Scotland’s judges to be asked for views on their own lack of transparency over personal interests, vast wealth. BY WHAT PRIVILEGE are highly paid Scottish Judges & Sheriffs allowed to conceal their substantial wealth, the origin of their investments, interests and other undeclared earnings according to rules written by themselves, asks a PUBLIC PETITION heard today by MSPs at the Scottish Parliament’s Petitions Committee.
The petition, inspired by legislation currently under consideration in New Zealand, calls for a published Register of Interests for Scotland’s highly paid Judges & Sheriffs who currently prefer to keep their vast and somewhat “interestingly arranged” wealth and in some cases, criminal records, hidden from public gaze, even when there are clear indications such wealth & interests conflict with the interests criminal & civil cases, being heard in Scotland’s courts.
However, and somewhat ironically, while the meeting of the Petitions Committee began with declarations of interests from its various members, a requirement politicians must comply with, a somewhat stony silence descended on the Committee when members were asked for their views on the petition which calls for members of the judiciary to be required to comply with similar rules of disclosing their financial & other interests in court.

Petitions Committee Convener David Stewart MSP (Scottish Labour) opened debate on the petition : The fourth and final new petition is Petition PE1458 by Peter Cherbi on the register of interests for members of Scotland's judiciary and members have a note by the clerks spice briefing and the petition and like other members i think there is some additional papers from the petitioner and that involves some press coverage and the press coverage involved some comments about six judges who have been convicted of crimes since 2005 i think the petitioner was very keen that was made public in terms of the interests of his particular petition.

Jackson Carlaw MSP (Conservative) said : I have to say similar to the last petition I find this slightly clumsy and unnecessary and at this stage as far as i can see on the basis of something that is envisaged potentially but not actually currently being implemented in New Zealand however I am quite happy for us to at this stage to seek the advice of the Scottish Government and the Lord President as to what his view would be on this and perhaps actually ask for some sort of indication or report as to what information has been forthcoming in terms of the way in which any system that's been operating up to this point has been functioning.

Given that the Petitions Committee have now decided to ask the Scottish Government, the Lord President Lord Gill, the Faculty of Advocates and the Law Society of Scotland for their views on this petition, it will be interesting to see just what arguments the professions, the judiciary and the Scottish Government put forward for excluding Judges from the accepted norms of full transparency of those key decision makers in Scots public life.
If the Judges have nothing to hide from a register of interests, then they have nothing to fear. We are often told the same as members of the public, therefore the same criteria should apply to those in the courts who are making decisions which affect us all in one way or another.
PETITION BACKGROUND :
Petition PE01458: Register of Interests for members of Scotland's judiciary calls for the Scottish Parliament to urge the Scottish Government to create a Register of Pecuniary Interests of Judges Bill (as is currently being considered in New Zealand's Parliament) or amend present legislation to require all members of the Judiciary in Scotland to submit their interests & hospitality received to a publicly available Register of Interests. The petition also features references to debate in the Parliament of New Zealand who are considering legislation to create a register of interests for the judiciary. It is time for Scotland to move in the same direction and create a similar register of interests for the judiciary of Scotland and all its members, increasing the transparency of the judiciary and ensuring public confidence in their actions & decisions.

A legal campaigner has urged MSPs to create a register of interests for Scotland’s judges.
Peter Cherbi has secured a Scottish Parliament petition calling for all sheriffs and judges to declare financial interests and hospitality.
The legal blogger from Edinburgh, said: “Like those in other areas of public life, members of the judiciary should be required to disclose their interests, financial or otherwise.
“This would increase transparency and help to ensure public confidence in their actions and decisions.
“It has been suggested to me some judges have offshore investments for the purpose of tax avoidance while others may have shares or other connections to businesses.”
Cherbi was inspired by a similar proposed law which is being debated in New Zealand.
The closing date for the online petition is December 7.
Judges were issued with ethical guidelines which were drawn up by senior judges headed by Lord Osborne two years ago.
The Judicial Office for Scotland: “We do not hold a register of hospitality for members of the judiciary and there are no plans to do so.”

