Scotland’s ‘well respected’ legal profession in the dock as solicitor jailed for drugs smuggling. YET another rough week for Scotland’s world famous legal profession has ended with the sentencing of solicitor David Blair Wilson to four years in jail for attempted smuggling of mobile phones & drugs into Saughton jail. As some legal observers have pointed out to journalists today, many feel the case only reached court because the media had reported on events surrounding the high profile swoop on Blair Wilson outside Saughton Prison in October 2011.
Blair Wilson had been targeted by a sting operation after Police & Prison authorities had been tipped off he was running a well planned operation, smuggling illegal drugs which had been heat sealed into pages of A4 paper, and other banned items such as mobile phones into Saughton Prison.
Sunday Mail reported arrest of David Blair Wilson in October 2011. His trial, which lasted six days in April, saw dramatic CCTV footage of plain clothes police officers blocking any attempt by Blair Wilson to drive away in his silver hatchback after making an exit from prison buildings. Police then led him away in handcuffs. Police subsequently searched Blair Wilson’s car and uncovered mobile phones, diazepam tablets worth up to £2800 at inflated prison prices, and cannabis resin with a prison value of £4000 along with other contraband items.
A jury's majority verdict convicted Blair Wilson of attempting to smuggle three mobile phones, three SIM cards along with two chargers and two earphones into the jail. He was also found guilty, by majority, of being concerned in the supply of cannabis resin, diazepam and body-building drugs, in particular to prisoner Lee Brown who is serving 18 years for attempted murder.
Blair Wilson rose to fame as a central character in the Magic Circle scandal of the late 1980’s, where the most senior members of Scotland’s judiciary had been investigated for having inappropriate liaisons with ‘young males’ and ‘rent boys’, liaisons which has clearly spilled over into the courts system, according to Police intelligence at the time.
Scottish Law Reporter has reported on the Magic Circle in an article HERE and has also featured a report on the key role of a former Lord Advocate in what was known at the time as Operation Planet, an investigation run by Lothian & Borders Police to catch crooked judges & prosecutors ‘who were swapping boys for favours in Scottish Courts’, HERE. Lord Nimmo Smith QC’s REPORT ON MAGIC CIRCLE GAY JUSTICE SCANDAL, has been widely refuted by many as a whitewash of the corruption in the Scottish judiciary, which some claim, with evidence, continues to this day.
Solicitor Grant Docherty – threatened to destroy a client. THIS WEEK had already started on a bad note for Scotland’s legal profession, when it was reported Police are allegedly investigating another solicitor, Grant Docherty, the current head of Banking & Finance for DWF Biggart Baillie after evidence presented to the Scottish Solicitors Discipline Tribunal (SSDT) revealed a torrent of messages containing threats & abuse from Mr Docherty to a client, over a failed house purchase. Scottish Law Reporter reported that evidence presented to the SSDT and included in complaints made to the Law Society of Scotland revealed that solicitor Docherty (aged 49), who is currently head of the Banking & Finance team at DWF Biggart Baillie said Robert Rankin would be ripped “to shreds” after failing to come up money for a house purchase. The Discipline Tribunal also heard that Docherty, 49, sent his client a string of abusive texts including one which warned: “I’ll come after you with everything I have.” A further text said: “This is personal. You’re a liar and the worst sort of human being.”
It was also reported the Law Society of Scotland’s Prosecuting Fiscal, Paul Marshall, told the Scottish Solicitor’s Discipline tribunal in Edinburgh of the contents of the messages, which said in one case : “He said he would rip Robert Rankin to shreds.” Mr Marshall went on to tell the Discipline Tribunal that some of Docherty’s 33 messages, which had been sent between December 2010 and January 2011, were also seen by the client’s young son. One of the messages said Docherty would “ensure” Robert was “destroyed”.
Docherty only stopped threatening his client, who had been put in a state of fear & alarm by the solicitor’s actions, when Police were called in. Complaints were then made to the Law Society of Scotland who brought the prosecution of Docherty before the Tribunal hearing in April where the solicitor was eventually fined £7,500 after being found guilty of professional misconduct although allowed to continue working.
A month on from the Tribunal hearing involving Grant Docherty, the Scottish Solicitors Discipline Tribunal have failed to publish its decision and any evidence heard during proceedings. Scottish Law Reporter added in their report that discussions have apparently been taking place “with a view to refrain from publishing some of the more threatening texts sent by the solicitor, which a well placed legal insider claims are allegedly of a violent nature”.
The brewing row over the SSDT’s conduct in the Tribunal hearing against solicitor Grant Docherty apparently relates to the content of many of the messages sent by Docherty to his client, content which some allege to contain life threatening statements which the SSDT do not want to publish in their final decision. Yet despite the seriousness of the threats made by the solicitor, the Tribunal chairman Alistair Cockburn could only manage a comment claiming : “The expressions used were unfitting of a solicitor.”
Admittedly, Mr Cockburn’s lack of shock may well be put down to the fact that solicitors physically threatening their clients has become commonplace in complaints, with substantial evidence pointing to the Law Society watering down client;s allegations to ensure most cases never made it to the media.
Former Procurator Fiscal Depute Stuart MacFarlane who served in Iraq, awaits sentence for downloading child porn. The former Procurator Fiscal, who had served in the Army in Iraq, and is now apparently working as a contractor in Afghanistan, was caught with at least 15,000 images of child pornography on computer equipment at his home after Police succeeded in gaining a search warrant to raid his premises and seize computer equipment. Images seized by Police from computer equipment owned & used by MacFarlane showed acts of a sexual nature against minors, and also pictures of sexual acts with animals. Macfarlane now awaits to hear if he will be handed a custodial prison sentence on MacFarlane although his name was placed on the sex offenders register.
MacFarlane had served as a Procurator Fiscal Depute at Scotland’s Crown Office & Procurator Fiscal Service (COPFS) for many years, and during his time there the media reported MacFarlane strangely escaped prosecution for earlier charges of indecency with a prostitute the Crown Office claiming at the time “it was not in the public interest” to prosecute.
The current Lord Advocate, Frank Mulholland, and the Crown Office have issued no statement or comment on their former colleague’s admission to downloading child porn, instead preferring to run off Press Releases praising their own conviction rate, and doubtless hoping for the reinstatement of bonuses or inflated salaries.

