Solicitors regulator blamed for failure to use powers on fees as accountants seize Disability benefits to pay Perth law firm for collapsed court case

Jane Irvine SLCC ChairJane Irvine, SLCC Chair : £300 a day for some, benefits seized to pay lawyers for others as regulator accused of failure to clip disputed fees. PERSISTENT FAILURES at the Scottish Legal Complaints Commission (SLCC) including A RELUCTANCE to use key powers which enable the ‘independent’ regulator of Scottish lawyers to reduce or even nullify fees of solicitors who ruin their clients legal interests are being blamed for the predicament of a Mr William Gordon of Perth, who has now been made bankrupt by Perth based law firm Kippen Campbell, over demands he must pay fees for a case which collapsed because his lawyers withdrew from acting for him.

Mr Gordon’s plight comes as a result of a series of bitter, ‘one sided’ court actions held in Perth Sheriff Court, where agents acting for Kippen Campbell demanded Mr Gordon be sequestrated to pay fees they claimed were due to them for legal services provided for a medical damages claim being heard in the Court of Session. However, documents obtained by Diary of Injustice in connection with complaints made to regulators show the Perth law firm walked away from Mr Gordon’s case after he made complaints about their service & conduct to the Scottish Legal Complaints Commission, who typically, backed the law firm despite considerable allegations of service failures provided by Mr Gordon to the SLCC.

Diary of Injustice has previously reported on Mr Gordon’s case, here : Personal injury client dropped by Perth based solicitors Kippen Campbell ‘being hounded’ by court attempts to recover disputed fees

Earlier this week, it was reported by the media that Glasgow based accountants Wylie & Bisset, who are now pursuing Mr Gordon, attempted to seize his home (even though he does not own it) and the home of another family to pay back the Perth law firm for debts the law firm claims were incurred on Mr Gordon’s damages claim in the Court of Session, now ruined because he is unable to obtain any further legal representation.

Scottish Law Reporter quoted an article from the Herald newspaper, and further reported HERE : Glasgow based accountants Wylie & Bisset who are acting on behalf of the Accountant in Bankruptcy, sent demands to Kippen Campbell’s former client Mr Gordon who lives in Perth, threatening seizure & sale of his property, which he does not own, and the seizure & sale of another property owned by an unconnected family who live in Rattray, Blairgowrie, whose surname is also Gordon.

Threatening letters – Pay up for lawyers fees or we make you homeless say AIB’s agents. In letters sent to Mr Gordon, Wylie & Bisset demand a “required payment” of NINETY TWO THOUSAND & FIVE HUNDRED POUNDS, and goes on to threaten “We require firm proposals for the realisation of the sum in question to your sequestrated estate as a matter of urgency. Should we not receive your proposals within 14 days of the date of this letter, then please be aware that we shall be forced to seek action for vacant possession of the property.”.

The property which Wylie & Bisset were attempting to seize and had valued, at £185,000, was located in Rattray, Blairgowrie, and owned by a family unconnected to Mr Gordon. Yet the debt allegedly owed to the Perth based law firm amounted to little more than £2,700, which now appears to have increased to some £6,600 taking into account several hearings at Perth Sheriff Court which have artificially inflated the original demand for the disputed legal fees. Another demand sent to Mr Gordon from Wylie & Bisset, just a few days after the earlier threat, stated : “Please note that should suitable proposals not be received in writing, within 7 days, then we will have no alternative but to instruct a solicitor to raise proceedings in court for the forced sale of your property.”

aibAccountant in Bankruptcy, Scotland’s insolvency service with added errors. The Accountant in Bankruptcy was asked by Diary of Injustice to explain why their agents, Wylie & Bisset attempted to seize Mr Gordon’s rented property and that of another family. However, a spokesperson for the AIB explained away the attempted property grab as “errors”, telling Diary of Injustice yesterday : “As previously advised, Wylie & Bisset are one of AiB’s Insolvency Service providers and are required to administer cases in accordance with our processes. The administration of sequestrations is a complex task where a range of information is obtained from various sources.  During this process, it is possible for errors to occur, though the Accountant in Bankruptcy is satisfied that our providers give a consistently high standard of service when acting on our behalf.  Where errors are discovered, our providers are required to review their processes and make necessary changes to ensure that similar errors are not repeated.  In cases where individuals have been negatively affected by an administrative error, our providers will attempt to rectify the issue as soon as possible and where appropriate, will write to apologise for any inconvenience caused."

Further enquiries by Diary of Injustice have now established Wylie & Bisset, acting on behalf of the AIB have also frozen Mr Gordon’s Lloyds TSB bank account and seized his disability benefits payments, leaving him without any cash to live on whatsoever. Documents & copies of communications between the bank & Mr Gordon appear to show the bank simply froze Mr Gordon’s account on a telephone call ‘say so’ from Wylie & Bisset.

This information was put to the Accountant in Bankruptcy, who attempted to explain away the seizure of Mr Gordon’s benefits by claiming they had no idea what the source of payments into bank accounts were.

