Season’s Greetings from Scotland’s Justice system : Still “Victorian”, still fails society, still costly, greedy, prejudiced & about to get a lot more dictatorial …

SEASON’S GREETINGS to all our readers from all of us at Diary of Injustice. Suffice to say, that Scotland’s justice system continues to be, as the current Lord President Lord Gill once said, “Victorian”, failing society, and as costly & frustrate today as it was twenty, or even thirty years ago, despite the claims of some that changes in Scottish Governments and politics would change our lives beyond all recognition.

If anything, it has got worse, and the consumer organisations which survive among the ruins of London sponsored cuts, and Holyrood laziness, have effectively been muzzled to the point of uselessness, leaving only the country’s media to hold vested interests to account, and expose or report on justice & injustice in Scotland’s disrespected justice system.

Do yourselves a favour, readers, if you have a problem with the justice system, those within it, those politicians who allow it to remain as ridiculous as it is, or those public bodies who fail to regulate it, don't keep it to yourself, go out and publicise it. and support those newspapers & journalists who take the time and make the effort for you. You might just do some good for yourself, and fellow Scots.

TIME TO CALL TIME ON SCOTS VICTORIAN JUSTICE & ANTI-PUBLIC COURTS SYSTEM

Scotland’s current Lord President, Lord Gill, said in his speech to the Law Society of Scotland’s 60 year anniversary conference in 2009, reproduced in full here  : “The civil justice system in Scotland is a Victorian model that had survived by means of periodic piecemeal reforms. But in substance its structure and procedures are those of a century and a half ago. It is failing the litigant and it is failing society. It is essential that we should have a system that has disputes resolved at a judicial level that is appropriate to their degree of importance and that disputes should be dealt with expeditiously and efficiently and without unnecessary or unreasonable cost. That means that the judicial structure should be based on a proper hierarchy of courts and that the procedures should be appropriate to the nature and the importance of the case, in terms of time and cost. Scottish civil justice fails on all of these counts. Its delays are notorious. It costs deter litigants whose claims may be well-founded. Its procedures cause frustration and obstruct rather than facilitate the achievement of justice."

Not to put too fine a point on it, Lord President … Coming up on four years on since this was said … It is time. The time is now. Scots are waiting for a justice system which will serve the country, not the needs of politicians and vested interests.

THE recent demand for longer sentences and heavier clampdowns by ministers chasing headlines could alter our faith in the criminal justice system.

Most of the time, he appears to be one of the more straightforward, committed and decent ministers in Alex Salmond’s cabinet.

And then, on a regular basis, he gets his big tackety boots on and blooters some fairly fundamental human rights all over the park.

There are some very serious and potentially alarming issues coming together in our criminal justice system at the moment.

We have Lord Advocate Frank Mulholland, now attending Cabinet meetings, who, rather worryingly, on Friday, claimed the independence of Scotland’s chief prosecutor from politicians was “a state of mind”.

Meanwhile, we have a new, single police force arriving next year with a new, single chief constable, Stephen House. He is a strong and stringent police officer who is unafraid to speak his mind and keen to champion changes to the law to increase conviction rates.

Now, none of these things are necessarily worrying. Taken together, however, the danger of an increasingly politicised prosecution service encouraged by a powerful police chief and backed by ministers eager to appear tough on crime raises very real fears for the checks and balances needed to protect ordinary people from the might and majesty of the law.

We are talking about things like the police’s increasing enthusiasm for scrutinising our mobile phones and emails without the approval of a sheriff or judge.

Things like the need to corroborate evidence before conviction. Things like the abolition of double jeopardy, meaning people can now be tried twice on the same charge.

Now, there are cases to be made for these changes but – and it’s a big but – where opinion is divided, our law-makers must come down on the side of those accused of crime.

These accused men, and they’re nearly all men, are often beneath contempt.

Many are vile and violent without decency or humanity. They contribute nothing and, when found guilty, deserve less.

Every single of them, however, has a right to a fair trial in a justice system where the most basic function is to protect that right. Because if they do not have it, then none of us have it.

