SLOW MOTION ON CROOKED LAWYERS : Law Society Chiefs unable to sniff out rogue solicitor, fail to serve court order banning him from targeting new victims

Law Society fails to sniff out rogue lawyerIn the bag ? ‘Sniffer dogs may have a better chance of catching John O’Donnell than Law Society’s Elaine Motion’. A ROGUE SOLICITOR remains at large in Scotland today after Law Society Chiefs claim they could not find him to serve a court order banning him from working as a solicitor. The lawyer in question, John G O’Donnell, who was suspended, then had his practising certificate removed after the media focussed on his trail of destruction which includes many ruined clients, is, according to the Law Society of Scotland “nowhere to be seen”, thus preventing the incompetent regulator from serving a court order obtain earlier in October at Scotland’s Court of Session.

The recent case in Scotland’s Court of Session, where the Law Society sought an Interim Interdict preventing O’Donnell posing as a solicitor, only came about after further investigations by the Sunday Mail newspaper, who revealed that O’Donnell had been receiving clients desperately in need of legal assistance from ‘wannabe lawyers’ working for Hamilton Citizens Advice Bureau.

The Sunday Mail revealed that O’Donnell had targeted an elderly widow, Elizabeth Campbell, who produced evidence that one of Hamilton CAB’s In Court advisers had sent her to O’Donnell, sending a handwritten note he hoped the crooked lawyer would be able to scoop £3000 from his latest victim. QC Elaine Motion of Balfour & Manson, has represented the Law Society against John O’Donnell at hearings before the Scottish Solicitors Discipline Tribunal and now at the Court of Session, yet years have gone by, and the numbers of victims of O’Donnell increased markedly, without any substantive action on the part of regulators or Scotland’s Crown Office to go after O’Donnell to end his reign of terror over Scots who take him on, unknowingly. In an earlier attempt to get O’Donnell off the hook, and limit media coverage of the serial conman, legal representatives of O’Donnell tried to broker a deal at a Law Society Christmas party in 2009.

A ‘sanitised‘account’ of the meeting between Elaine Motion & Steven Gold, is reported in the Tribunal's hearing into one of the complaints against O’Donnell, which is published online here Council of the Law Society of Scotland v John G O'Donnell and reprinted below to give a flavour of the double dealing behind the closed doors world of self regulation of Scottish solicitors :

Page three of the Council of the Law Society of Scotland v John G O'Donnell states : “In December 2009, Elaine Motion and Steven Gold, Solicitor were both at a Law Society’s Christmas Drinks Party. They were involved in a conversation with regard to the health and welfare of the Respondent. Mr Gold made representations on behalf of the Respondent to Elaine Motion to the effect that it would be humane and advantageous to everyone involved if a way could be found to allow the Respondent to hand in his practising certificate without having to undergo the ordeal and expense of an appearance before the Tribunal. Elaine Motion was sympathetic to the representations but indicated that she would require to discuss matters with the Law Society of Scotland who would make the decision. There was no undertaking given at this meeting to Steven Gold that if the Scottish Solicitors’ Discipline Tribunal struck the Respondent’s name from the Roll of Solicitors in Scotland no further Complaints would be brought against the Respondent and no undertaking was given that if the Respondent accepted pleas of guilty to the outstanding Complaint, no further proceedings would be brought against him.”

Commenting on the latest development in the O’Donnell saga, a legal insider told Diary of Injustice this afternoon he felt the case was being handed very poorly by the Law Society, who could have gone after O’Donnell “years ago” to stop his trail of destroyed clients.

He compared the latest efforts made by the Law Society of Scotland to stop O’Donnell working as a solicitor, as “a joke”, going onto say “The Law Society clearly don't want to find him to quickly. Perhaps they might have a better chance if they call out some sniffer dogs.”

A rogue lawyer is being hunted by watchdogs so they can tell him he's banned - again.

John O'Donnell, 62, has been accused of breaching a ban on working as a solicitor following a Sunday Mail probe.

The Law Society of Scotland's Elaine Motion is trying to take him to court but does not know where he is.

O'Donnell has been repeatedly rapped for professional misconduct and negligence.

The Law Society won an interim interdict at the Court of Session Edinburgh three years ago, banning him from posing as a solicitor. Six Months ago, we revealed that O'Donnell was allegedly using another lawyer's identity to beat the ban.

That prompted the Law Society to take action against him for flouting the interdict.

One source said : "The problem is that he's nowhere to be seen and does not appear keen to make himself available."

The Law Society said : "John O'Donnell does not hold a current practising certificate and therefore cannot practise as a solicitor in Scotland.

"The Law Society applied to the court to serve notice - by way of an advertisement in the press - of an alleged breach of an interim interdict."

"The Interim Interdict included an order preventing Mr O'Donnell from holding himself out as entitled by law to practise as a solicitor."

"The application to service a notice was granted by the court on October 16"

Makes you wonder just how hard Elaine Motion is prepared to look for someone she has already tried to give a soft sanction to?

When the poacher has run off with the farmer's chickens, you don't allow the person who cut the hole in the fence to search for the poacher to bring them to justice?

Just as with those who protect lawyers it is now easy to see now how Savile and the pedos manage to get away with their vile abuse when these sick so called 'regulators' step in to prevent any charges or bad publicity.