A spokesperson for the AIB claimed : “Where a trustee discovers that the debtor has a bank account, they may contact the bank to have the account frozen.  This action may be appropriate to prevent the debtor from inappropriately withdrawing funds after the award of sequestration. Where an account has been frozen, it is the responsibility of the debtor to contact the trustee to make representations around the money held in the account. This is particularly important where the debtor is reliant on state benefits that are paid directly into a bank account, as the trustee is unlikely to be aware of the origin of the money held in the account. This scenario can be avoided if the debtor co-operates fully with the trustee and provides information on their income and savings."

However, a senior official from one of Scotland’s Consumer organisations speaking to Diary of Injustice this morning rubbished the AIB’s claims of ignorance, and pointed out it was against the law to seize state benefits under section 187 of the Social Security Administration Act 1992 which clearly states “On the bankruptcy of a beneficiary, such benefit shall not pass to any trustee or other person acting on behalf of his creditors.”

She described the AIB’s actions as : “An attempt to starve out Mr Gordon to pay off his lawyers.”

The official went onto inform Diary of Injustice that her organisation has received numerous reports of law firms threatening clients with bankruptcy if they did not pay what appear to be dubious demands for fees. In other cases, law firms have simply gone ahead and made their clients bankrupt without even giving them a chance to question the legitimacy of the fees claimed to be owed.

Speaking to Diary of Injustice late last night, a senior source in the Scottish Government acknowledged there is a growing problem with law firms threatening clients over legal fees, an issue which has also been brought to the attention of some msps.

He went on to say he believed law firms were using their influence in local courts to easily obtain bankruptcy orders against clients who have little or no chance of obtaining legal representation to challenge the law firms demands.

Meanwhile Mr Gordon is running short of cash while the Accountant in Bankruptcy and their agents run up large charges to the taxpayer in the course of pursuing a client who has no access to justice to challenge what has been done to him, in the name of paying a firm of lawyers based in Perth. Mr Gordon is without legal representation and his doctor has told Perth Sheriff Court on numerous occasions his patient is too unwell to attend court hearings.

The unavoidable conclusion is Mr Gordon’s predicament could easily have been avoided if the Scottish Legal Complaints Commission had listened to him during the course of his complaint, and at the very least, reduced or nullified the fees of a law firm who walked away from their client when he discovered his case was not being pursued as he had instructed.

Diary of Injustice has previously reported how Ms Sally McCartney, the partner at Perth based Kippen Cambpell who dealt with Mr Gordon’s case, wrote letters to the Scottish Parliament CAMPAIGNING AGAINST independent regulation of the legal profession, also ARGUING AGAINST plans to increase compensation to clients of lawyers who had provided poor services, reported here : Scottish Parliament documents reveal Perth law firm in complaint fees case campaigned against Holyrood clean-up of regulation of lawyers

  1. Best wishes for Mr Gordon to overcome our thuggish justice system.

I agree, and if Mr Gordon's employers were insure by Royal Sun Alliance, Kippen. Campbell are also insured by Royal Sun Alliance, the Sheriffs at Perth Sheriff court are also Insured by Royal Sun Alliance. Ross Harper dropped me too Mr Gordon, Scotland's lawyers are all the same, they have no one to answer to other than their own. These people have despotic power it is Mr Gordon V The Scottish Legal Profession. Mr Gordon will find it, impossible to get a law firm to help him.

I know victims of litigation and the lawyers are bad bastards who bury evidence to save insurance companies. You are fighting a system you cannot beat Mr Gordon, these people would murder you before they would get damages for you. Your lawyers are part of your employers defence team, litigation provides income for doctors and lawyers, never damages for the client. I write from personal experience.

Another report an accountancy mafia, seizing disability benefits. Well these people would take all you have, and they are ruthless deviants masters of injustice. We see this again and again and again. Lawyers have starved people before by colluding with doctors to stop benefits to starve litigants into submission, remember Mr (XXXXXXX XXXX) you did it. Cold devious ruthless bastards is what they are. Some of them would have been perfect candidates for Hitler's SS they are so ruthless.

SLCC doing what they do best. They aint gonna change their spots are they?

  2. I received an e mail today asking me to claim PPI. I sent them an e mail back which stated

"Well when these PPI's were sold lawyers must have known they were not worth the paper they were written on. I do not trust the legal profession so no thank you, I do not want your help".

They are regulated by the Ministry of Justice, be the same as the Law Society or the SLCC. I do not trust anything to do with lawyers, accountants, financial advisors, doctors. The legal, and accountancy professions always want to help people when there is £ in it for them. Look at them now, seizing Disability Benefits. I like many others learned the hard way, there is nothing out there to fight these professions other than campainers. They control everything to their benefit.

Somewhere out there other victims are being lined up for the chop, get educated about these professions, do not learn the hard way.

EVERYTHING ABOUT THESE PROFESSIONS ARE ONE SIDED, THAT IS WHY THEY ARE SO DANGEROUS. A MEDICAL DAMAGES CLAIM. THE LAWYERS, DOCTORS WILL BE INSURED BY ROYAL SUN ALLIANCE. WHY IS THIS LAW FIRM TRYING TO SUE MEDICAL PROFESSIONALS INSURED BY THE SAME COMPANY AS KIPPEN CAMPBELL? THEY ARE JUDICIAL GANSTERS.

