New £313-a-day Chair for Scottish Legal Complaints Commission. THE widely disrespected Scottish Legal Complaints Commission (SLCC), the ‘single gateway’ for all complaints made by clients against Scottish solicitors, has a new Chair with the announcement of the appointment of Bill Brackenridge, who takes over the £313 a day position of what many observers now accept is little more than a “front company” for the Law Society of Scotland.
Mr Brackenridge claims the SLCC, with its annual budget of nearly £3 million pounds, paid for by client fees to solicitors, will be made more effective in dealing with complaints and will encourage improved standards in the legal profession under his leadership. Mr Brackenridge replaces Jane Irvine, the SLCC’s first Chair,and former Scottish Legal Services Ombudsman, who retired from her position on 31 December 2012.
The SLCC announced the appointment of Mr Brackenridge last week in a low key Press Release. The SLCC said Mr Brackenridge will bring “considerable Corporate Governance experience to the SLCC”, on the basis that as a management consultant for 25 years he has extensively advised public and private sector clients. Among his former appointments, Bill Brackenridge has served as a non-Executive Director on Highlands and Islands Airports Ltd and on NHS Highland, chairing the Argyll & Bute CHP for five years. For six years he chaired the Board of the Scottish Ambulance Service. He comes to the SLCC aiming to build on its formative years and intent upon developing positive relationships with its stakeholders.
Mr Brackenridge said : "I'm pleased to be joining the SLCC at such an important time in its development. We're now established as the gateway for all legal complaints in Scotland but there's much more for us to do to build trust and confidence in legal services. I'm looking forward to working with the team to make us even more effective and influential in dealing with complaints and in encouraging improved standards through our powers of guidance and oversight. The legal market is changing. Our hard-won experience will contribute to maintaining and strengthening public trust and confidence in buying and using legal services."
Omitted from the SLCC’s Press Statement, it is also known Mr Brackenridge was appointed by Deputy First Minister Nicola Sturgeon to the Vale of Leven Monitoring Group which was set up to advise NHS Greater Glasgow & Clyde on the future of the Vale of Leven Hospital in West Dunbartonshire and modernisation of health services at the hospital.
However, during Mr Brackenridge’s tenure at the Vale of Leven Monitoring Group, it is worth noting and perhaps of considerable concern, that eleven lay members from the Vale of Leven Monitoring Group resigned their positions in a mass resignation, claiming their views were being ignored by the health board after a number of decisions were apparently taken by the Health Board contrary to input from the group’s lay members.
At the time of the mass resignation by the lay members, Mr Brackenridge in his capacity as Chair, told a meeting of the Vale of Leven Monitoring Group he was "disappointed" by the resignation of 11 lay members. However, the incident was widely reported in the media, with opposition politicians calling for Mr Brackenridge’s group’s disbandment, on the basis it had “no credibility”.
It may well be worth noting that Mr Brackenridge now finds himself heading a legal complaints regulator also well known for its lack of credibility.
The Scottish Government’s similarly low key announcement of Mr Brackenridge’s appointment, made by Justice Secretary Kenny MacAskill, without a personal comment, claimed “The SLCC also promotes and advises on good complaint handling and makes recommendations to promote good legal practice in Scotland. The SLCC aims to resolve complaints quickly and effectively.”
However, some cases brought to the attention of Diary of Injustice appear to show the SLCC has told some clients it may be up to EIGHT MONTHS before their complaint is assigned to an investigator, while other cases have shown the SLCC is refusing to consider any evidence submitted by clients to challenge spurious claims made by solicitors who have the backing of organisations such as the Legal Defence Union to ‘persuade’ the SLCC to drop cases “on demand” as one insider put it.

He can of course proves us all wrong by demanding from the Law Society a copy of its Master Policy agreement with the notorious insurance provider Marsh - so he knows exactly what his terms of refernce are.

My mother was put in a care home against her will and this was done with a document called a `power of attorney`. This document claimed my mother said she could not write, and yet she had done so two weeks before in front of her bank manager.
ReplyDeleteWhen I asked the Public Guardian to investigate, they strung me along until my mother was dead, when they then informed me that it was too late, and I should have put my case in front of the sheriff.
When I asked the Public Guardian if they had ever put a case in front of the sheriffe they told me no, because it was a private matter. Yet I discovered that there had been a case in which the Public Guardiand had been involved. In other words, the Public Guardian could choose whether or not it had the obvious powers that it had, and whether or not they would choose to use them.
I am exhausted and probably not making much sense at the moment. But I would plead that these issues concerning powers over elderly and vulnerable people are matters seriously to be investigated.