The lines are blurring between our police, prosecutors and politicians in Scotland where a fear of crime has been exaggerated and our ministers chase headlines by demanding ever longer sentences and heavier clampdowns.

That makes for bad laws and we need to be wary because the constant chipping away at the pillars of fairness and decency shoring up our justice system will, at some point, chip away at our faith in that system.

Messrs MacAskill, Mulholland and House should be careful what they wish for.

Meanwhile, as the Beastie Boys reminded us so forcefully, there is at least one other right worth fighting for.

So, in that party spirit, from all of us to all of you, have a merry Christmas.

"No punishment has ever possessed enough power of deterrence to prevent the commission of crimes. On the contrary, whatever the punishment, once a specific crime has appeared for the first time, its reappearance is more likely than its initial emergence could ever have been".

We have criminals outside the structures of the state and within it too. A Banana Republic indeed.

The lack of a retiring room mean judges have nowhere to go if they have to escape an aggressive parent.
'It will take one serious incident and someone will wake up to the fact that the current system is not safe for family judges.'

District judge Nicholas Crichton, founder of the family drug and alcohol court at Wells Street family proceedings court in central London, told The Guardian it was a ’recipe for flashpoint’ to compel judges to walk through public areas and share corridors.

He said: ‘Emotions run high. These parents are coming to court feeling criticised about how they treat their children and terrified they’re going to have their children removed.’

There are no publicly available statistics for the number of attacks on judges but a spokesman for the judicial office at the Royal Courts of Justice said: ‘While we have noticed no recent increase in the level of significant incidents, security continues to be treated as a serious issue. The judiciary monitors security regularly, with input from a broad range of judges in different locations and courts.’

A spokesman from Her Majesty’s courts and tribunals service added: ‘HMCTS takes the issue of security within courts extremely seriously. Our security system is continually monitored to ensure that it is effective and proportionate and mitigates against the risks faced.’

Yes exactly. The more people do this the more difficult it will be for crooked lawyers. Report them by all means but you will have to use all legal means outside the complaints system to destroy corrupt lawyers reputations. Remember the Law Society and SLCC are not there to protect clients. Play into their hands by reporting your lawyer. When you hit the brick wall of resistance tell the public by any legal methods.

They took Solicitors from Hell off the internet because they are all crooks and want their victims silenced. Most companies want feedback these days. Lawyers don't, beware, speaks volumes folks.

The Law Societies power cannot prevail if Parliament wants to end it. Your MSP gain's more from the lawyer than you. The Law Societies power rewards those you voted for.

His Law Society are human rights abusers too. They destroy lives for profit and the secret protection of their network of thugs. They are simply transferring criminal abuse of civil clients to criminal clients. Political convictions in the Courts are the same as political exoneration of ruined clients. RSA insure lawyers, doctors, MSP's Law Society, General Medical Council, Legal Defence Unions, Medical & Dental Defence Unions, Local Authorities, Employers.

So any lawyer who tells you they will help you sue these groups is a liar. The lawyer wants to kid you he represents you not to win your case. Your [[[[honest lawyer]]]] [liar] wants you for the Legal Aid money.

Ruin your life, block you from justice, then the Law Society and its front quango the SLCC cover it all up.

Yes Lord President a system that selects clients on the basis of all getting representation without conditions is just. To deny representation to victims of lawyers means without any doubt there will be more victims. Your SLCC or Law Society [same anti client animal] shows the same inaction against lawyers as your Civil Courts Review has helped clients.

Lord President my question is this. Are the Scottish people going to suffer more injustice, delays etc and discrimination, or is your Civil Courts Review going to remain toothless to protect the Law Societies membership, by maintaining exorbitant fees, withdrawing client rights, and delays. I think your Civil Courts Review is spin, we need action not words. The 'save justice' group were saving their Legal Aid Money pot. That is only what Lawyers care about. You will pass away like us all one day Lord President and leave a Victorian justice system. You are not fooling me.

