Clients snared in £18K a year ‘Mediation Trap’ at Scottish Legal Complaints Commission find little resolution as dodgy lawyers ‘play for time’ to avoid complaints investigations

SLCCMediation at Scottish Legal Complaints Commission branded expensive time wasting tactic. A SCHEME set up by the Scottish Legal Complaints Commission (SLCC) to mediate complaints made against rogue Scottish solicitors & law firms by clients has been branded nothing more than an expensive time wasting strategy which more often than not results in failures of outcomes for the client and advantageous lengthy delays to investigations being started into many Scots law firms over serious complaints made about their service.

In the past year alone, mediation at the Scottish Legal Complaints Commission has cost upwards of EIGHTEEN THOUSAND POUNDS, with a significant number of cases being sent back to investigation after the lengthy mediation process failed.

Clients who have been stuck for months in what has been dubbed by some as a ‘mediation trap’ have recently contacted Diary of Injustice, reporting numerous difficulties and a breakdown of expectation after false promises of amicable conclusions or a ‘sorting out’ of difficulties between clients & solicitors, which have more often than not disappeared during the time it has taken mediation cases to progress, with many clients finding their solicitors have been much less than honest during the mediation process.

As part of an on-going investigation into the viability of mediation between clients & solicitors who have provided expensive, yet poor, often negligent legal service, Diary of Injustice asked the Scottish Legal Complaints Commission to disclose its latest records of medication cases.

MEDIATION slcc FOIbmp_Page1The SLCC responded via a Freedom of Information legislation, disclosing information which makes extremely poor reading for any clients who are currently being cajoled by the SLCC into what is clearly a very poor mediation scheme with little results :

1. 91 cases have been put to mediation in this last year (i.e. since our last annual report).
2. There has been 58 successful mediation outcomes
3. There has been 33 mediation failures
4. The number of mediation outcomes accepted or rejected by complainer/solicitor is not applicable - if either party does not want to agree, there is no settlement. Such a mediation falls within the number of "mediation failures",
5. 33 mediation cases were sent to Investigation (if a mediation fails, the case goes to Investigation),
6. 0 mediation cases have been abandoned
7. The cost of all mediation cases equals £18028.29

While the above figures reveal some 58 ‘successful mediation outcomes’, it appears clients in several of these cases had to settle for much less than they expected to gain from the mediation process.

After DOI journalists made further enquiries of legal sources, it will surprise no one to lean that most of the outcomes in what the SLCC have dubbed ‘successful mediation outcomes’ appear to have disproportionately benefited the law firms & solicitors being complained about more so, than the client victims who were forced to go to the SLCC because of poor legal services undertaken by their solicitors.

There is also evidence to support claims from some clients that solicitors & law firms have been using the SLCC’s mediation process as little more than a delaying tactic to prevent full complaints investigations by regulators which could result in stiffer penalties and media exposure for those in Scotland’s legal profession who consistently abuse their clients.

Speaking to Diary of Injustice, a legal insider said it was common knowledge that law firms were abusing the mediation process simply to avoid investigations into their conduct. He also claimed material from the mediation process has been seen on an almost ‘live basis’ by the Law Society of Scotland & solicitors acting for the Legal Defence Union (LDU) who have previously been reported to have been involved in secret no-notes taken meetings with the highest ranks of the Scottish Legal Complaints Commission, featured earlier by Diary of Injustice in a report here : Investigation reveals Scottish Legal Complaints Commission's links, secret 'off the record' dealings with lawyers lobby group Legal Defence Union

A client who has been stuck in a months long mediation case which ultimately failed described the whole process as “a complete waste of time which only benefited the lawyers and has probably ruined any chance my complaint about my solicitor ripping me off will ever be properly investigated by the SLCC.”

The SLCC have issued no further comment or details on the types of cases entering into its mediation scheme, nor have they published the details of those thirty three cases which have failed and then been put back into the investigation loop.

  3. Lawyers generally rub their hands when someone shouts MEDIATION anyway because of all the money involved and not to mention the fact a lot of the mediators are probably lawyers themselves.

    Wonder why the SLCC dont want to talk about the topics of the failed cases v the resolved ones?

    I imagine the critical complaints failed while the simple fiddles were talked away and marked 'resolved'

    Self regulation is like a straitjacket. It severely confines, constricts, or hinders the client’s ability to defend themselves. It is the one critical factor encouraged by MSP’s underpinning lawyer corruption. Readers of A Diary of Injustice I ask you, would you commit an act of evil against yourself ? Whether you realize it or not reporting a lawyer is an act of self inflicted evil. They cannot self regulate if you refuse to deal with the Law Society or Scottish Legal Complaints Commission.     Report you case to the DOI team.

    By all means use flyers and posters, against lawyers (AND YOUR MSP), if they refuse to help you. Yes they form policy to protect lawyers not you.