Partners at Kippen Campbell allege the fees are due, even though the law firm dumped their client, [SAME AS ROSS HARPER DID TO ME, MAKE THE MONEY AND KILL THE LITIGATION OFF, THEY ALL OPERATE THE SAME WAY.] Mr William Gordon, in a move which brought to a halt any progress on Mr Gordon’s personal injury claim as he has since been unable to secure legal representation.[SAME AS ME, A LAWYER TOLD ME THE COURTS ARE NOT FOR PROSECUTING CROOKED LAWYERS. CHRIST THE MAN IS TYRING TO CLAIM DAMAGES FROM THE LAW SOCIETIES INSURERS. THIS HAPPENED TO ME AND WHEN MY LAWYER SHOULD HAVE BEEN PUTTING THE BOOT INTO MY EMPLOYER HE BACKED OFF. IT IS A LITIGATION SCAM, THEY NEVER INTENDED TO GET YOU DAMAGES MR GORDON. I HAD NO MONEY FOR FIVE MONTHS, THE LAW SOCIETY WOULD NOT INVESTIGATE, THE SLCC DID NOT EXIST AT THE TIME, NHS PRIMARY CARE IN MOTHERWELL KNEW MY GP WAS CORRUPT BUT DID NOTHING ABOUT IT.

LIKE MYSELF YOUR CASE WAS NEVER GOING TO COURT, THEY ONLY TAKE YOU TO COURT TO GET THEIR FEES,[THAT THEY ARE MORALLY AND LEGALLY NOT ENTITLED TO BECAUSE OF THE INSURANCE ARRANGEMENTS).

THEY LAWYERS AND DOCTORS INSURERS PAYING YOUR DAMAGES MEANS THE MEDICAL REPORTS WOULD NOT HAVE BLAMED VARDY FOR YOUR INJURIES. THEY COVER UP INJURIES ALL OF THE TIME, THAT IS WHAT THEY ARE THERE FOR. THEY ARE PROFESSIONAL CRIMINALS WHO ABUSE PEOPLE FOR PROFIT. A COMPANY INJURES YOU, THEN LAWYERS AND DOCTORS INJURE YOU FURTHER, LETS FACE IT, IF YOU GOT DAMAGES FOR YOUR INJURIES (LESS PROFITABLE FOR THEM). THEY HAVE COVERING EVERYTHING, YOU NEVER HAD A LAWYER, THEY WERE WORKING WITH THE DEFENCE TEAM. PURE EVIL BASTARDS.

JUSTICE COSTS THE LAWYERS, DOCTORS EMPLOYERS AND ACCOUNTANTS MONEY. STRATEGY FOOL THE CLIENT INTO BELIEVING HE CAN GET DAMAGES TO MAKE MONEY, MEDICAL EVIDENCE IS A JOKE, THE OUTCOME OF YOUR EXAMINATION WAS DECIDED BEFORE YOU WERE EXAMINED {YOUR GP ROYAL SUN ALLIANCE TOO].

MY SO CALLED LAWYER WELL KNOWN IN GLASGOW LOOKED ACROSS HIS DESK AND SAID TO ME "WE CANNOT GO TO COURT BECAUSE THE MEDICAL EVIDENCE IS AGAINST YOU". RING ANY BELLS MR GORDON. IF WE MET OUR EXPERIENCES WOULD MIRROR EACH OTHER EXACTLY. IF THE DOI TEAM AND YOU AGREE I CAN GIVE THEM MY CONTACT DETAILS TO PASS ONTO YOU. WE HAVE MUCH IN COMMON WITH OUR CASES.

  6. saw this in the Herald about them trying to take the other house what a disgrace!

    http://www.heraldscotland.com/news/home-news/accountants-target-wrong-mr-gordon.18131357

    Accountants target wrong Mr Gordon

AN accountancy firm handling the sequestration of a man was preparing to seize the home of someone with the same name.

William Gordon, who lives in a rented house in Perth, was stunned to receive letters from Glasgow-based Wylie & Bisset demanding to know how much equity he had in a detached home in Rattray, Perthshire. When he ignored the letter, another arrived telling him a professional valuation had been conducted and the firm would target his share in the equity to cover a debt of £5200 to Perth law firm Kippen Campbell.

In fact, the William Gordon who owns the home in Rattray confirmed he had no connection with his namesake.

He said: "You'd think professionals involved in such a serious business would carry out their job a bit more thoroughly."

The target of the sequestration added: "I pay rent on a modest home in Perth. Why would I be doing that if I owned a lovely detached house 15 miles away in one of the most desirable parts of Perthshire?"

Wylie & Bisset was appointed by the Accountant in Bankruptcy (AIB) to pursue the legal firm's debt. Gordon Chalmers, a partner in Wylie & Bisset, said: "It would be inappropriate for me to add anything further to what you have from the AIB on the matter."