Personally I feel it is time for all victims to move against their abusers in whatever form the abuse takes and in all walks of life and end their reign of abuse NOW

What I cannot understand is how the Law Society of Scotland's lawyer (who is employed by them to minimise any potential claims against the Law Society of Scotland's Guarantee Fund) is allowed to replace the police, so they can try to keep this scandal in-house by locking the police out so that it blocks the police's ability to Report this crook to the Crown Office, which is all part of their agenda of defeating the ends of justice with impunity to ensure that they can unlawfully keep their lawyer out of jail?

Why would Elaine Motion serve an Interdict against O'Donnell to stop him from continuing to pass himself off as a lawyer?

This Interdict's purpose is to ask O'Donnell to stop continuing to pass himself off as a lawyer in the future, which is NOT the priority of the Public & his victims and only serves the interests of the Law Society of Scotland and O'Donnell himself?

We all know that O'Donnell has already broken the law and defrauded his clients therefore the Police should have an all ports bulletin posted to apprehend him as he is clearly attempting to flee justice?

It would not surprise me if the Law Society has paid for O'Donnell to leave the country for a few months in the hope that this scandal will be forgotten?

I have heard that all of the notorious crime families and organisations are putting their people through to become lawyers because:

(i) their Scottish lawyers are above the law

(ii) their Scottish lawyers will be able to extort and defraud the Public of cash knowing that the Law Society of Scotland will aid and abet them so that they can be kept out of jail and that they receive the softest sanction possible?

(iii) they will be able to double and triple bill their client victims with impunity?

(iv) they know that whenever they commit crimes that the police will be told NOT to investigate them and that the Law Society of Scotland's lawyer will ride to their rescue?

(v) the SLAB fund can be used as a tool for them to automatically augment their already inflated salary?

I've commented before about Elaine Motion,suffice to say I was the original complainer in a case she took before the SSDT and the Law Society completely cut me out of it,doctored the terms of my complaint and the solicitor was let off with a suspension.
I offered a statement it was refused and I was told nothing of what happened instead having to find out for myself.

A word of warning to anyone dealing with the Law Society and their so called "Fiscals" such as Elaine Motion you should always copy any paperwork you give them and every time you are forced to hand over original paperwork get them to sign a form saying you will get it back by a certain date because if you don't they lie and say they don't have it or they have lost it so cant return it to you.

Anyone talking to her or the Law Society should take full notes of any conversation and I mean FULL NOTES and hand it over to the press that way you stand a better chance of something happening in your case.

It's good to see you and the Sunday Mail keeping up with these horrible characters so keep up the good work all.

I know three others who were shafted by shifty Motion?

In my experience, if you feel you have to talk to any of these fiends then you are strongly advised to record every conversation digitally to protect yourself from their lies and double dealing?

I know of someone who's lawyer was being taken to the Law Society's SSDT, which they were a witness to their lawyers criminality?

When it became clear that there was serious corruption between the Law Society and their SSDT and they (as the Primary Witness) pointed this out to all the parties involved......they were told by the Fiscal and the Law Society's SSDT that THIS CASE WAS NOT OF THEIR CONCERN & THAT THEY WERE ONLY A MEMBER OF THE PUBLIC AND HAD NO INFLUENCE ON THEIR PROCESS OR CONDUCT !!!!!!!!?

Needless to say the crooked Scottish lawyer was let off Scot-Free, despite prime facie evidence of their criminality?

Of course I know this to be the case anyway as I am a solicitor myself!

Clearly the LSoS were only moved to act after the press coverage and this is the same Law Society who claim to protect clients just as much as their members.

A member of my family had her access to benefit stopped for five months to starve her into submission. Mr Cherbi and the DOI Team are spot on where you lot are concerned. I would jail everyone in the Law Society and weld the doors shut. And I would sleep well knowing the public were safer for it.

Mr O'Donnell is just a public version of a group who are all criminals. When clients look across any lawyers desk they are looking at an O'Donnell.

The bit about Solicitor Standards is bullshit too. They want to protect all their lawyers no matter what they do to you. This is why they designed the complaints system the way it is.

The Guarantee Fund is a little known fund that is supposed to compensate client victims who have been preyed upon by crooked Scottish lawyers (but they don't like you to know about it)?

I know a Hamilton lawyer who was derobed. 0h not for stealing from clients. He stole from his lawyer colleagues. But if he was doing what O'Donnell is doing he would have been protected. No Margaret you are immature and offensive. If l stole your property and the Police stood down you would be furious. But when lawyers steal from clients the Law Society & SLCC stand down.

Grow up Margaret, put yourself in the clients shoes. Campaigners are standing up against those who are meant to protect the public. They just want protection, just like you would if I stole your property.

Don't you know that Elaine Motion has been supplanted in there so as to do the exact opposite?

She is there as the Law Society of Scotland's personal lawyer and her job is to exact as much pain and humiliation to O'Donnell's victims?

Otherwise, she would have caught O'Donnell by now and got him sentenced to jail?

To get rid of Motion and allow the police to do their job?

The police would put out an arrest warrant on O'Donnell so that he could be brought to justice, charged and sentenced to jail, under the rule of law?