Coming along to reassure us the Law Society of Scotland would act further in the case of David Blair Wilson, but apparently not in the case of the convicted former Prosecutor, or the top banking lawyer who threatened his client, the Law Society of Scotland’s Director of Regulation, Philip Yelland issued a Press Release stating : Former solicitor, David Blair-Wilson was today, Friday 17 May, sentenced to four years in prison at Edinburgh High Court. The length of sentence means that he faces automatic prosecution before the Scottish Solicitors Discipline Tribunal. Mr Blair-Wilson has not held a practicing certificate which would allow him to work as a solicitor since October 2011.
Mr Yelland, who has been at the Law Society of Scotland for 23 years and who’s name has become familiar to clients who have received no justice against corrupt solicitors, commented : "Solicitors are expected to maintain the highest standards both in their professional and personal lives. They are bound by rules including rules about their conduct, and serious criminal convictions are a breach of these rules. We will get official notice of the sentence from the authorities, which will allow us to raise a formal complaint which enables us to take a prosecution to the independent Scottish Solicitors Discipline Tribunal."
Mr Yelland, after twenty three years at the Law Society, handling all the cases you have, your department & its staff saving hundreds of solicitors from the long arm of the law, from justice for clients, saving those solicitors who should rightly be stuck off after they ruined clients lives, interfering in many client’s legal cases in courts against solicitors … you must be kidding.

Yes DOI another excellent report and this is the reason the press must always be free. There are defamation laws and prison for those who flout the law, but I personally am convinced as you pointed out this would never have been in court without press reports.

