‘duty of care’ by rejecting valid complaints. Or upholding complaints - but only awarding a fraction of the loses incurred by the legal consumer.

In UK tort law, a ‘duty of care’ is a legal obligation imposed on anyone who has failed to adhere to a standard of reasonable care. I believe the Law Society’s complaint handlers have failed to adhere to this standard in hundreds of cases throughout the UK.

This action is for anyone who has genuinely suffered as a result of a solicitor’s action or negligence and is not, for example, if your solicitor has simply lost your claim or case.

Q. What is a ‘representative action’ or ‘class action’?
A. In law, a ‘representative action’ or a ‘class action’ is a type of lawsuit in which a large group of people collectively bring a claim to court against a single defendant.

Q. Are you sure? The Civil Procedure Rules (CPR 19.6) only allow persons to be represented in civil proceedings by an other if they all have ‘the same interest’.
A. I intend to use a recent judgment as a precedent. A claim by the Law Society where it was clear that the individual interests of the represented was ‘not the same’.

Q. How are you going to finance this action?
A. I will put this claim out to tender to various Barristers Chambers on a conditional fee arrangement (No win – no fee).

Q. Why are you doing this?
A. I was let down by my solicitor. The Law Society ruled in my favour and fined the solicitor £500 (payable to me). But this was a fraction of the losses I incurred as a result of the solicitor's actions. The only option then is to take direct legal action, which, for most people, the costs of individual litigation of this type is prohibited. Sound familiar? Opt in by using the form on the right.

Q. As all solicitors are insured for negligence, can they not simply make a claim to cover my losses?
A. The cost of indemnity insurance for solicitors is one of the highest, second only to plastic surgeons. A solicitor will fight tooth and nail not to make a claim and face a rise in the annual premium.

Q. If I use the ‘opt in’ form will my details be kept safe?
A. Yes, all collected information will be kept in the strictest confidence and will not be circulated, sold or published anywhere at all.

Q. My solicitor let me down by not winning my case. Can I opt in?
A. No. This is a class action claim for all who have suffered loss and want compensation for the anxiety and distress due to the negligence or the actions of a solicitor. Following which, the Law Society’s complaints handlers failed to adhere to a standard of reasonable care.

By submitting your information you understand that there is no guarantee in this action. Full details of the claim will be given to those who have opted in.

If your genuine complaint against a solicitor has been rejected or ignored by the Legal Ombudsman (or the SRA) or if you feel the compensation you were awarded was not sufficient to cover your losses please complete the form on the right. You will be added to the claim and our mailing list with regular updates.

Appeal lodged against High Court’s takedown of Solicitors from Hell, ICO tells Law Society CEO Des Hudson ‘to live with consumer criticism of lawyers’

solicitors-from-hellAppeal lodged against High Court’s decision to remove Solicitors from Hell website from internet. SOLICITORS FROM HELL (SfH) is back in the news for 2012 after its owner, Rick Kordowski revealed he has filed an appeal against the recent High Court decision by Hon. Mr Justice Michael Tugendhat in the case of The Law Society, Hine Solicitors & Kevin McGrath & a cast of others v Rick Kordowski to grant the Law Society of England & Wales its injunction for the removal of the now well known Solicitors from Hell website which allowed clients & consumers to rate their solicitors & post reviews of their experiences with law firms & lawyers from across the UK.

Diary of Injustice reported on the legal action taken by the Law Society of England & Wales against Mr Kordowski and his website:  ‘SolicitorsFromHELL.co.uk’ in November 2011, here : Solicitors From Hell removed from internet as UK High Court grants injunction to Law Society of England & Wales to censor client reviews of lawyers

The injunction, secured by Hugh Tomlinson QC and Sara Mansoori of Matrix Chambers as announced on Brett Wilson LLP’s blog, followed a successful application for judgment in default against Mr Rick Kordowski, the owner of the SfH website. The full judgement in the case can be read here : The Law Society, Hine Solicitors & Kevin McGrath v Rick Kordowski

Speaking late last week, Mr Kordowski said : “I was tempted to leave it and let it go down in  history as one of the most ‘archaic’ judgments of all time. However, now that the Law Society of England and Wales  have been served with the necessary paperwork, this judgment and order is in  the process of being formally appealed.”

Mr Kordowski said : “The individuals who accompanied the Law Society  on the claim against me failed to follow the Pre-Action protocol code. I am also perplexed to why these individuals had not (and still haven’t)  contact me to ask who the authors of the words complained about were.”