ReplyDeleteI know exactly what is going on here because I was at the Court of Session last year for my medical injury claim only to be told by my solicicitor that my QC had to be careful what he said because the judge in our case was friendly with the law firm representing the insurers and was a regular at their offices.If it helps any I can send you the stuff on my case and my counsels opinion saying everything was in my favour yet I lost of course and my solicitor pins the blame of it on the judge himself and the regular dishonesty of the defenders in court.

ReplyDeleteTne New Zealand case involving the Judge Bill Wilson who resigned is not so straightforward and you should be in no doubt the NZ judiciary moved to cover the whole thing up and even axed the judicial panel set up to investigate Wilson's conduct.

Lord Brailsford comes under fire
Recently appointed High Court Judge Lord Brailsford caused a storm after releasing an illegal immigrant accused of rape on bail.
Subsequently the accused man fled and has since failed to report to Stirling Police as instructed by Brailsford
Lord Brailsford opted not to hold Romanian Vasilica Potolinca in custody until his trial despite him not having a fixed address, despite a motion from the Crown Office requesting that he be held until he faced the charges in court.
The 22-year old Romanian stood accused of an attempted rape in Stirling while his victim was on a night out in the city.
He appeared in Stirling Sheriff Court and was remanded to Barlinnie Prison. After a bail application on 14th September at the High Court Potolinca was released and ordered to report to his local police station on a daily basis,which he failed to do immediately.
Lord Brailsford was only appointed as a High Court judge earlier this year at the same time as Lady Clark, Lord Turnbull and Lord Uist.
No wonder your courts/judges are out of control crooks with this Scottish Parliament in charge.Seriously your legislature looks and sounds like a PTA meeting!

It is a scam, ask your lawyer who his professional indemnity insurers are. YOUR LAWYER HAS TO BE CAREFUL. HIS LAW SOCIETY WILL TAKE AWAY HIS PRACTICING CERTIFICATE IF YOU WON DAMAGES. Fear yes of the public catching on that their MSP's want to protect the legal profession at all costs. Equal legal rights as Scotland shows are impossible even in a so called democracy, because our elected MSP's all have the same attitude as Mr MacAskill. Protect lawyers.
Benefits are taken to pay legal fees and our MSP's human rights abusers turn a blind eye or resign. The truth is that in matters of law Scotland is a Law Society oligarchy where the MSP's make policy to favour lawyers [the few] at the expense of the Scottish electorate. The Lord President and his subordinates are simply oligarchs supported by their MSP lackeys who keep their
interests protected by secrecy. The expenses scandal at Westminster proved what happens when they operate in an atmosphere of secrecy.

As far as I can see there are no good reasons for this not to go ahead.
However I am 100% sure after reading this story and the previous reports these judges are up to no good in their outside work hours (probably also during work hours) so it is safe to say they will not comply and lets face it even if a register of interests is created how can it be policed and how can we expect the judges to be honest when it already looks like they are crooks.
Well done to the single politician who spoke about the judges convicted of criminal offences!
I'd like to point something out to Mr Cherbi although I suspect he is already aware of this.The Lord President does not need the Scottish Parliament or Scottish Government to legislate the judiciary to maintain a register of interests dimply because the Lord President has the power to enact it himself.I'm sure Peter must be aware of this because the publishing of Judges expenses which Mr Cherbi's earlier campaign brought about was enacted without any intervention from Holyrood.

THE Crown Office came under fresh pressure yesterday to name a judge who has been convicted of benefit fraud.
SNP MSP John Finnie, a member of Holyrood’s justice committee, added his weight to the demands for the cheating judge to be publicly identified.
It emerged at the weekend that six judges have been convicted of offences since 2005.
Five were found guilty of road traffic offences but one of them admitted fiddling benefits.
It is not known whether the person was a high court judge, a sheriff or a justice of the peace.
Nor is it known how much cash was defrauded.
The Crown Office, who will not even confirm if the judge was male or female, insisted secrecy was “in the public interest”.
But Finnie said yesterday: “The law should treat everyone equally, regardless of who they are and what they do, and this is something that should be looked into.”
The Crown Office often name and shame benefit fraudsters by issuing press releases about them.
Campaigner Peter Cherbi, who uncovered the secrecy, said: “People in front of a judge should know if they have a criminal record.”

Must disagree as this is certainly not a waste of time now people are actually talking about it.Now if only the rest of the press would take up the issue then we might get somewhere.After all in who's interests is it that judges are allowed to get away with not declaring their financial/other interests?