ReplyDeleteThey will ruin you, and then you will find it impossible to get legal representation. In my opinion it is because they don't control all of the press that the general public are learning what lawyers really are. The Police caught the drug smuggler, God help us if the Police start lying. A lot of them do a great job in my opinion and yes there are crooks in every profession but free journalism is a critical part of any democratic country.
My advice to the public is be very wary of all lawyers. Lets be fair they are not all drug smuggling or downloading child porn but if you are ruined by a lawyer you will stay ruined.
Dissent renews politics and it is renewing the legal profession by holding them to account. I am a victim of a crooked lawyer and we don't want you to be one.
Journalism ceases to be journalism unless is is free and this must be upheld at all accounts to hold those to account who otherwise would be above the law. When journalism ceases to be free it becomes propaganda. How can anyone have respect for a legal system such as ours?
Mr Yelland bureaucracy or an in house complaints system was designed to keep lawyers who belong in jail out of jail. If you told me the sky was Blue I would have to check for myself. I have been at the end of a lawyers scalpel, and I tell everyone I know never to trust lawyers, but especially the complaints system that does not exist. One lesson I learned from the Law Society and NHS Local Resolution complaints system is that they are graveyards for complaints. We are in the know.

Mr Yelland I know you believe this because you have been conditioned by the culture of the system you have been trained in. But I would not ask a lawyer how honest the legal profession are, that is utter insanity. Ask the victims. The only people who are independent of the legal profession are the clients. You people don't even make me angry anymore, I have become comfortably numb. I expect this B******t and think if I complain to the lawyers they take control of the complaint. ReplyDeleteYes this is the same Mr Yelland when informed that there is overwhelming evidence that solicitors have been involved in colluding in a court case and a signature had been forged ,describes it as a "very serious matter" but does absolutely nothing. A Chief Constable indicates it is "beyond his remit " unless he is informed by Mr Yelland that there has been misconduct , this is passed on to Mr Yelland and he responds by closing the file and will not respond to any more correspondence. It really is a great system!!!!.

The system used to be like this.....
The Law Society of Scotland receive a genuine complaint regarding criminal conduct by a Scottish lawyer?
They immediately set about reducing the 'heads of complaint' against their crooked member to a minimum (say from 15 Heads of Complaint down to 2)
They will also play 'funny buggers' through correspondence, where they will go against any mandate you state, they will deny receiving corroborating prime facie evidence and they will try to engineer a time-bar against you?
Then if you got as far as the Law Society of Scotland's Committee stage, then Mr Yelland can sit in on these directing them to make the most advantageous decision for the crooked lawyer and the Law Society?
Then the SSDT will act deliberately obtuse and look at all of the damning evidence and then skew their decision to the most favourable outcome possible (Borrowing Without Consent ! )?
Nowadays we have the Law Society of Scotland's SLCC, chock full of former Law Society of Scotland CRO staff, who's agenda is always pro-crooked lawyer?
Then, their Liason Dept collude with the SLCC and give 'Instructions' to the SLCC staff to sabotage valid water-tight cases against crooked Scottish lawyers to keep them out of jail?
The whole purpose of the LALP (Scotland) Act 2007 was to make the monopoly & control of the system by the Law Society of Scotland over engineering miscarriages of justice even more certain?
This was as a result of client victims of crooked Scottish lawyers exposing the criminality being perpetrated by the Law Society of Scotland?
So, now the Law Society of Scotlamd are being allowed to act with more vengeance and menace against client victims in order to damage & humiliate them for having the temerity of expecting their crooked Scottish lawyer from being properly regulated?

Unfortunately, I trusted my Scottish lawyer and found out that he was a crook?
I reported this crooked Scottish lawyer to the Law Society of Scotland, showing them the prime facie evidence of criminal acts perpetrated against me. The Law Society of Scotland asked me not to report to the police, that they preferred to deal with it in-house. Then the Law Society of Scotland let their crooked member off Scot Free?
After I put pressure onto the Law Society of Scotland, they duly reported their crooked member to their SSDT and then the SSDT let the crook of Sco-Free again, despite having prime facie evidence of the crimes committed?
Unfortunately, I am one of the hundreds of victims of a crooked Scottish lawyer that has graduated with a 1st Class Honours Degree from the Law Society of Scotland's School of shafting?

