Marsh UK, the UK subsidiary of the US insurance firm Marsh & McLennan companies which saw some of its directors plead guilty as a result of an investigation by the New York District Attorney's Office of bid-rigging and price-fixing in the insurance industry has now been linked to Scotland's longest running civil damages action claim, now in its SIXTEENTH YEAR in the Court of Session, involving Motherwell College & North Lanarkshire Council after the local authority released details in response to a Freedom of Information request.
Court of Session judge Lord Woolman hears Scotland’s longest running civil damages claim. Now in its Sixteenth year in the Court of Session, fresh hearings in the long running civil damages claim in front of judge Lord Woolman began earlier on Tuesday of this week. M.Wilson v North Lanarkshire Council & Others (A1628/01) which has its origins in the mid 1990’s and brought about Scotland’s first civil law McKenzie Friend in late 2009, involves a sole party litigant, Mr Martin Wilson, a former Music lecturer of Motherwell College who, according to media reports was forced out of his job after sustaining severe back injuries during the course of his duties as a music lecturer during his time at the College in the 1990’s.
Responses obtained by Diary of Injustice in reply to Freedom of Information enquiries reveal that Marsh, the insurance firm who insure all members of Scotland’s legal profession without exception, now also insure North Lanarkshire Council, who operate Motherwell College.
An official from North Lanarkshire Council replying to an FOI request admitted : “I can advise that North Lanarkshire Council’s Insurance Brokers until 30 September 2007 were AON, and from 1 October 2007 this service has been provided by Marsh. I can advise also that Travellers Insurance Company Limited have provided employers liability cover for the whole period of your request.”
In what is now Scotland’s longest running civil damages claim, Mr Wilson, the party litigant, has been forced to represent himself after several of Scotland’s leading law firms suspiciously abandoned his case at the very last minute. Mr Wilson is facing North Lanarkshire Council and their indemnity insurers, Travelers Insurance Co Ltd who are both being represented in court by Edinburgh law firm Simpson & Marwick. Senior Counsel for Simpson & Marwick is Ian MacKay QC, Junior Counsel being Calum Wilson both of Compass Chambers.
Now, following further investigations by Diary of Injustice and despite the outrageous time it has taken for Scotland’s civil justice system to hear their testimony, hearings in the Court of Session have shown that many internationally acclaimed experts have supported the party litigant’s claims.
I first reported on Mr Wilson’s case late last year, here : FIFTEEN year wait for justice against Motherwell College marks poor state of Scotland’s ‘Victorian’ Justice System on European Civil Justice Day where legal insiders who attended previous court hearings reported that Mr Wilson, who had been put in the position of having to represent himself after several big name law firms, who were at the time & are currently all insured with Marsh UK, withdrew from Mr Wilson’s case at the last minute prior to scheduled hearings of the Proof. Mr Wilson had also encountered repeated & numerous refusals of ‘expert witnesses’ from Scotland to assist his case as long as he was unrepresented. As a party litigant without representation, Mr Wilson was, according to court observers, forced abroad to Japan and the United States for supportive expert medical reports.
According to court documents seen by Diary of Injustice last October, Mr Wilson was previously represented by the well known Edinburgh law firm of Balfour & Manson, who were appointed by Scotland’s largest teachers & lecturers Union, the Educational Institute for Scotland (EIS), who spent tens of thousands of pounds assessing Mr Wilson’s injury as a valid claim, and that it should proceed to court. Amazingly it took the EIS almost THREE YEARS to lodge the summons against Motherwell College.
Papers studied by legal insiders reporting on the case revealed that Balfour & Manson, after being appointed by the EIS spent a staggering EIGHT YEARS working on Mr Wilson’s injury claim, and then at the last minute, decided to withdraw from acting for their client with only weeks to go before scheduled Proof Hearings in the Court of Session.
Balfour & Manson’s withdrawal from acting for Mr Wilson then became a suspicious pattern followed by further four law firms, including the Glasgow based Harper Macleod also withdrawing at the last minute, some eighteen months after representing Mr Wilson. Harper McLeod claimed they had ‘suddenly discovered’ “a commercial difficulty” in that they had an annual retainer from Motherwell College for several years, and had represented the College in Mr Wilson’s Employment Tribunal hearing over his unfair dismissal, which Mr Wilson won on a unanimous decision. Motherwell College also appealed the Employment Tribunal decision on Mr Wilson’s case and lost again.
A further two legal firms took on Mr Wilson’s case and then were apparently persuaded to drop their client, amazingly even returning fees paid to them for their service.
Motherwell College squandered £300K of taxpayers money fighting a string of Tribunal hearings involving bullying allegations against lecturers which the College lost. A number of media reports, referred to in recent coverage of the case by Scottish Law Reporter, show Motherwell College were involved in a string of Employment Tribunal decisions the college lost during Richard Millham’s term as Principal of Motherwell College. Allegations in newspapers including the Sunday Mail reported that “In 1999, lecturer Martin Wilson won £4000 after a tribunal ruled he had been unfairly fired. He had a back injury and could not work. A close friend said : "He was targeted by Millham. There was a strong climate of fear, which is still there ."
According to Scottish Law Reporter who last year reported on the case, “From 1995-1998 Motherwell College opposed Mr Wilson's claim for Unfair Dismissal while on long term sickness leave and lost, to a unanimous decision. Undeterred Motherwell College appealed the decision, and lost again. This was the first of several high profile Employment Tribunal cases lost by the Board of Management of Motherwell College, often to unanimous decisions against it.”
Simpson & Marwick, who are representing Motherwell College & North Lanarkshire Council, are themselves famed for their representation of solicitors accused of professional negligence & client swindling, all supposedly covered by the Law Society of Scotland’s Master Policy Professional Indemnity Insurance Scheme, operated by Marsh to defend against negligence claims raised by clients. The Master Policy and its administration, operation was linked in 2009 to client suicides in an independent report published by the University of Manchester’s Law School.
One of Simpson & Marwick’s partners, Dr Pamela Abernethy famously appeared at the Scottish Parliament’s Justice Committee during 2008, telling msps that pleural plaques, an asbestos related condition, could actually be good for people. Marsh UK, the British end of the gigantic US insurance operation appear to be linked to many insurance deals in the public & private sector, ranging from multiple services provided by local & national government including law & order, to the private sector. Marsh also enjoy a monopoly on the insurance of all solicitors in Scotland through the Law Society of Scotland’s ‘brutal enforcement’ of the Master Insurance Policy arrangements where all solicitors are required to pay into the professional indemnity insurance scheme if they want to practice any form of law.
Marsh appear to have heavy political influence in the UK, with Conservative Lord Ian Lang now the Chairman elect of Marsh & McLennan companies, according to his register of interests published as per his duties as Chairman of the Advisory Committee on Business Appointments. Lord Lang joined the Marsh & McLennan board in 1997 and has assiduously refused all invitations to comment since news of the 'Marsh Frauds' broke, frauds which were accompanied by valid injury and disability claims being routinely denied. You see Lord Gill, this litigation involves ruthless lawyers taking on cases where their own insurers would be paying this mans damages.
This is the reality, if an individual is injured at work the doctors, lawyers, all share the same insurer as the employer.
Health and safety at work where injuries (ARE NOT VISIBLE) is an opportunity for lawyers, doctors, to make money but the same lawyers and doctors are paying premiums for professional indemnity insurance as the company who would be paying the damages. Ross Harper did the same to me.