Well, this doesn't come as any surprise, does it? Unfortunately Scotland is a bit of a dump-it site when it comes to professionals in most public authority positions. It manages, for the most part, to keep its own dirty laundry within Scotland with its own Ombudsman, NHS, Law Society and politicians, and ultimately they aren't answerable to anybody. Their standards reach new lows on a regular basis, but they appear to be quite happy with that. Why on earth though any of them would think that Scotland could survive independently makes me roll with laughter. You might be able to blag it when it comes to overlooking a lack of competency within the country provided there is still outside assistance and no accountability, but if the EU money stopped (think about the legal aid bundle solicitors get in Scotland) and you see they can only behave in such a manner simply because they are being subsidised. You can't apply the same low standards to economics and productivity and hope that nobody will find out your errors.

You will have to because once your lawyer is reported to the single Scottish Legal Law Society Cover up Commission you will learn only you can expose your crooked lawyer. Look at Mr Cherbi, he had to set up this blog to expose Penman. Law Society refused to prosecute Penman. Lawyers will never act in your best interests when they get more for being crooked. The Scottish Legal Law Society Cover up Commission is there to kill of clients rights and that is why only reporting lawyers will never work for you the client.

UNDER welfare reform changes that come into effect in April, housing benefit claimants will receive less money if they are deemed to have an empty room in their house.

The “bedroom tax” will hit hundreds of thousands of tenants in rented housing and will have devastating consequences for people who have to balance their family needs on tiny budgets.

It will mean that if you are a divorced parent who sees their children for part of the week, you will not be able to rent and claim for a two-bedroom house.

If you are disabled and in need of carers who might have to stay over in a spare room, you will lose 14 per cent of your housing benefit because technically you are over-occupying the home you rent.

The move is dressed up as a way of freeing over-occupied housing in the social sector but it really is just another way of cutting back on the welfare budget to make the poor pay for the deficit run up by bailing out the banking sector.

The plan, cruel at the best of times, is being enacted when people have little prospect of moving on or up in society.

We already know there are few enough jobs available for people to be able to earn more and there certainly aren’t enough ­one-bedroom properties in the rented sector for people to move into.

The SNP Government estimate the changes will take more than £60million out of the Scottish economy.

That’s without taking into account the social effect of moving away from family, carers, schools and other local ties when a cut in housing benefit makes it impossible to stay in the home you were allocated.

Most of the Coalition cuts are still to have an impact and will end up costing society more than they save.

Of course, in 2009 we had a Victorian Justice & Prosecutorial System which was totally corrupt and morally bereft?

However, now it is 2012 and we have well and truly entered into the DARK AGES!

When you have supposedly eminent senior Counsel stating on a BBC radio interview that the Scottish Courts are places where miscarriages of justice were well known and accepted as common then we really are scalping the bottom of the filthy barrel that these Scottish lawyers have colluded to participate in all in the pursuit of enrichment?

Our systems are so corrupt that the Scottish public have lost all faith?

Our Lord Advocate has failed in his primary duty which is to be impartial and independent and he should either resign forthwith or be sacked, so that he can pursue his political career if he really wants to?

As Mr Jim Swire so eloquently describes, Scotland is tainted through its collusion in many miscarriages of justice which puts the Hillsborough case into the shade to include the Megrahi Scandal not to mention the Hollie Greig shocker?

The Treasury would save over £2 billion a year if workers were paid the Living Wage because of higher income tax payments and lower spending on benefits, a new study has suggested.

The Resolution Foundation and IPPR think tanks said the suggested rate of £7.45 an hour and £8.55 in London would add around £6.5 billion to workers' earnings.

The lesson is, as some of you have already said in comments, if a client has an action regarding a claim against the Master Policy, it is very difficult to get into court or even obtain legal representation to proceed the case, however, a solicitor can raise an action on their own behalf almost at will ... hardly a fair justice system now is it ...

Thanks to all at the Scottish Legal Law Society Complaints Commission for teaching us there is no point reporting lawyers to you. We know now how to avoid participating in coverups by going public ourselves. Your future clients are outwith your offices.