They Scottish police are 'Instructed' to allow the Law Society of Scotland to be able to deal with Scottish crooked lawyers 'in-house' where the Law Society's own clean-up lawyers move in to deliberately smother the serious case against one of their members, to try to gain as much information from the Client Victims, in order that they can start preparing a defence AGAINST the Client Victim and FOR the crooked lawyer?
From this moment forward, this clean-up lawyer will act AGAINST the best of the Client victim and FOR the best interests of the crooked lawyer to try and keep their crooked member out of jail?
Of course this is tantamount to perverting the course of justice, as the Law Society of Scotland has a duty under the Solicitor (Scotland) Act 1980, which they routinely disregard on a daily basis?
The Law Society of Scotland's biggest fear in all of this is exposure of their unlawful means and those of the crooked Scottish lawyer to the Press & the wider Scottish Public?
So, you may ask, why not sue them in court?
Many have tried but the Law Society of Scotland have got their interests sewn up as tight as a crabs arse, where it is nigh impossible to get a lawyer to act for you against the unlawful Law Society because the Law Society of Scotland have an unlawful monopoly of control over all lawyers in Scotland and can intimidate and attack Scottish lawyers by threatening to or removing their Practising Certificate at a whim?
Why do the police not arrest these crooks?
Because the police know that they will get hounded and barracked by the lawyers at the Crown Office & Procurator Fiscal's Office where they can make police officer's life a lot more difficult?
The very few cases that do reach the police and then court are usually crooked Scottish lawyers that the Law Society of Scotland has decided that they want sent down, for whatever partial reasons they have?
Sad but true?

If there was a credible and lawful Regulation System for Scottish crooked lawyers then you could say this but there isn't?
The Regulation System is unlawful, biased and designed to let Scottish crooked lawyers off with as light a sanction as possible to allow them to continue perpetrating their pestilence and hatred on to poor members of Scottish Society?
A friend of mine said he was going to see his lawyer about a house purchase. I said you better read A Diary of Injustice first, what shocker that was for him.

ReplyDeleteThe comment on the 18th at 21.29 indicates that a Chief Constable states it is beyond his remit to look into collusion and forgery ,I find this difficult to understand what is the role of the police, criminal acts have nothing to do with anyone else other than the police.
ReplyDeleteReading the case of Docherty I want to tell you of my own experience.I was threatened with the Police if I told the tribunal about the threats my solicitor made against me and my family.My solicitor threatened to send one of his criminal clients to my house who he said was violent and he told me he was facing trial for stabbing someone and raping their wife.He said Would I like the same to happen to me and my wife?I made a complaint about him to the Law Society of Scotland and told them everything.They took years to investigate and when they made a complaint to the SSDT all the threats and lists of telephone calls and recordings were not in the complaint.I asked to go to the hearing and they told me I was banned and if I attended I would be arrested by Police.I have not been told what happened at the hearing and it is nearly a year ago.There is no record of my complaint against my solicitor on their website and no one at the Law Society will answer my letters I think I may as well go to a newspaper now?

ReplyDeleteI don't think Mr Yelland needs to be good at his job. A complaint goes to the Law Society and in an office as I repeatedly say a favourable outcome can be engineered. Think of secrecy as a weapon against you clients. Secrecy keeps you ruined.
As for the drug smuggling, downloading child porn and threats to destroy clients no surprise there. Nothing this faction do could shock me now. I always look forward to the DOI teams next report. It is most satisfying reading what a corrupt group of creeps they are. Thanks again DOI, the only people and the Sunday Mail I trust to tell it how it is.