Well Kippen Campbell where are your ethics. You take on a case where the employer and you will have a common link to the insurers. Now if this client was awarded damages your Law Society Master Policy premiums would increase. So even if you and the doctors know he has been injured we have a cover up, you dumped the man at the court doors. I have seen this many times and do you know what makes my blood boil. It is the fact you do not give a F**k for the victim because he is not a client. You knew the case was never going to court. And after you have protected the Master Policy insurers you use the same court this man was dumped in front of to seize his disability benefits. What else can you be other than pure evil. It happened to my sister, same thing but she was starved into submission.

All you people out there if a lawyer tells you he can sue your employer that lawyer is a liar. His Professional Indemnity Insurers would be paying your damages. Kant said "people should never be used a things". Well lawyers use people as things to an end, and coverups of occupational injury bring in much £. I wonder what Kippen Campbell's lawyers would want done to someone who had done top them what they have done.

    Justice = Minimised Profits.

Also how the heck is someone getting paid £300 a day to avoid using their powers to help people or is this the true role of these supposed regulators all along?

Anyone with half a brain between their ears will hopefully now stay the hell away from law firms who do this to their clients

  25. Lodging an official complaint about anyone who works in the legal services industry has long been problematic.

The ever-present threat of expensive legal action routinely puts people off from even criticising a solicitor.

The Legal Ombudsman is designed to help anyone who has a bad experience with their solicitor or lawyer.

In its first full working year to the end of March this year, the Ombudsman received just under 76,000 calls from the public.

Around 8,400 of these contacts resulted in cases which have been, or are being, investigated.

The most common complaint is about cost, in a quarter of all cases, while the most commonly complained area of law is family law (18 per cent), residential conveyancing (17 per cent), probate (14 per cent) and then personal injury and litigation (both 9 per cent).

The ombudsman can award up to £30,000 compensation for anyone who feels they’ve been badly treated by a solicitor, conveyancer, legal executive or barrister.

In addition to the stubborn ignorance of the SLCC - no surprise there - Mr Gordon has been placed under further intolerable stresses by the vultures aided and abetted by an obliging Court.

Just one further example of the SNP's 'banana republic' at work.

  38. Self regulating is ruling, or governing itself without outside interference; operating or functioning without externally imposed controls or regulations.

With this definition it is hardly surprising that the want to keep things as they are. Now they will regard A Diary of Injustice as outside interference, but the reality is that the man who owns the blog's legal aid was stopped by the Law Society and his lawyer was told to drop him.

These lawyers are ruining people's lives and they probably enjoy doing it. In my opinion Mr Gordon's claim was decided BEFORE he went to a lawyer because they always cover these things up. Mr Gordon's so called lawyer and the Vardy legal team were on the same side. This case has been a routine cover up, and like the Atos medical reports, the decisions are always taken BEFORE the person is examined.

Kippen Campbell and their attempts to recover fees from a client they were [not representing] a personal injury claim against Arriva Motor Retailing Ltd & Reg Vardy plc.
How can they claim to represent Mr Gordon when the Law Societies insurers would have been responsible for paying Mr Gordon's damages. It happened to one of my family, Kippen Campbell ABUSED this man because they knew his case was never going to court. But they will take him to court to recover fees when Mr Gordons injuries have been covered up by them.

Only fools believe doctors, lawyers and accountants are honest. Kippen Campbell knew the outcome of the medical reports because Mr Gordon could not have turned up for the examination and the report would still state "Mr X was unable to make a diagnosis.

Litigation doctors and lawyers always cover up occupational injury, that is their job. Mr Gordon like my family member was is fighting a system where all other parties benefit when his injuries are covered up.

Watch Michael Moore's Sicko, [they are witholding treatment that is resulting in the insured person's death when their condition is treatable. Watch this Kippen Campbell and the public will see that in litigation for occupational injury Kippen Campbell are the same as American doctors.

If American insurers pay out patient is saved but has cost the insurance company $100,000. Doctors write condition not treatable, [patient dies] the doctor who saves the insurers the most each month gets a bonus.

Kippen Campbell are the same, linked to the insurance company who would be paying the man's damages. It happend to us, lawyers, accountants, doctors, pure scum.

    ReplyDelete
  39. The following is a summary of what had happened to Mr Gordon, Mr Cherbi, and me and thousands of others, which applies to all of us, [including you if it has not happened to you, your lucky, get educated, save yourself legal hell]. Kippen Campbell, Vardy, Vardy's lawyers, will be insured by Royal Sun Alliance. The following explains why Mr Gordon cannot secure legal representation from what is a legal mafia who protect vested interests.

"Here's an example, although the same applies if you go up against many other professionals - who are insured by the same insurers, Marsh, RSA & the remainder of the group who comprise the Master Insurance Policy.

If you try and sue a lawyer, you will find your lawyers are insured by Marsh & RSA, your crooked lawyer and their lawyers will be insured both by Marsh & RSA, the Sheriff or Judge in your case is a subscribing member of the Law Society of Scotland and this is also be insured by Marsh & RSA, and several of the Scottish Courts Service staff, as well as the Auditor of the Court, have similar insurance arrangements.