Mr Kordowski has also indicated he will take the case all the way to the European Court if he loses the latest appeal in the UK Courts. Mr Kordowski said that in the event of his appeal being  turned down by the higher appeal court here in the UK, with the help of legal advice provided by the mainstream media, he will take this  case to the European Court in Strasbourg where he feels he will receive a fairer hearing and a more ‘balanced’ approach to the matter.

Lawyers & their grudges ? Law Society Chief Executive Desmond Hudson Des Hudson the £400K-A-YEAR Chief Executive of the Law Society of England & Wales who pursued the SfH website through the courts at huge cost to members, commented in a Press Release at the time of the High Court’s decision : “This website has served simply as a vehicle for pursuing personal grudges and vendettas against conscientious and reputable firms and legal professionals. Far from being of any help to consumers, it has been a danger. Some excellent firms have been listed on the website, and exclusion from the site has more often than not been a matter of whether a firm has been prepared to pay a fee to have the listing removed. I feared the website was directing people in real need of help away from professionals best placed to assist them.”

However, it has come to light Mr Hudson and the Law Society received little joy from their attempts to involve the Information Commissioner’s Office (ICO) in their battle to remove the Solicitors from Hell website from the internet, raising further questions over the High Court’s decision to side with the vested interests of the legal profession out to block their own client’s right of free speech to rate and review the service provided by UK based lawyers & law firms.

Diary of Injustice has been passed a copy of a letter from the Information Commissioner Christopher Graham to Desmond Hudson, CEO of the Law Society. The Information Commissioner’s office confirmed the letter as genuine and said they had no objection to it being published in full. The letter can be downloaded HERE

Law Society is told to live with criticism and ‘censoring online comments against lawyers is not a job for the Information Commissioner’ In the letter, Christopher Graham, the  Information Commissioner said to the Law Society’s Chief Executive, Mr Hudson : “We have looked at the website and agree that some of the content that individuals have posted about solicitors is highly offensive, although some of it does strike me as representing, on the face of it, credible accounts of the experiences that some individuals may have had of their solicitors. The inclusion of the ‘domestic purposes exemption in the Data Protection Act (s.36) is intended to balance the individual’s right to respect for his/her private life with the right to freedom of expression. These rights are equally important and I am strongly of the view that this is not the purpose of the DPA to regulate an individual’s right to freedom of expression – even where the individual uses a third party website, rather than his own facilities, to exercise this.”

“The situation would clearly be impossible where the Information Commissioner to be expected to rule on what it is acceptable for one individual to say about another, be that a solicitor or another individual. This is not what my Office is established to do. This is particularly the case where other legal remedies are available – for example, the law of libel or incitement.”

“There is still a considerable lack of certainty concerning the extent to which website operators are legally responsible for the content they host, Although solicitorsfromhell/Mr Kordowski may well be a data controller, and is indeed registered as such, the instigators of the website;’s content are generally private individuals expressing their own views. Their activity attracts the s.36 exemption, which emanates ultimately from Article 10 of the European Convention on Human Rights.”

“In giving due weight to freedom of expression in cases like this we have to accept that enforcing the data protection principles in respect of the activities of the website owner is likely to entail a disproportionate level of interference with the rights of the contributors, however unpleasant their contributions may be.”

“We also have to accept that contributing to, and using, ratings and customer feedback sites – of variable quality – has become an established part of consumers’ online behaviour.”

Others also question the High Court’s decision to side with the Law Society and grant the removal of the Solicitors from Hell website from public view after it became known the Legal Ombudsman (LeO) is also to embark on a similar strategy of naming & shaming solicitors & law firms who fail their clients, a fact reported by Diary of Injustice in early November 2011, here : Scots to be ‘kept in dark’ on details of crooked lawyers while Legal Ombudsman’s ‘naming & shaming’ policy ‘will protect’ consumers in England & Wales.

So, the battle is on to restore Solicitors from Hell to the internet, and thus restore the right of consumers across the country to freely comment on and rate the services of their legal representatives, just like all other consumers purchasing products & services across the land.

In the meantime new websites have emerged to allow clients to post their opinions about lawyers :

Cowboy SolicitorsCOWBOYSOLICITORS.COM, a new website to allow consumers to rate their lawyer online. While the battle for Solicitors From Hell looks set to continue all the way to the European Courts, a host of new websites offering consumers the chance to air their views of how they were served by their legal representatives have emerged, the latest one being COWBOYSOLICITORS.COM. The new website, which is free to become a member of, states Solicitors have ruled the roost for far too long, the law society is completely bias against any complaints. The truth is that many UK legal practices are filth ridden and need exposing. Become a free member and start shaming your solicitor within minutes. Manage all listings from your personalized dashboard.

