Justice Secretary forced into new appointments round at Scottish Legal Complaints Commission after lay member ‘steps down’

The Scottish Legal Complaints Commission was caught up in another scandal tonight as it was revealed that at least one, so far unidentified lay member wants to stand down, provoking a new round of Ministerial appointments of ‘lay members’ who are supposed to have no links to the legal profession, to the beleaguered law complaints body.

SLCC lay member steps down February 16 2009Minutes from February 09 just published reveal that at least one lay member is to stand down. Revelations from minutes recently released show that one of the SLCC’s lay members, so far unidentified, has asked to stand down, and discussions have already taken place between the SLCC’s Chair, Jane Irvine, the CEO Eileen Masterman and the Scottish Government’s Justice Department over replacements and mysteriously also point to the appointment of an additional lay member. “Paper (08.07.5.1) was noted from the Chair. The Chair also stated that she and the CEO had attended a meeting with the SG to discuss the recruitment of an additional Board Member. It was noted that SG have agreed to the appointment of 2 additional Lay Members; this is due to 1 Lay Member wishing to stand-down in the near future so that there will be 1 additional new appointment. Discussion took place regarding the recruitment process for additional Members and it was agreed that the Chair would update Members as matters progressed.”

Jane IrvineSLCC Chair Jane Irvine. The Chair of the Scottish Legal Complaints Commission, Jane Irvine, refused give an explanation for the sudden departure of a lay member, nor did she wish to identify the individual at the centre of the latest crisis to hit the ‘independent’ SLCC. Ms Irvine delayed any announcement on the matter by making the enquiry a ‘freedom of information request’, which can take anything up to 20 days to receive a reply.

A legal insider said tonight : “This latest problem to hit the Scottish Legal Complaints Commission shows it is unfit for purpose and should be scrapped in its present format. The delay in publishing these minutes simply because there were problems within the organisation the SLCC did not wish to reveal, demonstrates the commission is more focussed on protecting itself than protecting the interests of clients.”

He went on : “If the public and the profession are to be served by a regulator which will give the public confidence in the Scots legal services market, there has to be a totally independent regulator with full powers of prosecution and enforcement of discipline, rather than the idiotic arrangement we currently have where the SLCC will investigate a complaint and the Law Society will ‘punish’ the offending solicitor.”

MacAskill tight lippedJustice Secretary Kenny MacAskill decidedly unhappy over more disarray at SLCC. The Justice Secretary, Kenny MacAskill was asked for his reaction to the resignation and the requirement for a new round of lay person appointments to the SLCC. His spokesman said : “We wouldn’t comment on speculation about the board membership of an independent public body. Any further appointments that might be required would take place according to the statutory framework laid down in the Legal Profession and Legal Aid Act and the procedures laid down by the Office of the Commissioner for Public Appointments in Scotland.”

An official from a Scottish consumer organisation who looked at the latest publications of minutes from the SLCC was staggered that ‘late publication’ had been used to conceal serious problems within the SLCC. He said : “This latest scandal points to an organisation which does not have the consumer’s best interests at heart. Concealing resignations of lay members by failing to publish information timely seems to indicate to me the Commission realises it has no public trust otherwise why fear releasing such information into the public domain ?”

He continued : “These events also raise many questions such as : if new lay members are to be appointed, where are the advertisements for these posts ? who will pay for this new round of appointments ? what are the criteria for these positions ? and why is there to be an extra lay member appointed ?”

If an extra lay member is to be appointed which will leave the SLCC with one more lay member than lawyer members, will the legal profession object to the arrangement or ask for an additional lawyer member to be appointed ? I can see this developing into another big mess at the SLCC.”

Well we have an interesting set of circumstances here, as it looks very much like the Justice Secretary will have to appoint new lay members to the Scottish Legal Complaints Commission, but where will these lay members come from ?

Are the replacement lay members to be more stooges from the legal profession or other self regulatory bodies who know how to protect the guilty from their victims ? I fear that will be the case, as the initial round of appointments to the SLCC by the Justice Secretary, which I reported on here : Call for MacAskill appointments 'sleaze investigation' as revelations show Legal Complaints Commission member was subject of Police inquiry left a lot to be desired in terms of transparency and accountability.

Very dubious that the release of February Minutes only occur at the end of June (!), and no-one will believe for a moment that Mr. McAskill has not told - err... made his views known to - Ms. Mastermann who any relpacement should be. Doubtless it will be someone with an 'impeccable' track record.

Bernard Madoff is given 150 years the maximum sentence for a $65bn (£40bn) fraud which was described as "extraordinarily evil"

There is no public trust because it is not worthy of trust. We need to have a complaints system,

Free of lawyers and their supporters in any form.

A method of prosecuting crooked lawyers outside the legal system.

A database which can be accessed by the public, so they can be warned which lawyers to avoid. At the moment in my view all lawyers are criminals.

Lawyers involved in any complaints process will obliterate public trust, because we know you all so well. They enforce laws but are above the law because your corruption is buried by your lawyer friends, simple as that.

MacAskill's spokesman, if the SLCC is public why could no member of the public get access on Friday last when the academics reported about Law Society Master Insurance protecting crooked lawyers?

Independent-it is not because if it were you would not have needed buckets of black ink because of FOI Act. Independent organisations do not need to cover up if there is nothing to hide.