There is no complaints system to protect clients from your legal profession Mr MacAskill and you know that to be true even though you will never admit it. The SLCC and you consider clients to be thorns in your flesh.
Credibility comes expensive at £313 a day - that works out at £1,565 a week assuming a Mon-Fri stint.

Cabinet Secretary for Justice Kenny MacAskill today announced the appointment of Bill Brackenridge to the Chair of the Scottish Legal Complaints Commission.
The appointment will be for five years. He replaces Jane Irvine, the first Chair of the Commission, who served from 1 January 2008 to 31 December 2012.
The introduction of the Legal Profession and Legal Aid (Scotland) Act 2007 created the Scottish Legal Complaints Commission (SLCC) which opened for business on 1 October 2008. Providing a single gateway for complaints against legal practitioners operating in Scotland, the SLCC investigates and resolves complaints about inadequate professional service; refers conduct complaints to the relevant professional body and provides oversight of complaint handling across the profession. The SLCC also promotes and advises on good complaint handling and makes recommendations to promote good legal practice in Scotland. The SLCC aims to resolve complaints quickly and effectively.
Bill Brackenridge brings considerable corporate governance experience to the commission. As a management consultant for 25 years he advised public and private sector clients as the governance agenda developed. He has served as a non-Executive Director on Highlands and Islands Airports Ltd and on NHS Highland, chairing the Argyll & Bute CHP for five years. For six years he chaired the Board of the Scottish Ambulance Service. He comes to the Commission aiming to build on its formative years and intent upon developing positive relationships with its stakeholders.
The appointment will be for five years and will run from 1 January 2013 to 31 December 2017.
This appointment is part-time and attracts a remuneration of £313 as a daily rate. This extension is regulated by the Public Appointments Commissioner for Scotland.
All appointments are made on merit and political activity plays no part in the selection process. However, in accordance with the original Nolan recommendations, there is a requirement for appointees’ political activity within the last five years (if there is any to be declared) to be made public. Mr Brackenridge has undertaken no political activities over the last five years.

ReplyDeleteCome on Bill.The SLCC has been on the go since 2008 and not even lawyers trust it (hence all the appeals in the Court of Session by solicitors) so your trust building exercise is dead before it happens.
Anyway,the Law Society trots out this "We will build trust" line every year and we are still neck deep in crooked lawyers who get a gold star in the margin when they end up at the SSDT.
Like Irvine did at the opening of the SLCC he will simply dismiss any criticism and say the page has to be turned.The only problem is the next page reads the same as the last and the one before it so don't expect any improvements or solicitors raising their standards of service just because a political appointee comes along and says so.

No one is worth £313 a day especially when it comes to handling complaints about lawyers BUT dont just take my word for it .. look around and see how many people you can find who are satisfied with the handling of their complaint against some miserable scumbag in the legal profession who gets away with stealing because his buddies handle all the regulation and see to it no criminal case to answer
Surely with 25 years of Management Consultancy experience (yawn,just look how most of these public sector organisations are run) the wise thing to do would be to admit the slcc is in a bit of a mess and needs a complete revamp instead of the rather tame comments attributed to him in the SLCC's media comment.

Watching the news tonight there is a story about the Police trying to persuade rape victims to withdraw their complaints well a similar situation is going on between the SLCC and myself over a complaint I made about my solicitor and they are trying their best to get me to drop it and no one will talk to me on the telephone about it.

I am so sorry for your loss but you seem to have fallen victim to the Law Society of Scotland and their legal monopoly?
The Office of The Public Guardian was set up (and it is structured to be run by an unelected and unaccountable single person who makes decisions for your loved ones) precisely to ensure that where an elderly person or incapacitated person is vulnerable and in need of support that the Scottish lawyers have easy access to their money/estate?
This was set up simply as another cash enrichment stream for crooked Scottish lawyers to take advantage of the vulnerable in Society?
Why?
Because they can?
They see us all as £ signs and are devoid of any emotion when they BORROW OUR MONEY WITHOUT CONSENT? (AKA Steal)?

I am exhausted and probably not making much sense at the moment. But I would plead that these issues concerning powers over elderly and vulnerable people are matters seriously to be investigated.

Client : What do you mean? Of course you know me? It's me? You are my lawyer? I have used you and your firm for 10 years and have paid you £Millions of my hard earned money in the process? Why did you say you don't know me? That is very offensive?