SFH2Solicitors from Hell 2 has returned to replace the original Solicitors from Hell website. The new Solicitors from Hell 2 website which is registered in the USA, and is thus outwith the reach of UK Libel laws, replaces the now censored Solicitors from Hell. As before, clients can rate their solicitors and document their experiences whether good or bad although this time, it may be more difficult for the Law Society to act. The new website states : Solicitors From Hell 2 will allow people to upload articles about Solicitors from within the UK or anywhere else in the world this will be done automatically & free of charge. They think its all over : Solicitors from Hell owner to appeal High Court’s website shutdown order ‘all the way to Europe if necessary’

solicitors-from-hellIt’s not over until the European judges sing : Solicitors from Hell owner will appeal High Court order to close website after the ‘suffering’ of lawyers. IN RESPONSE to the publication of MR JUSTICE TUGENDHAT’s written ruling in the case of The Law Society, Hine Solicitors & Kevin McGrath v Rick Kordowski which granted the vested interests of the legal profession in England & Wales their demand to shut down the critical website known as SOLICITORS FROM HELL where clients could posts online reviews of their experiences with solicitors, Mr Kordowski, the owner of the now censored Solicitors from Hell website has said he intends to appeal the draconian judgement “all the way to Europe if necessary”.

The judgement, dubbed by many as a blistering attack on free speech and the rights of consumers to express their views on services provided to them by their lawyers details in no uncertain terms the lengths to which the vested interests of the legal profession of England & Wales ‘had gone after’ Mr Kordowski.

In one part of the judgement, Mr Justice Tugendhat brands the Solicitors from Hell website owner as “A public nuisance” who “is in effect a vexatious litigant”. Readers of the judgement will note there is not one single remark in the judge’s opinion which appears to be critical of the legal profession.

As Justice Tugendhat’s judgement continues , the Law Society of England & Wales Counsel, Mr Tomlinson states that the Claimants and in particular, the First Claimant, have no objection to proper criticism of the legal profession or debate about whether a particular solicitor has failed to provide service of appropriate quality in a particular case. Informed debate on these issues is clearly in the public interest and a proper exercise of the right to freedom of expression. But he submits that the Website makes no contribution whatever to such debates but instead sets out to and does provide a forum for the publication of malicious and defamatory allegations about solicitors. The Website operates against the public interest and the Claimants have brought this action with the aim of ensuring that it ceases operation. The Law Society is concerned about the enormous reputational damage that is, and can be, done to firms and lawyers as a result of their being listed on the Website. It is also concerned about the disservice to the public. The dissemination of misinformation to members of the public through the Website may deter members of the public from instructing good solicitors.

However, most see the Law Society’s claims against the Solicitors from Hell website as little more than an attempt to censor consumers online debate of how they have been treated by their lawyers, whether good or bad. The legal profession in general are firmly against clients being able to “name & shame” their solicitors in any venue, and have been known to threaten newspapers who carry reports of “crooked lawyers” with legal action or the withdrawal of advertising. In several well known instances in Scotland, individual journalists have had their careers threatened if they did not cease reporting on “crooked lawyers”.

Diary of Injustice earlier this year revealed the Law Society hoped to use its battle with Solicitors from Hell to dissuade the Legal Ombudsman (LeO) from going ahead with its own policy of naming & shaming “crooked lawyers”, reported by Diary of Injustice here : English, Scots Law Societies ‘team up’ in legal moves against “Solicitors from Hell” in bid to stop Legal Ombudsman ‘Naming & Shaming’ crooked lawyers. However the attempt failed, after the LeO announced naming & shaming is to begin in 2012 reported earlier here : Scots to be ‘kept in dark’ on details of crooked lawyers while Legal Ombudsman’s ‘naming & shaming’ policy ‘will protect’ consumers in England & Wales

In what some may see as a spiteful move against Mr Kordowski, who has been made bankrupt by the legal profession in their pursuit of him, the judgement also revealed the trustee in bankruptcy had also gone after the solicitors from hell website domain and all its contents, gaining an interim injunction to prevent Mr Kordowski handing over the website to someone else to operate.

Quoting Mr Justice Tugendhat’s ruling : As a result of the Defendant's bankruptcy the intellectual property rights in the Website and its contents are vested in his trustee in bankruptcy, but he has not taken any steps to transfer them. Rather, on 2 November 2011, he announced that he had decided to "give the website away" to "experienced owners who operate overseas". The Claimants successfully applied for an interim injunction to restrain this transfer on the basis that it would constitute unlawful data processing and harassment. An interim injunction was granted by Langstaff J restraining the transfer ("the Transfer Injunction"), returnable at this hearing.