On the subject of Bernie Madoff, I think I would describe the SLCC as being the biggest Ponzi scheme on the Scots public currently on the go.

The taxpayers money should be clawed back from the SLCC, and the organisation revamped without baggage from the Law Society. Unfortunately I don't see that happening unless there are lots of protests and lots of public pressure.

Well Peter MacAskill will appoint lawyer lovers into this Law Society, SNP Quango, a bit like Hitler appointing Himmler to lead the SS, we are trying to change a system where the decision makers are the system.

The Scottish People need to know there is no point in reporting a solicitor in Scotland, naming and shaming is the only option under the present dictatorship. It would have been like asking the Nazi's to accept democracy in Germany.

at Ormskirk Hospital.

Dr Chahal persuaded four nurses at the hospital to inhale Entonox

A doctor, who admitted inhaling gas and air while on duty at a children's ward, told nurses it "created a floaty sensation", a panel has heard.

Dr Jonathan Chahal, 33, used the anaesthetic Entonox from a gas canister at Ormskirk District General Hospital.

Staff heard giggling coming from a resuscitation room and found him inhaling the substance, the General Medical Council (GMC) heard on Monday.

His fitness to practise will be debated during the three-week hearing.

GMC counsel Craig Sephton QC told the panel that Dr Chahal admitted using Entonox from a gas canister on four separate occasions.

'Cocaine traces'

The senior house officer paediatrician also persuaded four female nurses to inhale the gas, which is frequently administered in childbirth to alleviate pain.

Mr Sephton said: "He asked if they had ever tried it. He said it was fun and made you feel floaty."

He added that the effects of Entonox can alter the user's perception and can last up to 12 hours.

Dr Chahal denies taking cocaine between January and March 2008 last year, despite traces of the drug being allegedly found in hair samples during tests.

Each of the examining doctors also concluded Dr Chahal suffered from a medical condition (HERE WE GO, MENTAL HEALTH ISSUES AFFECTED HIS JUDGEMENT) - details of which were not disclosed in public.

Dr Chahal denies that the statements he made to the three doctors were misleading and dishonest.

The GMC argues his fitness to practise is impaired because of his misconduct and adverse physical or mental health. (HE WILL NOT GET STRUCK OFF).

The hearing continues.

Interesting.If there is an additional lay member that means the solicitor compliment of the SLCC board will be in a minority and therefore an imbalance will exist.
I doubt solicitors would sit by without protest while this took place.

I read a story the other day about lots of trainee lawyers getting kicked out on their arses.
Great.That night I invited all my mates for a drink to celebrate a few less ROBBERS on the loose.
We should all stay away from lawyers and let them go bankrupt.No need to have ROBBERS with titles to their name when they are just glorified ROBBERS.

I have a friend who is a lawyer, but after reading your blog for many evenings Mr Cherbi, I am beginning to think my friend is a criminal.

Not that he has done anything I know of, but he is one of this group. I doubt he would help me if a lawyer ruined my life. Something is seriously wrong if people are barred from justice because a lawyers reputation will be ruined. Shocking system from the 18th century, at least it looks that way to me.

I would be distressed if circumstances dictated I needed a lawyer. I see no difference between them and Hitler, except lawyers have no military power. In truth they are light years from what decent people stand for. The frightening thing is that lawyers think they are honest. MP to quit over expenses 'stress'
Harry Cohen

Labour MP Harry Cohen has said he is to step down at the general election due to the "intolerable stress" expenses allegations have had on his family.

Mr Cohen represents an east London seat but reportedly claimed £104,701 in six years for his "second home".

A complaint was made to the standards commissioner that his designated "main home" was 70 miles away in Essex.

Mr Cohen said he believed he would be exonerated (like cash for honours crooks) but his wife's health had suffered due to "constant attacks".

Reforms 'could harm MPs' rights'

Measures to reform Parliament after the expenses scandal could violate MPs' human rights, it has been claimed. WHAT ABOUT THE HUMAN RIGHTS OF TAXPAYERS?

The right of MPs to a fair hearing if accused of misconduct could be violated under a planned new system of external regulation, MPs and peers have warned.

CLEARLY THE SAME DISEASE THAT AFFECTS THE LAW SOCIETY, SLCC, ANY EXCUSE TO AVOID SELF REGULATION, AND THIS BUNCH OF PARASITIC BASTARDS WANT THE ELECTORATE TO TRUST THEM. SO MP's AND PEERS WANT FAIR HEARINGS. SO DO VICTIMS OF CROOKED LAWYERS. DOUBLE STANDARDS FROM PEOPLE WHO SHARE A COMMON BOND, INCREASED WEALTH THROUGH SELF REGULATION.

You know Peter there isn't half the trouble in England with lawyers compared with up there in Scotland.Even you have to admit that as I see you got some half decent replies in from the Law Society of England & Wales.
Ever considered recommending people to come south to get decent legal service ?

An organisation's credibility all comes down to public trust.I wouldn't trust this slcc lot whatever they said.

If there are English legal firms willing to take on cases without restriction - even against members of the legal profession, and they prove this to me, I will happily recommend their details to people.

Great work you are doing, I like the comment about English law firms taking on Scottish law firms, we will watch this space?