The longer the case goes on the more money they make.
There is no Health and Safety at work, unless you get your legs broken, there are lawyers and doctors who know people get injured but they cover it up.

To be sued successfully under delict it must be proven that you owed a duty of care to an individual.
But how can Mr Wilson prove Motherwell College were in breach of this duty if his own lawyers and doctors will be penalised by their insurers if the medical reports blame North Lanarkshire Council?
It is corruption, lawyers taking on cases they can never win without hurting their own finances.
A stone age Justice system is what this is, it results in injuries being covered up automatically. Make the lawyers and doctors pay, and the employer and their insurers never pay out.

It will never happen, but you already know that. It is simply lawyers and doctors abusing this man Mr Wilson so they can make money. It happened to my sister.
Even if the X Rays and evidence prove Motherwell College are responsible it will be covered up.

In these litigation cases there is no such thing as two groups of prosecution and defence teams. They are one group with a common purpose. You all share the same insurers and the employer being sued is also insured by your insurers Miss Abernethy.
There is always a pattern of money making by the professionals involved, with no justice for the victims even although you pleural plaques are bad for the health.
You are not only lawyers and doctors, you are directors of the insurers paying the damages, you are kidding no one.
I have home insurance and car insurance. PPI, Critical illness, never pay out because the lawyers and docotrs get bonusus to protect insurance companies.

ReplyDeleteA young woman injured due to prolonged standing and stenciling at a Bakers.
Her lawyer, all doctors, her GP for over thirty years covered up what happened to her.
Her lawyer (well known in Glasgow) got three years legal aid money, and we found out later the all lawyers and doctors were insured by the same company as her employer.
So the doctors and lawyers insurers would have been paying her damages.
She has not worked for years due to these ruthless criminals.
Occupational injury where legally privileged criminal doctors cover everything up encourage employers to injure others.
Her GP, made out to the court she had been seeing a psychiatrist for over twenty years, a lie and put a straight line through the box on the benefits agency form which asked if there were any psychiatric problems.
She does not have psychiatric problems.
So at least he told the benefits agency the truth.
Simple strategy, stop her money from the benefits agency by stating there is nothing wrong with her, he did not mention her leg damage or wrist damage which was true (she had no money for 5 months until her employer terminated her contract) her GP sent her back to work for the third time her employer would not let her into work, the GP refused to give her another medical certificate and the Glasgow lawyer did not help her because his insurers would have been paying her damages, a total nightmare.
The employer, lawyer and GP cut off her money to starve her into submission.
This is the reality of the self regulators.
I beg every member of the public reading this please do not get injured at work, all of the lawyers, doctors, sheriffs are working for the insurers you are suing.