The full judgement in the case can be read here : The Law Society, Hine Solicitors & Kevin McGrath v Rick Kordowski

Speaking to Diary of Injustice, Mr Kordowski said : “The judgment contains claims that both the second and third Claimants had long suffered significant damage, upset and could not work who the author of the published allegations were. It is interesting to note that neither of these Claimants ever asked me who the author of the posted allegations were. No letters, emails, nothing! As to why they continued to allegedly 'suffer' in the way for many months without contacting the publisher, one can only imagine.”

Mr Kordowski continued : “My argument was (and still is) that the current libel laws are sufficient to protect the defamed. However, Justice Tugendhat states that even if I could prove that every single listing was true and justified or of honest opinion that harassment & data protection laws supersede the current libel laws. Which is quite simply outrageous.”

“He [Justice Tugendhat] states that I am someone who 'STILL attempts to charge lawyers if they want comments to be removed'. He didn't have any evidence to back this up - as there is no evidence. I do not charge lawyers. Justice Tugendhat also goes on to say that I am a 'Public Nuisance' like an environmental hazard!”

“I will appeal, which will be thrown out, obviously. So it seems that both I and the public will not get justice in this country. I will most definitely take this matter to the European Court in Strasbourg. The High Courts decision is simply tyranny - we are not in China, Iran or an African despot, this is the democratic UK!”

Not all lawyers welcomed the terms of the written ruling which shut down Solicitors from Hell, with one solicitor branding the decision as “costly, unbalanced and in the long run, counterproductive to the interests of the legal profession at large”

Should a complaint arise we will require evidence to substantiate your complaint. or the removal of the offending post or words will take place. This will be at the sole discretion of Solicitors From Hell 2 editors. Further should anyone claim that any item is defamatory and can prove the information wrong then the post will be removed free of charge.

So those of you looking for an opportunity to name & shame your poorly performing or even crooked lawyer, there is now even more choice to do so, courtesy of the Law Society’s attack on UK consumers right of free speech.

Solicitors From Hell removed from internet as UK High Court grants injunction to Law Society of England & Wales to censor client reviews of lawyers

solicitors-from-hellUK High Court grants injunction to Law Society to remove Solicitors from Hell website from internet. SOLICITORS FROM HELL, the well known website which allowed clients to post online reviews in their own words of experiences with their legal representatives has been REMOVED from the internet after the Hon. Mr Justice Michael Tugendhat, sitting in the High Court in London granted an injunction to law firm Brett Wilson LLP on behalf of the Law Society of England & Wales, a so far unidentified law firm and a solicitor. The injunction, secured by Hugh Tomlinson QC and Sara Mansoori of Matrix Chambers as announced on Brett Wilson LLP’s blog, followed a successful application for judgment in default against Mr Rick Kordowski, the owner of the SfH website.

Speaking to Diary of Injustice earlier today, Rick Kordowski said : “The Law Society issued an application for 'default' judgment. Justice Tugendhat, after perusing many avenues with Hugh Tomlinson QC as to the most appropriate course of action to stop me publishing, including at one stage the Public Disorder Act, decided to issue the default judgment along with two injunction with immediate effect.”

Mr Kordowski continued : “"Of all the 'Acknowledgement of Service' forms I have sent to the court in the past, I find it 'strange' that the one relating to The Law Society's class action, had not been lodged”.

The Law Society of England & Wales have now issued a press release on the decision, however a source already commented : “.. some of its members were happy the website had disappeared from existence”

Lawyers & their grudges ? Law Society Chief Executive Desmond Hudson Des Hudson the £400K-A-YEAR Chief Executive of the Law Society of England & Wales who pursued the SfH website through the courts at huge cost to members, commented in a Press Release : “This website has served simply as a vehicle for pursuing personal grudges and vendettas against conscientious and reputable firms and legal professionals.

While noting Mr Hudson’s comments, consumers have themselves, witnessed first hand the power of lawyers pursuing personal grudges & vendettas against clients who raise complaints with the Law Society of England & Wales & Legal Ombudsman (LeO), or in Scotland via the Law Society of Scotland & Scottish Legal Complaints Commission (SLCC).

Cases brought to the attention of Diary of Injustice over the years where lawyers have pursued personal vendettas & grudges against clients reveal instances of people being denied legal representation, being denied access to courts, being hounded by Police and other public agencies, coincidentally all occurring after a client had lodged a complaint against their solicitor. The grudges & vendettas all apparently helped along by equally prejudiced & vindictive officials at the Law Society of Scotland.