I think anyone would agree there is a problem in that - a client is fighting a system where everyone except the client, pays into the same insurance arrangement the client is trying to claim against.. There is certainly a conflict of interest, which time & again, prevents negligence claims against crooked lawyers from ever getting a fair hearing. How can a member of the client go into court when everyone except themselves is insured by the same insurers and all except themselves will benefit if their claim & case are dismissed ... Most people would call that a fit-up".

Yes DOI Team spot on, I go further it is criminal what is happening to people. Scotland does not have a justice system. It is a system of lawyers and magistrates who lock the doors of the Scottish Courts to any member of the public who wants to claim damages from an employer or a professional. It is simply a legal dictatorship.

If you get injured at work Law Firms like Kippen Campbell will take your case on. But they will never be working for you. If they got damages for you, THEIR INSURERS WOULD HAVE TO PAY THE DAMAGES. Ross Harper did the same to me. Your employer is negligent, the legal, medical and accountancy teams are calculating.

Occupational injury in Scotland = £0.00 damages, just torture from the lawyers you thought were on your side. So even though Kippen Campbell were never on Mr Gordon's side he cannot sue them. That is why they want to keep self regulation. They are professional criminals who abuse the man in the street for money.

Well I like this "go do something else and leave us alone". And Mr Mill I read he flips when anyone at the Law Society mentioned your name Peter.

Funny how these immature brats dish out injustice but do not like journalists reporting it. The lawyer mentions an unhealth dislike of lawyers, but if he was mature he would have contempt for Penman who caused the injustice the Cherbi family have suffered. Its always the client at fault, never the lawyer.

Strong comments from some, although I can understand the strength of feeling due to the issue of clients of 'crooked lawyers' being driven to suicide simply because they try to secure a fair hearing in Scots law which Scots law itself is denying all of us.

I am quite supportive of campaigns and protests against the workings of the Law Society, the SLCC, the Faculty of Advocates & the Master Policy. What is going on, particularly with the Master Policy affects us all .. and it should not be forgotten that millions of pounds of taxpayers money also goes to the insurers who are part of the Master Policy, in terms of Government contracts, in Scotland and the rest of the UK.

In my view, and I dare say many others ... it must be morally wrong to be a part of an insurance scheme which thrives on the demise (even death) of claimants & awards bonuses to negligent or 'crooked' lawyers for their efforts in destroying a client's case.

    ==============================
It is not an isolated case, the same happened to me but the Glasgow Lawyer and my GP had an arrangement. My GP refused me a medical certificate and sent me back to work for the third time, and the employer would not let me in. I phoned my lawyer and he refused to answer my call. I was left for five months with no money until my employer terminated my contract. It was a tripartite aggreement to starve me into submission. The Law Society refused to investigate it.

I put a T Shirt on with my GP's name and his practice on the back of it. The partners threw me out of the practice and they never took me to court. He had been lying in my medical records because another GP worked for my employer as their medical officer. His real job was covering up the multiple injuries do to repetitive movements, as the has a friend of the Company directors.

There are many more of us across the UK. If Mr Gordon has nothing to lose name and shame them. Use the insurance links because they cannot sue him for telling the truth.

We all need to learn to target law firms in our areas with posters, leaflets and and other legal means. Their strength in in their invisibility because the Law Society and SLCC are never going to tell the public what is going on.

    ReplyDelete
  53. PS I wore the T Shirt because I could not get a lawyer to represent me. £12.00 for a white T Shirt with a bold black message on the back about my corrupt GP. Now there is bypassing the Law Society of Scotland and NHS Primary Care.

The Police officers who saw my T Shirt said "he needs to take you to court for what you are wearing". They did not threaten me with arrest because it was a civil matter. Leaflets and T SHirt messages are not criminal acts but they do bypass the so called independent complaints systems. If I had been taken to court I would have told the Sheriff "I cannot get a lawyer to represent me, so they can do whatever they want".

Their defence union threatened me with harassment, that was rich because they could not take legal action for the T Shirt message because it was true. Screw you MDDUS.

  76. Accountants seize Disability benefits to pay Perth law firm for collapsed court case. Compassionless Nazi's is what they are.

I believe this has happened many times. I know it has happened in central Scotland. Now I am sure any reasonable person would conclude that Kippen Campbell and their accountants are human rights abusers. My sister had her money stopped until her employer terminated her contract and she has no money for five months. {We helped her, god knows whay would have happened without her family behind her]. We have all of the NHS Primary Care complaints documents and her lawyers documents. A lot of lies, inaction which protected the employer, and human rights abuses. Once these human rights abusers decide they have milked enough Legal Aid they cut off the clients and patients money supply.

One thing I can promise every employee, if you have non visible injuries no Scottish lawyer will ever get you damages.

Your lawyer and doctor are insured by Royal Sun Alliance. Your employer will be too. Try this. Go into any law firm and ask them to sue your employer. When they say "fill out the Legal Aid forms, you say "who are your professional indemnity insurers"? Then you say "how can you sue my employer when you are insured by the same company". Oh they never tell clients this, because they are going to cover up what has happened to you.