    You could ask your local newspaper shop to pop a flyer into each paper they sell as well as those posted through letter boxes, so that you can tell the truth about your situation, as you will surely be providing a good service to your community?

    Anywhere people gather distribute leaflets to warn them.

    Stop the Law Society and Scottish Legal Complaints Commission and your MSP’s maniacal pursuit of CONTROL over you?

    Protect your children when they grow up by acting now.

Thanks for the update and hope you post some more soon anyway all I can say about this mediation is that after having been through hell with my solicitor,his odious complaints partner and then the SLCC and Law Society of Scotland I just dont understand why anyone would bother with mediation.Take it from someone who has been pursuing his thieving rat of a solicitor for the past six years there is no chance mediation will bring any benefits to you after what your solicitor did behind your back!

  10. It so happens a friend of mine was talked into mediation with his lawyer only to come out of it badly so I imagine a few of these people are just as munch on the rocks financially as he is.A trap if ever there was one but easily avoided now you have written about it.

Be very aware this individual is only interested in the money and has no intension of getting you compensation for what the employer has done to you. Look at poor Mr Gordon she destroyed his case and billed him for the privilege and we all know who she is and the rip off firm she works for. Stay Away!!!!!!

I'm minded to believe the 33 failures are probably the more important complaints the SLCC and the solicitors were trying to keep away from investigators.It would be handy to know how some of these failed cases have faired under the investigation process whether ending up as the typical whitewash or actually resulting in action against a solicitor.

  18. Each firm of solicitors has, or should have, a Practise Manager.

    This post is normally occupied by the senior solicitor and its purpose is to allow clients dissatisfied or concerned with any aspect of that firms work for them to report this to the Practise Manager who can mediate and attempt to find a solution.

    Your report describes yet one more exercise by the SLCC in 'passing the buck' - ably assisted by the Law Society of Scotland and Solicitors defence union lurking in the shadows.

    A con from start to finish, like so much of the Scottish 'justice' system.

    Friends why do you deal with those in an office who can engineer the solution they want?

    In the lawyers world there is no law, just like a world where there were no governments. I promise you lawyers don't want leaflet distribution in near their offices because that is public, not secretive like their complaints structures. They have designed a perfect system for extortion because they know punishment will not happen. Report a lawyer and the whole profession are against you. Go public with leaflets because that is where the clients are.

    "In brief, the Scottish Legal Complaints Commission investigates complaints made against legal practitioners in Scotland. MR GORDON STARVED AND KIPPEN CAMPBELL PROTECTED. We operate wholly independently of the legal profession [LIARS]] and government, and are impartial,[LIARS] accessible and independent".[LIARS].

    When I look at their web site or the Law Society web site, I think print 1000, leaflets about my lawyer and hand them out in my home town. This is far more productive and prevents the utter torture of complaining to people who hate my guts. When all roads leading to Rome close [or in this case Edinburgh} go public yourselves.

    Target the potential clients in your town to warn them instead of a futile battle with people who think it fine for lawyers to ruin you for their lifestyles. They froze a man's Disability Benefits for four months illegally and the Law Society and SLCC do nothing to protect him.

    What manner of evil are we dealing with, what type of persons can do this to clients who have zero protection. Pure evil. Link all the complaints structures and link all lawyers, employers and insurers. It is not about justice, it is about reputations and money.

    Practice manager Smith at blogs solicitors protects crooked lawyers.

    Clients you will never get justice against a lawyer if you stay within their bent complaints procedures. They were designed to protect them not us.

    Law Society, Scottish Legal Complaints are obsessed with protecting lawyers. Again we see the clients life getting worse because he or she trusted these bureaucracies. People need to realize reporting a lawyer to lawyers is utter madness.

    One hundred leaflets where the lawyer works will do more damage in a short time than going to these human rats.

  27. Is it not typical of the Client Hating SLCC that nearly 40% of cases going to mediation have collapsed into failure?

    This mediation process is a total corruption of what the Legislation promised, as it is being used as another tool to frustrate and torture the innocent victim of Scottish crooked lawyers?

    If it was genuinely being run as a system to provide a relative Justice for the innocent victims of crooked Scottish lawyers, as well as protecting the crooked Scottish lawyers' disciplinary record (which is the SLCC's only motivation with 'their' system) then there should be a double demerit for the crooked Scottish lawyer if they do not settle under the mediation process?

    Double demerit being a double sanction penalty against them, so that there is an incentive for them to settle......Because the Mediation Process that the SLCC are employing is MASSIVELY IN-FAVOUR of the crooked lawyer as they can effectively buy themselves a cleaner disciplinary record?

    This double demerit could be designed to hand the punishment of a double penalty of disciplinary finding against the crooked Scottish lawyer or a double financial penalty (effectively a fine) whilst the case be sent for further investigation?