In on example, one elderly client who raised a complaint against their solicitor with the Law Society of Scotland, was threatened with having his pension taken away from him and being made homeless after his solicitor provided a false statement to Police & Benefits officials and the pensioner’s Housing Association, where a relative of the solicitor worked. No action was taken against the pensioner when all three agencies investigated the allegations and found them to be false. However, for some reason, the authorities took no action against the solicitor who provided the false information in order to intimidate his former client, and this same solicitor is known to have been the subject of many complaints to the Law Society including frauds against deceased client’s estates.

On a personal note, if Mr Hudson is looking for examples of lawyers pursuing personal grudges & vendettas against clients, there are many, usually involving the fabrication of evidence against former clients, or a more extreme example, where in one case a still-working solicitor asked one of his criminal clients to pour petrol through the letterbox of a client who raised a complaint about a £300K will fraud.

The Solicitors from Hell website has operated for a number of years, enabling clients of solicitors to write their own reviews of their lawyers work in their own words, something the Law Society of England & Wales have found difficult to accept, culminating in the Law Society’s use of the courts to silence the right of consumers to write about their own experiences and thus alert others as to the potential dangers of dealing with a solicitor or law firm which had already failed their clients.

A long campaign by the Law Society of England & Wales against the Solicitors from Hell website ensued, which at times drew highly personalised & bitter attacks on its owner, Mr Kordowski. In one now widely reported instance Des Hudson the £400K-A-YEAR Chief Executive of the Law Society of England & Wales was alleged to have branded Mr Kordowski “a criminal” after a BBC Radio debate with Law Professor John Flood, Additional coverage on the Law Society v Solicitors from Hell battle over naming & shaming 'crooked lawyers' has been reported by Diary of Injustice in earlier articles,, HERE.

A legal observer commenting on the decision branded lawyers use of the courts against consumers of legal services as“vile” & “degrading to free speech”. He said : “There is clearly a problem with the legal system when lawyers and their lobby groups can use the courts to prevent clients talking freely about the level of service they receive from their legal representatives.”

He continued : “The removal of Solicitors from Hell from the internet simply because a profession feared it was losing business because its clientele were able to write the gory details of how badly their solicitors handled their legal affairs is an attack on free speech and will rightly leave people even more suspicious about dealing with solicitors.”

An official from a well known consumer group, speaking to Diary of Injustice on the matter commented : “Whatever the rights & wrongs of the website, censorship is never to be welcomed in a democracy. With cases such as this, the perception of our legal system is that the courts are giving more rights to convicted criminals & terrorists than consumers who want to write about their own experiences in the legal world or alert others about the poor treatment they have suffered at the hands of the legal profession.”

While the Law Society of England & Wales, its members, and apparently the Law Society of Scotland are happy today over the demise of the Solicitors from Hell website, the legal action to delete SFH from public view, legal action which both Law Societies were planning to use in a similar way to deter the Legal Ombudsman (LeO) from naming & shaming ‘crooked lawyers’, reported by Diary of Injustice here : English, Scots Law Societies ‘team up’ in legal moves against “Solicitors from Hell” in bid to stop Legal Ombudsman ‘Naming & Shaming’ crooked lawyers.

Legal OmbudsmanLegal Ombudsman was to be subject of desperate personal attacks from lawyers in attempt to thwart official naming & shaming by LeO. Some within the legal profession of England & Wales have branded the Legal Ombudsman’s decision to name & shame lawyers & law firms who fail their clients as a “witch hunt” however, details of just how solicitors hoped to ‘persuade’ the Legal Ombudsman not to go ahead with a naming & shaming policy are nothing short of a witch hunt on their own, where material disclosed to Diary of Injustice indicated key officials from both the Scottish & English legal professions discussed angles of attack against the LeO which clearly inferred members of the Legal Ombudsman’s staff were to be subject to the same types of personal & public criticism by the legal profession against others who reported on ‘solicitors wrongdoings’ if the LeO went ahead with naming & shaming.

Attempts by the legal profession throughout the UK to persuade the Legal Ombudsman against naming & shaming ultimately did not succeed, with the Legal Ombudsman announcing last week it will be naming & shaming solicitors in certain circumstances, beginning next year in 2012, reported in more detail here : Scots to be ‘kept in dark’ on details of crooked lawyers while Legal Ombudsman’s ‘naming & shaming’ policy ‘will protect’ consumers in England & Wales.

A final message from Rick Kordowski on the Solicitors from Hell website, before it was ordered removed by the High Court stated : Your right to ‘Freedom of Speech’ - Preserved!