Client : How arrogant, you must know my name is Mr Hargreaves?
Lawyer A : ......Ahh, Mr Hargraves. Of course......how are you sir? Everything swimming I presume?
Client : You confuse me? Why did you not recognise me initially?....
Lawyer A : Well you see Mr Hargreaves, it is really a rather simple explanation and is peculiarly an issue with us Scottish lawyers......We are only ever concerned with our clients name.......otherwise misunderstandings can occur....like today for example?
Client : I am still confused? I am one of your highest billed Clients, you simply must have recognised me?
Lawyer A : Err, No. The reason I didn't recognise you & instead had to rely on your name is simply because when Scottish lawyers look at their client they all look the same to us.........all we see is a body with a £ sign for a head......

CPS West Midlands staff members charged with £1m fraud
Two Crown Prosecution Service staff members face charges of conspiracy to commit fraud over false taxi claims totalling at least £1m, the CPS said.
Lisa Joanne Burrows and the other member of staff, who has not been named, work for CPS West Midlands.
The allegations concern false claims for witness care taxi services when no such services had been supplied, the CPS said in a statement.
A spokesman said Ms Burrows, 41, had been charged by West Midlands Police.
She will appear at Birmingham Magistrates' Court on Thursday.
The other staff member has not yet been charged.
'False claims'
West Midlands CPS covers the counties of Warwickshire, Shropshire, Staffordshire, Herefordshire and Worcestershire, and the metropolitan area of the West Midlands including the cities of Birmingham, Wolverhampton and Coventry.
Malcolm McHaffie, deputy head of special crime for the CPS, said: "Following a complaint by the Crown Prosecution Service and a subsequent investigation by West Midlands Police into two members of CPS staff, I have carefully considered available evidence in relation to Lisa Joanne Burrows, a finance manager, and another member of staff, an administrative officer.
"I have now concluded that it is appropriate to charge both [Ms] Burrows and the other individual with conspiracy to commit fraud.
"The charges relate to an allegation that [Ms] Burrows and the other member of staff, on or before 27 February, conspired together to commit fraud by false representation by submitting to the Crown Prosecution Service false claims for witness care taxi services to the value of at least £1,000,000 when no such services had been supplied."
Lawyers overcharged for legal aid
ReplyDeleteThree lawyers have been barred from providing criminal legal aid services after being investigated by the Scottish Legal Aid Board over charges.
All three were found to be in breach of the board's code of practice.
Solicitor Iain Robertson of Paisley-based Robertson & Ross and former associate Alistair Gibb were found to have overcharged the board for travel to various prisons.
Mr Robertson's firm has since repaid £221,847 to the Legal Aid Fund.
In a separate case, Glasgow lawyer Steven A Anderson and his firm Andersons Solicitors were found to have held "unnecessary meetings with clients" and made "inappropriate, multiple and repetitive grants of advice and assistance".
The Scottish Legal Aid Board monitors and investigates legal aid expenditure involving both legal aid applicants and the legal profession.
While it can stop solicitors undertaking criminal legal aid work, only the Law Society of Scotland has responsibility for stopping solicitors from providing civil legal aid services.
Last year, the board saved or recovered almost £2m following investigations.

Come on Bill.The SLCC has been on the go since 2008 and not even lawyers trust it (hence all the appeals in the Court of Session by solicitors) so your trust building exercise is dead before it happens.
Anyway,the Law Society trots out this "We will build trust" line every year and we are still neck deep in crooked lawyers who get a gold star in the margin when they end up at the SSDT.

ReplyDeleteSurely with 25 years of Management Consultancy experience (yawn,just look how most of these public sector organisations are run) the wise thing to do would be to admit the slcc is in a bit of a mess and needs a complete revamp instead of the rather tame comments attributed to him in the SLCC's media comment.

ReplyDeleteWatching the news tonight there is a story about the Police trying to persuade rape victims to withdraw their complaints well a similar situation is going on between the SLCC and myself over a complaint I made about my solicitor and they are trying their best to get me to drop it and no one will talk to me on the telephone about it.

You will no doubt also notice that they try to do this double dealing on behalf of the Law Society of Scotland over the phone, so that you are denied proof of a written example of their behaviour?
The SLCC's job is to make it look like it is not the Law Society who are doing all of this defeating the ends of justice but you can be CERTAIN that it is the Law Society of Scotland and is down to some particularly evil staff members who take great delight in ruining people's lives and creating human devastation?
We live in a truly SICK Society in Scotland?