FirstGroup buses Iain Gray's plans focus on bus routes, timetables and fares
The former leader of Scottish Labour has proposed a parliamentary bill aimed at strengthening regulation in the Scottish bus industry.
Iain Gray wants local councils to be able to bundle together profitable and loss-making routes and offer them as a package bus firms can bid for.
His plans also include monitoring the quality of vehicles used.
The proposed Regulation of Bus Services (Scotland) Bill comes after an earlier attempt to strengthen bus regulation.

Surely this can not be correct. [THEY DO THIS BECAUSE THEY CAN] This is what I would have expected in some of the third world countries I have worked and was well warned of. I then had a leaflet [OH YES THEY WORK] handed to me by a young girl in her early teens it explained how her grandfather had battled with the Legal System and had involved politicians all to no avail. [ALL THE SAME UNIT] Having read through the leaflet it would appear that there is absolutely no point trying to persue a complaint through the "SYSTEM" [SPOT ON YOU ARE 100% CORRECT] and it would appear MSP's have no input whatsoever !!!! [OH YES THEY DO, THEY SHAPE POLICY TO PLEASE THE LSS NOT THE PUBLIC] what are they there for, if my local MSP has a local meeting or surgery I certainly want some answers and I will record the event lets all do the same ,this "mess" can not be allowed to continue let us all unite through D.O.I.

Tugendhat meant the legal profession cannot claim damages when Solicitors from Hell feedback was true so use harassment laws to close the site. And he is a member of the Law Society of England and Wales.

Have to agree with those who say this wont go anywhere and this is probably to do with the fact the judges are dishonest and have been for a long time.If they start declaring now and someone gets wind of them changing around their finances or interests before a register takes effect we will all know for certain they have been skewing verdicts in their vested interests for years.

Again this will come down to how we can trust the judges to be honest and fill in their register of interests and then how will it be regulated and what sanctions will exist if a judge is discovered to have withheld information.Like most of the comments here I dont think the judges can be trusted and a good example of this is the politicians who are already required to register their interests but we always see a few of them caught out failing to declare and also fiddling their expenses and guess what,they usually keep their jobs.That being said I support your idea 100% and hope it becomes law soon.This will give us a great insight into these people sitting at the top of the courts system and what they get up to.

ReplyDeleteI have heard lawyers talking about judges and which ones they prefer to be in front of because they know the judge is involved with another law firm or has a bias or something like that so this information is not so far away if the lawyers know about it to that extent.

ReplyDeleteI know exactly what is going on here because I was at the Court of Session last year for my medical injury claim only to be told by my solicicitor that my QC had to be careful what he said because the judge in our case was friendly with the law firm representing the insurers and was a regular at their offices.If it helps any I can send you the stuff on my case and my counsels opinion saying everything was in my favour yet I lost of course and my solicitor pins the blame of it on the judge himself and the regular dishonesty of the defenders in court.

Whatever the difficulties or more like obstructions put in the way of making this happen I believe it has to happen and the judges must be made as accountable as the rest of us have to be.

Either way something like this has to be a warning what Scotland will be like under independence as in the public not having the right to know about the justice system and probably not having any rights at all.

ReplyDeleteI asked my msp to help me with a problem about a complaint to the Law Society and he never replied not once.I tried to get an appointment to see him and his secretary refused.She actually threatened me with the Police on the telephone when I asked her why I could not see my msp (he is a Scottish Conservative but the story does not stop there).I approached my list msps (SNP and Liberaldemocrat) and did not even get an answer to I also called them by telephone both times I was told not to contact either again.So I let my former solicitor know he was going to be in the newspapers and on this blog and I received all my papers back illegally withheld from me and a complete cancel of his fees which formed part of the complaint.I am presuming all the politicians are bribed not to do anything to help people like me so it has to be the media to expose a crooked solicitor.
Maybe you should start looking into how many msps actually help their constituents who have problems with solicitors I think the number will be very small!