I would like to thank the dozens of authors who have taken the trouble to write and send in a Witness Statement confirming that what is posted on this website is true. I would also like to thank the lawyers and barristers who have contacted me offering their pro-bono help and expressing their concerns about the Law Society’s High Court action to have this website shut down.

However, past experience has taught me that regardless of how much evidence I present in the High Court to support my defence or claim, the judicial system will always side with the law firm, solicitor, or in this case The Law Society.

In order to secure the future of this website and your right to freedom of speech, I have decided to give the website away. The new experienced owners, who operate overseas, will be taking this site to the next level in terms of world wide promotion and ease of access by the public.

All current reviews will need to be re-entered and they will be posted automatically on a new style website (similar to TripAdvisor). Authors will be able to edit and update their listings at any time. Others can make further reviews and solicitors can post a response. Full rating system and the ability to upload evidence, to name just a few advantages. All totally free of charge and out of the reach of The Law Society of England and Wales.

I would like to take this opportunity to thank everyone again for their previous support and kind words. Godspeed.

This article has been updated to include the Press Release from the Law Society of England Wales and additional material. It is very clear to this journalist from this situation, and all clients who have fell by the wayside before it, that a lawyer harbouring a grudge and pursuing a personal vendetta against clients who are forced to complain about the quality of their legal services, is most certainly a greater threat to society at large than any consumer advocate.

Criminal in nature ? Law Society Chief Des Hudson off the hook over ‘criminal’ jibe against Solicitors from Hell website owner as judge dismisses case

SFH vLaw Society of England & Wales Chief Des Hudson will not face court over “criminal” remarks against critics of crooked lawyers. Des Hudson the £400K-A-YEAR Chief Executive of the Law Society of England & Wales will not face further court scrutiny of his remarks branding the owner of naming & shaming website SOLICITORS FROM HELL “a criminal” after the judgement in the case published earlier today revealed Mr Justice Tugendhat has dismissed Mr Rick Kordowski’s claim for damages against the Law Society Chief who is alleged to have told Law Professor John Flood in reference to Mr Kordowski “That man is a criminal” and “He should be closed down”. The ‘disputed remarks’ were apparently born out of the Law Society’s frustration and it’s inability to prevent members of the public documenting their experiences at the hands of crooked lawyers on the Solicitors from Hell website.

The ruling in the case states that Mr Justice Tugendhat said Mr Kordowski’s complaint against the Law Society could not go ahead because he had not also complained about Mr Hudson’s alleged remarks being republished by others including Professor Flood. The judge said there was no evidence of any real or substantial harm to Mr Kordowski and also held the case brought against Des Hudson was “an abuse of court process”. The judge said : “Whether or not there is a good reason for refraining from suing in libel on the words posted by Professor Flood, that is not relevant to my decision that the action for slander on the words spoken to Professor Flood [by Hudson] is an abuse of the process of the court.”

Diary of Injustice reported on the claims in an earlier article, here : Naming crooks is criminal ? Law Society of England & Wales Chief Des Hudson to face legal action from Solicitors From Hell owner over "criminal" jibe

In this latest case, the Law Society of England & Wales was represented by QC Hugh Tomlinson, who is also representing the Law Society of England & Wales in their court efforts to have the Solicitors from Hell website taken down and all its content deleted forever from public view. It is understood Mr Tomlinson is the only QC who agreed to represent the Law Society in their attempts to have the Solicitors from Hell website taken offline.

Professor Flood’s statement to the court. Mr Hudson’s remarks against the Solicitors From Hell owner were corroborated by Professor John Flood in a written statement. Professor Flood’s statement read : I John Flood [address removed] provide the following statement of fact : It was about 12.30 on 21st July. I and Des Hudson had finished our live on-air discussion about Rick Kordowski and his website “Solicitors from Hell” on the BBC Radio 4’s ‘You and Yours’ programme. We were being led out of the BBC and as we were going through the doors at the BBC, Des Hudson said 'that man is a criminal' referring to Rick Kordowski, to which I replied, the police rejected that. Des Hudson further said 'he should be closed down' after that he went his way and I went mine".

Mr Hudson, responding to the allegations, told the court in his own statement, which has not been published in full : “Professor Flood suggested that our actions were likely to make Mr Kordowski a martyr and we would be seen as muzzling free speech. I replied that our actions were focussed on an issue that had nothing to do with free speech but rather his methods of collecting payment to remove comment. I believe that I said 'in my view this amounts to criminal behaviour which is why we have reported him to the police'. Professor Flood told me (and by this time I was almost at the main doors of the entrance hall to Broadcasting House) that the police would do nothing, and I remember speaking over my shoulder to him as I walked out of the room 'we'll see'. I did not say to Professor Flood 'that man is a criminal'. I would add that indeed it is my belief that the actions of Mr Kordowski are criminal in nature…."