The Sunday Mail is the only paper I ever buy now as They have shown me that they are the only newspaper with the guts to break free from the threats against the Scottish Press and report these criminals to the Scottish People?
And guess what?
Having broken through the threats against them, the Scottish legal crooks have not followed through with their evil threats but still the other so-called newspapers tow the party line and betray the Scottish People?
This betrayal will continue to be highlighted in massively reducing newspaper circulation and ultimate fast approaching bankruptcy?

This is awful but unfortunately all too commonplace?
The Law Society of Scotland's meandering serpent fingers get to infiltrate all areas of public life including the police, albeit they always try to use their threatening influence via third parties (rather than direct involvement) from the Crown Office and Procurators Fiscal office to do their dirty work for them and so if the victim cries foul, the Law Society of Scotland MUST always be seen to be unconnected with this criminal behaviour?
Unfortunately, you are one of the many victims of the Law Society of Scotland and have witnessed that they routinely pervert the course of justice to their own ends?
Report your case to the DOI team as a matter of urgency and remember you are not alone?
Exposure is their biggest fear?

You, my friend are like the majority of good Scots in that you have been brain washed into believing a certain reality that is not real!
In England, the situation is fundamentally different......
An English Policeman or Policewoman have a duty to seek out and investigate crime wherever they find it and to pursue their investigations into this crime, regardless of where the evidence leads them?
In Scotland however, the position is fundamentally different to that of England........
In Scotland we have Police Officers?
They are assigned a senior officer who is office based (controller) and their job is to INSTRUCT the Police Officer WHETHER OR NOT TO INVESTIGATE CRIME AND ON WHICH EVIDENCE THEY ARE TO LOOK FOR?
This system is further corrupted in that the Police Controllers can do NOTHING as a case progresses unless the Procurator Fiscal gives them an INSTRUCTION?
Then we have the cosy and evil axis between the Law Society of Scotland and the Crown Office, who can interfere in Justice by using these levers to dictate how or IF a prosecution goes ahead?
Than after all this, if you have caught them out completely, they will just LIE?

Yes my friend I left the comment you replied to and yes I got a 1st Class Honours too like many other people who deal with the bureaucracies that were set up to let crooked lawyers they all find out one fundamental truth. There is no complaints system in Scotland. Now we realize this is what self regulation is for and hence the reason many people are warning others, spread the word my friend you are not alone. Dealing with any Scottish Lawyer is dangerous because clients have no rights and as long as we complain to them we sadly participate in the coverup because they keep everything hush hush in house. Tell everyone you know.

Tonight on reporting Scotland they were arguing about how banks will be regulated in an independent Scotland.Well with the model they have for regulating lawyers we will all be broke in 10 minutes to the bankers so I know how I will be voting!

They are a fundamentally evil profession who will do anything to protect each other. The truth is that they want to be allowed to rip people [they see it as their right] off and then get upset when those people want justice. Mature people I think not, you are not alone my friend. We have been there and it is dreadful indeed what these people do to those who dare question them. One of them wanted someone to blow Peter up, freaks, and yes Mr Lawyer DOI have friends, many of us.

another reason to avoid doing any business with Scottish lawyers - they are all the same and stick up for each other no matter how horrible they treat their clients

ReplyDeleteThe Discipline Tribunal also heard that Docherty, 49, sent his client a string of abusive texts including one which warned: “I’ll come after you with everything I have.”
Law Society of Scotland’s Prosecuting Fiscal, Paul Marshall, told the Scottish Solicitor’s Discipline tribunal in Edinburgh of the contents of the messages, which said in one case : “He said he would rip Robert Rankin to shreds.”
One of the messages said Docherty would “ensure” Robert was “destroyed”.
I'll make sure everyone I know is aware of this and not to do business with this law firm.
Very dangerous getting involved in any way with a lawyer in Scotland and this is the proof if any more were needed.

Why was this Scottish crooked lawyer allowed to be 'looked after' by the SSDT, when his conduct was of such a serious nature to include harassment and threats by telephone that he should have been dealt with through the normal court procedure where wider legislation could be upheld against him, leading to a far more effective sanction and a more reasonable outcome to protect the victim & the public?