What we see in all these cases is that justice goes to the highest bidder. Royal Sun Alliance, deep pockets and probably giving law firms and medical practices no claims bonuses for killing off litigation against them. Trust none of them.

Scotland's lawyers are as evil as the Nazi's but you cannot understand this until you are in our shoes. Imagine you have debts, been injured at work, have a wife and kids, and these criminals cut off your money supply to protect insurance companies. They are evil incarnate and if you have read this blog and still trust lawyers, I cannot warn you any more.

But they knew he would never get damages, so they wanted to use him to make money. Now they are torturing him for their fees.

It's all about money Kippen Campbell, justice costs you money so Mr Gordons injuries have been covered up. A lawyer once told me cases involving litigation for occupational injury always collapse. He never told me about the insurance arrangements. Now we know why.

What is happening here is a form of bureaucratic terrorism, a nasty vindictive poisonous legal, medical, employer, and accountancy machine against one man because he was injured by an employer, and attempted to claim damages. And now the machine wants to starve him to get fees they are morally not entitled to, but the Sheriffs will side with Kippen Campbell.

There terrorism is not explosives but slow subtle torture, grind him down, smash him, the legal grinder is operating at full throttle to throttle a man who's injuries were covered up.

Scottish Parliament Justice II Committee, what are you doing about these human rights abusers? Oh forgot lawyers on the committee too. God help Scotland if Salmond gets his way.

In South Africa there was apartheid. Now this in political science was Ethnocracy, political rights for white people but no rights for black people. This is the same, protection from the state for citizens, who become outcasts, without rights against the legal juggernaut. These so called professionals are treating a human being as a thing to make money. They are no different from the Ethnocrats who operated in South Africa before worldwide pressure afforded change. Mr Gordon is the victim of Scotland's legal dictatorship. Clientocracy, rights for lawyers, no rights for their victims.

    Keep up the good work.

  86. Hello Jane Irvine, SLCC Chair, how do you sleep at night, imagine one of your family tortured in this way. Do you have any compassion. Oh yes you do, for Mr Gordon's lawyer.

I would never report any lawyer to you. That would be a frustrating pointless experience. Here is what the political theorist Hannah Arendt would say to you about your Law Society and SLCC.

"Today we ought to add the latest and most formidable form of domination. Bureaucracy or the control of a intricate system of bureaus where no one is held accountable for what is being done, and it is impossible to identify culprits".

If the DOI team, were not reporting on this case the Law Firm would not be identified, so just proves Hannah Arendt's point.

I would bypass your bureaucracy and do a massive leaflet campaign in the town where the law firm operated. Now Jane, tell us this. How can you control that? When a person has been tortured for a case as you know [he could not have won] the only solution is to bypass those who call us "frequent fliers" and "chancers". Bypass bureaucracy, as Hannah argued. Leaflets stating, Blogs Solicitors are Corrupt. You think about it Jane. You and MaTrashkill cannot control that.

  87. Why not employ a traffic light warning system for crooked Scottish Lawyers, where GREEN category crooked Scottish lawyers have a clean regulatory history, AMBER for crooked Scottish lawyers whose former clients have reported their concerns about and RED for crooked Scottish lawyers who have had a regulatory history?

This way in one foul swoop, we could starve the crooked Scottish lawyers out of their jobs? Well we will have to do something because the lawyers will never relinquish theor power over clients, that would seriousley damage profits.

Just like Kippen Campbell are starving Mr Gordon for the fees they are non entitled to because Mr Gordon has suffered the usual coverup when anyone tried to sue an employer.

Mr sister's doctor stopped her incapacity benefit certificates in September 2002. Her employer terminated her contract in January 2003. The GP lied in her medical records implying she had seen a psychiatrist on an ongoing basis for twenty years. He was so ashamed when we found out. This is the reason he stopped her certificates because if the case had got to court she would have found out about this. As it was his body language gave him away so we reported him to Primary Care. Another GP was the defenders Medical Officer. Her Glasgow lawyer left her dispite repeated phone calls her money was stopped. Her lawyer dumped her just like has happened to Mr Gordon. The GP's, Medical Consultants, Employer and Lawyer were all insured by Royal Sun Alliance. We wrote to the Sheriff at Hamilton Sheriff Court, and the clerk wrote back stating the Sheriff could not give legal advice. Ironically she told us to seek legal advice. The Law Society refused to investigate, NHS Primary care manager [who was also a male nurse} wanted it covered up, and no lawyers would help her.

We know what has happened to Mr Gordon, and we still have all of Ross Harpers documents. Noone in the Legal or Medical establishments wants to know.

We know this was all arranged between her GP and his colleagues, her lawyer and employer. They are corrupt to the core, and they are all still working with [except the employers GP who has retired] clients and patients. Do not try any sue anyone, there is no Health and Safety at work if your injuries are not visible, the medical and legal professions are the insurers first line of defence. This is similar to what has happened to Mr Gordon, another routine cover up by those who you will never get into a court of law.

We still have all of the documents but no lawyer wants to look at them. Result, covered up injuries and legal check mate. Just like Mr Gordon.