    However, it is clear from the statistics that the SLCC are using the mediation process as a threat to the innocent victim of the crooked Scottish lawyer by inferring if you don't take the cash being offered then the chances are that we will find in favour of the crooked lawyer anyway???

    Unfortunately, as a result of the crookedness of the person they trusted (crooked Scottish lawyer) the innocent client feels forced into going to the SLCC in the first place and if their crooked Scottish lawyer has stolen from them (which is a very common occurrence) then the innocent victim is pressured into accepting the offer of a cash settlement?

    When it turns out that the SLCC's Mediation deceit system is only set-up to allow the crooked Scottish lawyer to buy-off a cleaner disciplinary record in place of an insulting cash settlement, then this will lead to further anguish and torment for their collective victim The crooked Scottish lawyer's Client?

    They firstly lobby the MSP's hard to accept their late rewriting of the LALP Bill which brought the SHAM SLCC into existence........Then the Law Society of Scotland parachute their own completely corrupt Client Relations Department straight into the SLCC staff uptake and then they incorporate another fraud that is a mediation system that allows their crooked Scottish lawyer members to buy themselves out of a disciplinary bad record which awards corrupt practice and is overt anti-client in plain sight?


    If you took all of these parameters in a well written book of fiction to a publisher.......They would reject it out-of-hand because the proposal was too unbelievable in the real world!!!!!!!!!!!!?

    They will not play for time if your public leaflet states Scottish Legal Complaints Commission protect crooked blogs solicitors High St Aberdeen.

    There is the easy and hard way to expose corrupt lawyers. If the issue is serious enough to the you the client you have no choice. The Scottish Legal Complaints Commission like the Law Society are there for lawyers protection not yours.

  32. Lanarkshire woman loses negligence case

    Sep 27 2012 Hamilton Advertiser

    A LANARKSHIRE woman has lost a medical negligence case, 17 years after the operation she claims devastated her life.

    Janice Hannigan (50) suffered complications following a hysterectony at Law Hospital, Carluke, in 1995.

    She was afflicted with significant pain and is still suffering the effects today.

    A number of other problems which occurred following the operation, caused her quality of life to deteriorate, and she blames them directly for the end of her promising career at the Bank of Scotland.

    She recently took NHS Lanarkshire to the Court of Session, and Lord Tyre published his opinion on the case on Friday

    Had negligence been proven, Mrs Hannigan who lives in Motherwell, would have been awarded a payout of around £46,000.

    However, Lord Tyre did not believe this was the case.

    He accepted there was a link between the issues suffered by Mrs Hannigan, and damage caused during the operation.

    However, on the evidence led by a number of expert witnesses, Lord Tyre decided that Doctors Lennox and Ikedionwu, who had carried out the operation, had followed “ordinary practice”.

    For a doctor to be found negligent it must be shown he did not act in accordance with normal practice.

    Two of the expert witnesses who gave evidence during the case, felt the way in which the procedure was carried out was different from how other doctors would do it.

    But two other experts said Mrs Hannigan’s operation was in accordance with ordinary practice.

    On the basis of this, Lord Tyre said: “I therefore hold that the injury to the pursuer which occurred...was not caused by negligence of the surgeons who carried out the operation.”

    He found in favour of the health board, and Mrs Hannigan will not be paid any compensation.

    She has the right to appeal the decision.

Central Ayrshire Labour MP Brian Donohoe said: “It seems major organised criminals and terror suspects qualify for unlimited Legal Aid, yet I have constituents who don’t get a penny simply because they have a few thousand pounds of savings. “The system in Scotland and the rest of the UK is out of control.”

    And what about your constituents Mr Donohoe who cannot get a lawyer to sue another lawyer. "Major organised criminals" are also the Law Society of Scotland, and its membership evil, utterly ruthless and above the laws of Scotland.

But none of the 14 reported to prosecutors was put in the dock, prompting claims that Scotland’s legal self-regulation system protects lawyers. Kilmarnock solicitor Niels Lockhart, who took £600,000 in Legal Aid in just two years, was found to have made “unnecessary and excessive” claims.     That will never happen Yelland. Hannah Arendt wrote "bureaucracy or a system of bureaus where so one is held accountable for what is being done and it is impossible to identify culprits".

    She was right, you cannot serve two masters, that is why clients are mad not using public leaflets to overcome your bureaucratic secrecy.

While the article on mediation makes for grim reading in terms of how the Law Society of Scotland & Scottish Legal Complaints Commission handle aspects of complaints investigations and mediation cases, consumers must go through the current regulatory process of making a complaint regarding any poor or negligent legal services provided by their solicitors, even if that process fails, otherwise there is simply little that can be done in terms of reporting on injustice caused by the legal profession and campaigning for better, independent regulation to protect all consumers.

    Thanks for putting us right,I was getting tired of those comments about the do not report your lawyer crap and make a leaflet stuff because none of this works and the only way there will ever be some change is when the media takes notice of people's difficulties like you are doing a fine job of getting across.