A legal observer commenting on Mr Hudson’s submission challenged the Law Society Chief Executive's belief Mr Kordowski’s actions “are criminal in nature”. He said : “As far as I am aware, the Police are having nothing to do with the Solicitors from Hell website, and I think any reasonable person may think naming crooked lawyers so other consumers can avoid the same fate as ruined clients before them, is simply providing a much needed service to consumers of legal services we currently do not have. Naming and shaming crooks is certainly not an act which can be branded criminal in nature.”

The full judgement in Kordowski v Hudson can be read here : Kordowski v Hudson [2011] EWHC 2667 (QB). It is understood Mr Kordowski was ordered to pay £14,000 in costs and his application for permission to appeal was refused although Mr Kordowski said he would be appealing the judgement.

Speaking to Diary of Injustice, Professor Flood commented on the High Court decision against Mr Kordowski, saying : “At some point the legal profession must stop trying to shoot the messenger and listen to the complainants' voices and work to recreate the professional bargain of caring for clients.”

A legal insider speaking to Diary of Injustice this afternoon partly blamed the Legal Ombudsman for as-yet failing to use its powers of naming & shaming rogue solicitors as a factor in ongoing court attempts by the Law Society of England & Wales to pursue websites which name & shame the worst elements of the UK’s legal profession.

He said : “The Legal Ombudsman in England & Wales already possess the necessary power and backing to identify poorly performing solicitors in published decisions. If the LeO had already begun publishing the names of solicitors who fail their clients, I believe the Law Society’s case against the Solicitors from Hell website with an aim to having it taken down would also have been thrown out. ”

LEGAL OMBUDSMAN STILL TO NAME & SHAME CROOKED LAWYERS :

Legal OmbudsmanLegal Ombudsman for England & Wales is expected to decide on naming & shaming before end of the year. AS DEMANDS GROW from consumers of legal services in Scotland & throughout the UK for an independent and transparent ratings system for lawyers & law firms, insiders from the consumer world report the Legal Ombudsman (LeO) which regulates complaints against the legal profession in England & Wales is expected to decide by the end of the year at the latest on how it will finally proceed to identify ‘crooked lawyers’ who have been found guilty of failing their clients after being subjected to investigations by the independent law complaints regulator.

adam_sampsonLegal Ombudsman for England & Wales, Adam Sampson has backing to name rogue lawyers & law firms. As the LeO’s plan to identify solicitors & law firms in complaints judgements has the backing of consumer organisations such as Which?, and the Office of Fair Trading (OFT), the UK Government and the Legal Services Consumer Panel, more of which cab be read in an earlier report here : Legal Ombudsman moving to name & shame crooked lawyers in England & Wales, crooked Scottish solicitors records to remain protected by secrecy for now, observers in the consumer world say the time has now come for the LeO to act on the matter at hand, as consumers are being put at an ever increasing risk of using the wrong lawyer they know nothing about, particularly in these tough financial times where clients cannot afford to get into long running & costly spats with their legal representatives over misrepresentation, negligence, or even fraud.

USE IT OR LOSE IT – SOLICITORS FROM HELL

solicitors-from-hellSolicitors from Hell website allows clients to comment on their experiences with lawyers. While the Legal Ombudsman takes the time to decide on how to proceed with naming & shaming ‘crooked lawyers’, the website “SOLICITORS FROM HELL” currently offers clients an opportunity to write about their own experiences with their lawyers, whether good or bad. I suggest consumers use the Solicitors from Hell website to comment about their own experiences with lawyers and find out all they can those in the legal profession who are best to be avoided.

Decision day looms for Legal Ombudsman on ‘naming & shaming’ rogue solicitors as Scottish & UK consumers demand freedom to ‘rate your own lawyer’

SLCC MacAskillKenny MacAskill’s Scottish Legal Complaints Commission are determined not to identify crooked lawyers, even ones who steal legal aid funds. Yet while consumers in England & Wales will have the added protection of knowing exactly which solicitors & law firms fail their clients, and in what particular types of cases, giving clients the chance to dodge a potentially explosive, expensive bullet of a serial crooked lawyer, there is to be no similar move in Scotland by the Law Society ‘controlled’ Scottish Legal Complaints Commission (SLCC) who have kept firmly out of the debate of identifying Scotland’s worst lawyers who continue to rip off multiple clients who are given a chance to walk away from a ruined client with as little as a £10 fine, regardless of the true financial loss to their client.