  88. “The civil justice system in Scotland is a Victorian model that had survived by means of periodic piecemeal reforms. But in substance its structure and procedures are those of a century and a half ago. It is failing the litigant and it is failing society. It is essential that we should have a system that has disputes resolved at a judicial level that is appropriate to their degree of importance and that disputes should be dealt with expeditiously and efficiently and without unnecessary or unreasonable cost. That means that the judicial structure should be based on a proper hierarchy of courts and that the procedures should be appropriate to the nature and the importance of the case, in terms of time and cost. Scottish civil justice fails on all of these counts. Its delays are notorious. It costs deter litigants whose claims may be well-founded. Its procedures cause frustration and obstruct rather than facilitate the achievement of justice."

I note your comment above Lord Gill.

Do you think this is justice? A human being being tortured to save insurance companies and Law Firms. You know the way it works. How they sleep at night is beyond me.

The question is are you going to do anything about it? I cannot argue with the century and a half ago part of your Civil Courts Review. Jeremy Bentham's parents had a servant who took two broken silver spoons [because he argued he had not been paid when he was dismissed]. He was hanged, [for two broken silver spoons].

Lawyers stealing Legal Aid money today do not even get charged. One law for the professions, another for the man in the street. The judiciary do not kill people today, they drive them to suicide instead. Some justice system.

Someone with a board like Stuart Usher did in Edinburgh accusing Brodies of corruption may happen at Kippen Campbell. 93. Gandhi said that a society is judged by how it treats its weak and its frail. He was right, a legal dictatorship is proving what it is capable of.

Hannah Arendt [who was Jewish) was in New York when rumours of the holocaust reached her. At first she did not believe it because it was not necessary in military terms. But she said when she found out the truth "a black hole opened up into which politics dissapeared". She also said the "Nazi's were ordinary human beings" in appearence anyway. What it did was make the world realise what humans are capable of.

These lawyers do not have gas factories but they are evil nonetheless, and you place yourself in the utmost danger when you deal with them. Please avoid at all costs, do not become the victim of a legal lottery.

"A black hole opened up into which politics dissapeared". Where there is no politics, there is no state protection. There is no politics for Mr Gordon because without someone in power to help him he becomes a thing [no offence to the man] to be abused as Kippen Campbell and their mob see fit. And Mr Salmond thinks this is a satisfactory situation. God help us all of he gets his way.

Now Kippen Campbell we see why Judge Tudengat took Solicitors From Hell of the web. You are starving this man, putting him in a financial prison to get fees you have no right to. I know what he is suffering, it happened to me too. You know why Jane Irvine is furious, it is because the DOI team and us are telling the truth and you know that too.

Does Sally or any of the other Partners buy from E Bay? Well they will know that buyers and sellers leave feedback to "keep the E Bay community safe".

Clients need the same system to protect the public. What does Mr Gordon have to lose now? What would you do in his shoes Sally? How can you sleep at night Sally? If it does not bother you what manner of person are you?

Lawyers are terrified of clients uniting. Well it is going to happen. I would come up to Perth to have a peaceful protest outside your offices. Today with social networking sites you cannot afford to keep ruining clients. You will suffer the boomerang effect. If I had my way I would jail all of you as masters of torture and legal apartheid.

But I will tell you this. No member of the public in Scotland can ever get a fair trial when they legal issue is between a lawyer and client. No Sheriff, Judge can ever eliminate the bias that would be there. Proof of this is simple, Mr Gordon would never get a lawyer to go against you, so how can any member of the public get a fair trial.

It is protection for the lawyer and torture for the client.

It is a funny thing when people tell the truth, their opponents go silent. Not one lawyer reading this article has posted a comment to say the insurance arrangements are not true, or that occupational injury is not routinely covered up. You covered up what happened to this man, you may as well have been a Director of RSA or Vardy's. We have worn his shoes twelve years ago, we know what hell he has gone through because he went to work. Employer negligent and responsible, but the lawyers, doctors, and accountants are criminally responsible.

If any people from Perth are reading this, warn your friends to avoid Kippen Campbell like the bubonic plague. No clients for them, see if they like being starved into submission.

    ================================
Yes you are correct, there will be thousands, perhaps tens of thousands. Mabe more, the mind boggles.

They systematically cut of people's ability to act. They are doing this to Mr Gordon, crushing his ability to act legally because he cannot get any lawyer to help him. They may as well have stuck him in a concentration camp because that is how the Nazi's prevented people acting. When a persons ability to act is removed, [in this case having legal protection] he becomes a thing, they can abuse any way they want. He cannot get a lawyer so he is rightless, just like people locked away in Nazi Germany. He cannot put his torturers on trial, so they are destroying him for profit.

And the SLCC are furious because they hate action from the DOI Team on this. Crush the ability to act and you crush the ability to defend yourself. This is why Scotland does not have a justice system. Mr Gordon is the [like thousands of others is a victim of Judicial Totalitarianism. Without legal rights he is in a prison he cannot escape from. In these lawyers and accountants eyes Mr Gordon is not longer human. He is a thing to be tortured to make them money and they are simply pure evil.