Don't play into the Scottish Legal Law Society Complaints Commission hands folks, this reinforces their ability hr destroy you. Expose lawyers and firms the DIY way. If you don't want to do this your have not been hurt enough. Only you can help you.

Scotland’s Crown Office & Lord Advocate refused to prosecute FOURTEEN lawyers for legal aid fraud.

Scotland’s Law Society protect crooked Lawyers.

If they wont prosecute their own they will never protect you.

Nearly 1,000 doctors and surgeons have criminal records including child porn and sexual assault offences, it was reported on Friday.

Some 927 physicians with convictions are practising, the General Medical Council (GMC) revealed in a Freedom of Information response to the Daily Mirror.

The figures showed that 25 doctors had convictions for actual bodily harm and three for grievous bodily harm, while three were caught in possession of indecent images of children.

There were also two convictions for causing death by dangerous driving, two of drug trafficking, and two of cruelty to children.

Other offences included attacking their partners, harassment, weapon possession, threats to kill, perverting justice, fraud, kerb-crawling, forgery and theft, as well as driving offences. The largest category, at 296, was for being drunk at the wheel.

None of those treated by the 927 physicians has been informed.

Niall Dickson, GMC chief executive, said: "Our job is to protect patients by ensuring that only doctors who are fit to practise are able to do so.

"The number of licensed doctors with criminal convictions is extremely small and in the vast majority of cases these doctors are either subject to restrictions on their practice or are struck off the medical register."

Paralympians 'should have received more honours'

Former Sports minister Gerry Sutcliffe says members of the New Year honours committee made a "big mistake" in not recognising more Paralympic athletes.

He said Paralympians were not put on an equal footing with Olympic medallists and that was a "missed opportunity"

Report them by all means but you will have to use all legal means outside the complaints system to destroy corrupt lawyers reputations. Are the Scottish people going to suffer more injustice, delays etc and discrimination, or is your Civil Courts Review going to remain toothless to protect the Law Societies membership, by maintaining exorbitant fees, withdrawing client rights, and delays. I think your Civil Courts Review is spin, we need action not words. The 'save justice' group were saving their Legal Aid Money pot. That is only what Lawyers care about. Nearly 1,000 doctors and surgeons have criminal records including child porn and sexual assault offences, it was reported on Friday.

Some 927 physicians with convictions are practising, the General Medical Council (GMC) revealed in a Freedom of Information response to the Daily Mirror.

The figures showed that 25 doctors had convictions for actual bodily harm and three for grievous bodily harm, while three were caught in possession of indecent images of children.

There were also two convictions for causing death by dangerous driving, two of drug trafficking, and two of cruelty to children.

Other offences included attacking their partners, harassment, weapon possession, threats to kill, perverting justice, fraud, kerb-crawling, forgery and theft, as well as driving offences. The largest category, at 296, was for being drunk at the wheel.

None of those treated by the 927 physicians has been informed.

Niall Dickson, GMC chief executive, said: "Our job is to protect patients by ensuring that only doctors who are fit to practise are able to do so.

"The number of licensed doctors with criminal convictions is extremely small and in the vast majority of cases these doctors are either subject to restrictions on their practice or are struck off the medical register."

I received a letter from my lawyer today telling me the slcc were going to find in his favour and he is now going to give me 7 days to pay his blood money (for losing all my property titles) before he goes to court to recover what he reckons he is owed plus the usual bonus given by the sheriff well anyway I have written back telling him he can stuff it and if he tries to take the house along with his bastard pals in the courts they can sweep up what will be left of me and the house if they try it hope you publish because no one has listened to me one bit and the slcc rubbished everything I said even before I said it

Solicitors are members of the Law Society of Scotland and require a practising certificate to work as a lawyer. Of 10,400 Scottish solicitors currently in practice, many have criminal convictions for serious offences such as fraud, theft and forgery. Scottish Solicitors' Disciplinary Tribunal (SSDT) is our primary source of information on crooked lawyers. The Law Society 'prosecute' solicitors at the SSDT who they believe to be guilty of misconduct.