I reported on the Legal Ombudsman’s plans to name & shame poorly performing law firms & solicitors earlier in March, here : Name & Shame : Complaints data on law firms to be published in England & Wales, Scots solicitors complaints history to remain secret, for now however, the road to publicly naming the worst elements of the legal profession in England & Wales has been a rocky one, with consultation after consultation, more on which was reported here : England & Wales : Legal Ombudsman criticised as ‘name & shame’ policy hit by lawyers protests over insurance costs, second consultation now underway and alleged secret threats of legal action by the Law Society of England & Wales if the LeO’s plans went ahead.

adam_sampsonLegal Ombudsman for England & Wales, Adam Sampson has backing to name rogue lawyers & law firms.

One client who spoke to Diary of Injustice said it was imperative the LeO identified lawyers who fail their clients so that others can avoid the same fate.

He said : “The Legal Ombudsman has to get on with this now rather than waiting until its too late. I have spoken to people I know who used the same lawyer as I did and ended up with a huge bill and the same failure to do anything in their case. They said if they had known of what happened to me they would have avoided using the same lawyer.”

He continued : “Everyone should know the names of useless lawyers who mess up their clients cases and there should be some sort of online directory where we as clients can write about what really happened so nothing is missed out. I really wouldn't want what happened to me at the hands of a crook in a suit, happening to others.”

There is no announcement yet from the Legal Ombudsman on how the naming & shaming policy will be implemented, however Diary of Injustice will report on developments as they occur.

RATE YOUR LAWYER – GOOD, RUBBISH, OR CROOKED :

In the meantime, Diary of Injustice has received considerable contact from clients across Scotland and in England & Wales on the subject of implementing a ratings system allowing clients themselves to rate their own lawyer. Many ideas have been expressed on who should be in charge of overseeing such a ‘directory’ with many readers pointing out the legal profession cannot be trusted to maintain any kind of book or register on their own abilities as seen from the client perspective. I agree.

solicitors-from-hellSolicitors from Hell website allows clients to comment on their experiences with lawyers. While the Legal Ombudsman takes the time to decide on how to proceed with naming & shaming ‘crooked lawyers’, the website “SOLICITORS FROM HELL” currently offers clients an opportunity to write about their own experiences with their lawyers, whether good or bad. I suggest consumers use the SFH facility. However, as readers will also be aware, the Law Society of England & Wales, apparently supported by their Scottish counterparts the Law Society of Scotland, are trying to close down Solicitors From Hell on the basis the SFH website gives too much free speech to consumers to name & shame their lawyers over failures we should all have the right to know about.

Diary of Injustice earlier reported the legal profession’s battle against Rick Kordowski & Solicitors From Hell, here : English, Scots Law Societies ‘team up’ in legal moves against “Solicitors from Hell” in bid to stop Legal Ombudsman ‘Naming & Shaming’ crooked lawyers after an investigation in Scotland turned up discussions at the Law Society of Scotland who were keen to support moves to kill off Solicitors From Hell in a joint attempt with the Law Society of England & Wales to ‘scare off’ the Legal Ombudsman’s intentions to identify poorly performing solicitors & law firms in published complaints decisions & investigations. The Law Society of England & Wales battle to undermine the owner of the Solicitors From Hell later took a highly personalised twist as Diary of Injustice reported during mid September : Naming crooks is criminal ? Law Society of England & Wales Chief Des Hudson to face legal action from Solicitors From Hell owner over "criminal" jibe.

Further developments in the Law Society v Solicitors From Hell battle will be reported later this week.

HUSH MONEY MAKES THE CASE FOR NAMING & SHAMING STRONGER THAN EVER :

Since reporting on the naming & shaming issue, Diary of Injustice has been approached by a Scottish solicitor acting on behalf of others who is apparently keen to steer this reporter away from further reporting on the Legal Ombudsman’s moves to identify law firms & solicitors who fail their clients. Additionally, a financial incentive was offered in an apparent attempt to persuade Diary of Injustice to drop reporting on the Solicitors from Hell case. Readers can rest assured, neither of the two incidents will have any effect on this journalist’s reporting on the legal profession or campaigning for reforms of consumer protection against the closed shop world of lawyer regulating lawyer and lawyers covering up for their colleagues, all the way up to the highest positions in the judiciary.

You, the Scots consumer of legal services have a right to know the full regulatory history of those in the legal profession you choose as your legal representatives. Given consumers in England & Wales will eventually be able to find out much of this same information, you should begin writing to your MSPs and the Scottish Government now to ensure YOUR RIGHTS are placed above vested interests.

After all, YOU are paying for your legal services, YOU have the right to know exactly who they are, what they are capable of, and whether they have damaged any clients in the past.