    Tell everyone you know.

I go on a bit at times but I just wanted to comment on Peter's family. The Law Society told his lawyer to stop representing him when Drew Penman ruined his family and another Law Society rat told the Legal Aid Board to stop his legal aid. This reinforces my point. They were crushing his ability to act [in the legal arens] but they could not forsee his Diary of Injustice. Christ I bet they wished they would have fried Penman now.

Mr best wishes to all victims of Legal Tyranny and thanks again DOI team. And you people out there, get educated about so called professionals. Listen to us. Do not learn the hard way.

Wealthy people who who use aggressive tax avoidance schemes could be named and shamed, under plans due to be unveiled by the Treasury on Monday.

Exchequer secretary David Gauke will tell the Policy Exchange think-tank that schemes of the sort that allowed comedian Jimmy Carr to pay only 1% tax on his income "undermine the actions of the vast majority of taxpayers".

He will say: "We are building on the work we have already done to make life difficult for those who artificially and aggressively reduce their tax bill.

"These schemes damage our ability to fund public services and provide support to those who need it."

While tax avoidance is not illegal, David Cameron described Carr's actions as "morally wrong"

And in his March Budget George Osborne said tax evasion - which is illegal - and aggressive tax avoidance were both "morally repugnant".

Under the plans proposed today, the government would force companies that help people avoid tax disclose the names of wealthy clients who take advantage of tax loopholes.

Gauke will say: "They harm businesses by distorting competition. They damage public confidence.

"And they undermine the actions of the vast majority of taxpayers, who pay more in tax as a consequence of others enjoying a free ride."

Officials often hit a dead-end when investigating schemes that are based off-shore but under the proposals UK promoters will be made to hand over customer databases.

That information will be used to formally warn clients directly about the deals they have signed up to and to work out how much tax they owe if the scheme fails.

"Court of Session judge Lord Woolman hears Scotland’s longest running civil damages claim. Now in its Sixteenth year in the Court of Session, fresh hearings in the long running civil damages claim in front of judge Lord Woolman began earlier on Tuesday of this week. M.Wilson v North Lanarkshire Council & Others (A1628/01) which has its origins in the mid 1990’s and brought about Scotland’s first civil law McKenzie Friend in late 2009, involves a sole party litigant, Mr Martin Wilson, a former Music lecturer of Motherwell College who, according to media reports was forced out of his job after sustaining severe back injuries during the course of his duties as a music lecturer during his time at the College in the 1990’s".

Have a read, these cases never get to the stage where the client wins damages. Lawyers and doctors cover everything up and do not give a S**t whether you live or die. One of Scotland's top lawyers has been appointed as a High Court judge.

Maggie Scott QC, who led the Lockerbie bomber's abandoned appeal case, was chosen as a Senator of the College of Justice by the Queen, following a recommendation from First Minister Alex Salmond.

It means she will sit as a judge in the Court of Session and the High Court of Justiciary.

She is expected to take up the post later this year.

Mr Salmond is said to have nominated the high-profile QC on the basis of a report by the independent Judicial Appointments Board for Scotland.

Ms Scott has worked on numerous high-profile cases.

As well as the Lockerbie appeal, she represented Jodi Jones' killer Luke Mitchell during his bid to take his appeal to the UK Supreme Court, and also represented Tommy Sheridan during his perjury trial, but parted company with the former MSP during the proceedings in 2010.

The 52-year-old became a solicitor in 1989 and was admitted to the Faculty of Advocates in 1991, before becoming a QC in 2002.

Since 1991 she has been involved mainly in criminal defence work, specialising in appeals, and was appointed a part-time sheriff in 2002.

Ms Scott will pick up a salary of £172,753 a year in her new role.

Yes my friend Pure Evil, that is what they are. A farmer was ruined by his lawyer and the Law Societies Director of client relations Phillip Yelland sent the farmer to a law firm so that he could sue his lawyer and get damages from the Master Policy.

What the farmer was not told by Yelland is that the Law firm he sent him to was a member of the Legal Defence Union, who exist to prevent claims against the Master Policy. After months of the farmer getting no where he killed himself with a shotgun.

Now this is pure evil, driving victims [I do not like the word clients any more] to suicide. Yelland has never denied it. My sister may not be here today if it were not for her strong family. She is so mentally tough but they stopped her money so we paid her bills. What you find in these cases is a pattern that is always against you. The lawyers never chase things up against the party you are in litigation against. They do not need to, their cover is bureaucracy.

The Law Society and SLCC have much in common with the Nazi's, they do not use violence. Their terror machine is bureaucracy, a system where all of the complaints channels are set up against you, by people who all think the same way.

There are many people out there who have been treated as things, subhumans by these evil gangsters to make money. Never trust a lawyer. The Law Society and SLCC dish out repetitive human rights abuses. Put the victims together, and the true horror will emerge. That is how we destroy their power. Please see the DOI teams article on this network of evil.

If the victim was 18 years old and he or she could not work again they would cover it up. People are things to the Law Society and its branches, they are simply evil incarnate.

    All the best.