THE Crown Office came under fresh pressure yesterday to name a judge who has been convicted of benefit fraud.
SNP MSP John Finnie, a member of Holyrood’s justice committee, added his weight to the demands for the cheating judge to be publicly identified.
It emerged at the weekend that six judges have been convicted of offences since 2005.
Five were found guilty of road traffic offences but one of them admitted fiddling benefits.
It is not known whether the person was a high court judge, a sheriff or a justice of the peace.
Nor is it known how much cash was defrauded.
The Crown Office, who will not even confirm if the judge was male or female, insisted secrecy was “in the public interest”.
But Finnie said yesterday: “The law should treat everyone equally, regardless of who they are and what they do, and this is something that should be looked into.”
The Crown Office often name and shame benefit fraudsters by issuing press releases about them.
Campaigner Peter Cherbi, who uncovered the secrecy, said: “People in front of a judge should know if they have a criminal record.”

Whoever spurted out the lie, 'in the public interest' to conceal criminal behaviour by these unelected and unaccountable so-called public servants, should be arrested forthwith?
The reason that they do no not want to reveal these judicial criminals is precisely to keep the criminals in their job. Unaffected and above the law?
Their reasoning is this....that their trying to conceal judicial criminality from the Public means that they will not have to do the right thing (obey the law) because by doing so, all of the cases presided over by these judicial criminals would by any normal persons judgement be unsafe (because the judges' judgement is seriously flawed.....i.e. the judges, by their own unlawful actions, do not know the difference between right and wrong) and this would cause unbelievable turmoil within the judicial system bringing it to a halt and where all parties to the process would cease to have any faith in the system?
So, in order for the system to continue as normal (i.e. to maintain the status quo) we have to have criminals as judges, to keep the wheels oiled and to make sure these crooks continue to sneak cash from the Public coffers?

Remember the crooked Scottish lawyers Court, the SSDT (Scottish Solicitors Discipline Tribunal) otherwise known as the Edinburgh Luncheon Club, when considering the sanction to be taken against crooked Scottish lawyers who had been caught steeling money from their clients, found that they had BORROWED THEIR CLIENT'S CASH WITHOUT CONSENT !!!? Why not make them undergo psychometric testing to evaluate their fitness of purpose to be a Judge/ Sheriff, which would have the added benefit of identifying all of the pedophiles, thieves and crooks too?

I asked my msp to help me with a problem about a complaint to the Law Society and he never replied not once.I tried to get an appointment to see him and his secretary refused.She actually threatened me with the Police on the telephone when I asked her why I could not see my msp (he is a Scottish Conservative but the story does not stop there).I approached my list msps (SNP and Liberaldemocrat) and did not even get an answer to I also called them by telephone both times I was told not to contact either again.So I let my former solicitor know he was going to be in the newspapers and on this blog and I received all my papers back illegally withheld from me and a complete cancel of his fees which formed part of the complaint.I am presuming all the politicians are bribed not to do anything to help people like me so it has to be the media to expose a crooked solicitor.
Maybe you should start looking into how many msps actually help their constituents who have problems with solicitors I think the number will be very small!

I am utterly astonished that known criminals are pretending to be Judges / Sheriffs?
ReplyDeleteHow can a convicted criminal (someone who has demonstrated by their actions that they do not have the understanding or moral faculty to know the difference between RIGHT & WRONG, where their judgement cannot be relied upon) be allowed to continue to be a Judge / Sheriff, where their very judgement is required to impartially make life-changing decisions against members of the public?
Answer?
It is a CRIMINAL OFFENCE for these convicted criminals to continue to act (pretend) as a Judge/Sheriff and only a totally unmoral and sick society such as Scotland's could allow such a bizarre state of affairs to exist?

The Scottish Government & Parliament: We have no opinion whatsoever. The Law Society of Scotland dictates policy for us and we are too frightened to oppose them such is their power?

ReplyDeleteI saw that rather snooty rebuff by the Supreme Court justices over the idea of a register of interests however what they are forgetting is before they had the Supreme Court this was handled in the House of Lords were all members have to submit a register of interests http://www.parliament.uk/mps-lords-and-offices/standards-and-interests/register-of-lords-interests
So, all in all a very good idea from New Zealand to extend this idea to our judiciary and very happy to see someone like Mr Cherbi able to raise it in the terms he has.Good luck all.