Scottish Solicitors' Guarantee Fund purports to reimburse clients who have suffered pecuniary loss as a result of a solicitor's dishonesty. We hold a mountain of evidence to show that it does nothing of the sort.

Scotland's legal profession is SELF REGULATING. This means that when a complaint is made against a lawyer it is a fellow lawyer who takes charge of the investigation. We contend that this system is open to widespread abuse.

Civil and Criminal Courts Cases occasionally a judge will accuse a lawyer of professional misconduct, such as acting dishonestly in court or treating a client badly.

Two Main Types of Offence....

Professional Misconduct can take many forms; such as a lawyer misappropriating clients' monies; deliberately misleading clients or acting to protect their own legal interest in preference to their client's legal interest.

Inadequate Professional Service (IPS) is not considered to be as serious as professional misconduct and applies only to the law firm - not any individual solicitor. In theory IPS should relate to relatively minor professional failings, such as a failure to communicate effectively with a client. In reality though, serious professional misconduct is conveniently watered-down by the self-regulators to a charge of IPS, despite clear evidence of serious professional misconduct. Lawyers cannot be struck-off for IPS.
Penalties are....an absolute joke!

Censure is a formal telling-off. We know of many instances where a lawyer's misconduct may involve the misappropriation of many thousands of pounds, causing the client unpardonable stress and financial loss, but the crook will escape with this absolute joke of a penalty.

Fine the maximum fine in relation to IPS is 20,000 pounds and we do not know of any law firm ever to be fined anything close this. Less that 1,000 pounds is the norm.

Practising Restriction this penalty is commonly used by the SSDT. In most instances a solicitor will be restricted to practising only as a Qualified Assistant (QA) for a couple of years. A QA must work under the supervision of a senior solicitor, usually a partner.

Striking Off is rarely used. There are lawyers on the Rogues Gallery who have criminal convictions for serious offences such as defrauding the Inland Revenue and Legal Aid Board - out of sheer greed. Incredibly, these wholly corrupt individuals managed to avoid being struck-off!

All her benefits had been stopped, Eileen explained, and she was in arrears with her rent. She was assessed by Atos, a private company employed by the government to carry out what it calls the "work capability assessment" to decide whether people receiving incapacity benefits should be sent back to work. Eileen found the form she was asked to fill extremely long and bewildering. The assessment is a tick-box exercise, with points scored depending on the patient's replies. The assessors do not ask GPs like me to provide any medical information about patients to help them make their decisions, even though someone may have received incapacity benefits for many years.

Now I am left with no lawyer to take my case on because this bunch of fools have made sure it looks like original lawyer is going to get away with what he did to me. Having spent most of my life abroad self employed working in the oil industry I decided to come home to Scotland and "throttle back" . Being undecided on what kind of property to buy "I'am still a batchelor" rented a small cottage.I had never found it necessary to have a lawyer ,friends I had made were in the legal business and I got by on freebies I wish I could say the same for my accountants. A lawyer in Aberdeenshire was recommended to me , but a neighbour informed me that he had been mentioned on two web-sites for misconduct Solicitors From Hell and Scotland Against Crooked Lawyers, I understood this lawyer the one man business BANSKI & CO also held a post with the LSS and before I had made contact with this lawyer he was struck off by the LSS, All this I believe involves stealing money and several clients are involved, but the most surprising the police are not involved the LSS have contained it all within the complaints system . Surely this can not be correct. This is what I would have expected in some of the third world countries I have worked and was well warned of. I then had a leaflet handed to me by a young girl in her early teens it explained how her grandfather had battled with the Legal System and had involved politicians all to no avail. Having read through the leaflet it would appear that there is absolutely no point trying to persue a complaint through the "SYSTEM" and it would appear MSP's have no input whatsoever !!!! what are they there for, if my local MSP has a local meeting or surgery I certainly want some answers and I will record the event lets all do the same ,this "mess" can not be allowed to continue let us all unite through D.O.I.