Incidently The GP stopped her money. If the case had gone to court she would have learned earlier that her GP was lying about her mental health.

ReplyDeleteI do not mean like Shipman, I mean occupational injury, mortgages, wills, family law, these people are above the law. Think about this.
By investigating their colleagues activities, they bypass the public space (the courts system) no trial by jury, trial by lawyer or doctor.
Do not trust them especially if taking legal action. They do not have a duty of care becasue their colleagues will clear them of any wrongdoing.
The system has been designed this way, it is not an accident.

Here is the pattern again, I see so many similarities with what happened to me. Their insurers are paying your damages Mr wilson, that is why they are withdrawing from the case.
It really is a multiple whammy, employer injures you, then lawyers make money with no intention of the case getting to court, them doctors cover up, then if you go to the Law society they cover it up. Cameron Fyfe did not tell me he was insured by Royal Sun Alliance same as my doctor and employer.
They are abusing you Mr Wilson for profit, pure evil calculating scum. The all have the same way of operating.

The fact that lawyers take on litigation cases they cannot win tells you all something about how lawyers view their clients.

Lawyers are a low as paedophiles and from what I hear a few in the Judiciary are fond of kids, sick scumbags.
I remember a Hamilton lawyer told me years ago that cases like Mr Wilson's never get supportive medical evidence. But he did not tell me why.

The pile of paper I still have shows the same pattern as Mr Wilsons. I would love to meet him in a public place for a coffee and a discussion. We would have a lot in common as I am a litigation victim and a pianist. I have every sympathy for him as I know he has been sent to hell.
As someone else said simply this is a disgrace and why no politicians have come to comment on some poor person being dragged through a 16 year court case is equally a disgrace.

This is good practice for the legal and medical profession. In my life I have never met a more mendacious group of bastards than medical and legal people. Your interests are in direct conflict with their interests. But they do not say, "oh Mr Wilson we cannot represent you because our insurers will be paying your damages".
Like me you might as well go to Marsh UK Royal Sun Alliance and ask their directors for money. They would show you the door but make no mistake, your lawyers and doctors may as well be directors of this company because at the end of the day it is their insurers you are claiming against.

ReplyDeleteThe "COMARE" survey probably isn't worth the paper its written ... if it is then they will have to explain why Westminster & the Scottish Government have prevented the release of childhood leukaemia clusters around certain areas .. and spent a lot of taxpayers money on legal teams in the courts seeing to it the information does not come out.

This case has been going on so these bastards can make money. They should all be jailed for this level of inhumanity.
Why not just put an advert in the Scottish condemning this. These people are sadists.
In time Peter Hans Kochler's warning about independence may become a reality, with Salmond and MacAskill and the Scottish Nazi Party in power.

Inhuman treatment is the norm when dealing with these people. They cut of your money to starve you, this has happened.
Lawyers and doctors are no different from Hitler's SS, they would fit into any Nazi party.
ReplyDeleteIf this is the treatment party litigants are getting from Scottish courts clearly there is some kind of active prejudice or discrimination going on.
ReplyDeleteIf you can track down enough party litigants who have endured the same maybe they can get together and take their case to Europe.
You might also kiss goodbye to certain parts or maybe all of European Commission Human Rights Legislation (ECHR) which any future independent Scottish Government may begin to find 'inconvenient' to its management, or as we have seen in the past four years, lack of management of Scotland's justice system.

Yes Peter exactly MacAskill will kill any access to Human Rights. I mean one of his Sheriffs Brian Lockhart wanted to use this act to hide his and other Sheriffs past from the public. I believe MacAskill is so biased he would stop lawyers being prosecuted in the courts.
Cameron does not want to break up the union but his policy of deficit reduction, and Clegg following like Dave's poodle has strengthened the SNP in Scotland. Most people are concerned with the economy, not controlling our corrupt unnaccountable legal establishment.
You will not hear MacAskill condemning the law firms who have taken Mr Wilson for a ride to legal hell. MacAskill would treat him the same way.
Is Andrew Penman still allowed to work as a lawyer?

Hearings begin again tomorrow morning (Tuesday 10 May) at the Court of Session, members of the public are free to attend and I would encourage anyone who can to go along and witness the level of prejudice a party litigant faces in the Scottish Courts.
Whatever the final result of this case there will have to be an investigation into the way party litigants are discriminated against in Scottish Courts, and believe me, I can muster quite a few party litigants to appear before a Scottish Parliamentary Committee and tell of their experiences, should the need suffice.