If any of your constituents write to you complaining about a Scottish lawyer report this to us as quickly as possible and we will tell you how to deal with it?
Some standard tricks are to not to respond to them at all, even if they have asked for your response.....then when the make contact again, simply deny receiving their initial letter, email or phone call....continually say that you will offer help but you never do, this will frustrate and exacerbate them so much that they will become distressed, then you can say that you are discontinuing dealing with their concerns under a bogus unacceptable behaviour policy, making them give-up and hopefully kill themselves off.....Problem solved?

The Scottish judiciary has no longer got any confidence of the Scottish Public?

Well if the Law Society of Scotland et al had any sense of abiding by the law (which by their actions they don't) then they would have already reported these crooks to the Police a long time ago?
No. They have very conveniently stayed silent?
Is this why the Scottish Government have rushed in the double jeopardy rule, whereby a charged person can be prosecuted twice for the same crime, if the first prosecution fails (i.e. the Defence Advocate uses the ultimate sanction to get his client off by whispering to the Judge that he is going to claim the prosecution against his client as ultra varies because the judge - being a convicted person - has shown that they no longer have a reliable judgement?)
Thereby, they can quickly annul the first case and wheel in a different judge to prosecute the person again?
That they would rather go to these extraordinary lengths of bringing in double jeopardy rather than following the rule-of-law and sacking the convicted judges for being unfit to be able to carry out the duties and responsibilities of a lawful judge?
This whole example brought to the Scottish Public's attention by the DOI team shows just how rotten and corrupt Scotland has become?

A bent lawyer is behind the firm offering hypnotherapy sessions to pupils at a Hamilton secondary school.
Tony Murphy, who was struck off for taking from clients’ accounts money to which he was not entitled, is running the Lanarkshire Hypnotherapy Clinic from a building in Barncluith.
Earlier this month, the Advertiser told how signs were posted outside Hamilton Grammar and in the vicinity of the University of the West of Scotland offering hypnotherapy as a cure for exam stress.
Parents were told that the sessions would give their children “an extra edge”.
However, South Lanarkshire Council said there were other established ways to deal with exam stress.
The Advertiser phoned the number on the sign but there was no reply.
However, parents of children at the Grammar say the advertiser was Mr Murphy who previously had a legal business in Hamilton and in November 2011 was found guilty of professional misconduct by the Scottish Solicitors’ Disciplinary Tribunal.
He took deposits from property buyers then acted in the sale of the development to another company.
Only part of the deposits were returned.
He was also found to have failed to account to the liquidators of two companies and to have falsely represented to Law Society officials that his accounts had been destroyed in a flood.
Now, after watching clients’ cash disappear he is now offering to make people’s anxieties vanish by offering hypnotherapy services and neuro-linguistic programming.
Neurolinguistic programming is a controversial therapy with little scientific evidence to back its effectiveness.
He works from a `clinic’ in a former utilities building at the corner of Carlisle Road and Old Avon Road.
The clinic’s website states that it is run by “Tony Murphy `D.Hyp (MIAPH), LLB, Dip LP’, a professional hypnotherapist registered with the International Association of Pure Hypnoanalysts.
He claims to practise `pure hypnoanalysis - the single most effective form of hypnotherapy available’ – and `suggestion therapy’
According to the site, Mr Murphy can help with problems such as smoking, fears and phobias.
He charges £65 for `children’s problems’ and £199 for a full course of weight loss sessions.
There was this week no sign of Mr Murphy at his luxury home in Barncluith nor at the clinic. He also failed to return telephone calls requesting information about the signs and his new career as a hypnotherapist.
A parent of a pupil at Hamilton Grammar said: “I was glad, following the Advertiser story, when the sign outside the Grammar was taken down - particularly when I discovered who was promoting it.
“There’s one of his signs still up in Muir Street, Hamilton, and that should be taken down as well.”
Another parent added: “There is something not quite right offering to hypnotise kids to get them through exams.”
South Lanarkshire Council say hypnotherapy was not something they would actively promote for use to relieve exam stress.
Who monitors the Lord President and the rest of them, they do. Law Society staff are in the SLCC, and Parliament. In the latter they are called MSP's. They have achieved domination by bureaucracy and covered it up as democracy. Legal equality is a myth, this blog proves this fact.

Actually this petition may end up as a great indicator of Scots justice as in completely prejudiced and lacking ANY transparency whatsoever!
