Unfit for Consumer Consumption : How the Law Society views itself illustrates why consumers will never be protected by Scots lawyers regulator

Law Society of ScotlandThe Law Society of Scotland’s latest foray into the world of video gives a rose-tinted view of regulation. THE LAW SOCIETY OF SCOTLAND have, in a rare foray into the world of published video footage, given notice they intend to apply to the Scottish Government as an “approved regulator” of legal services in the ‘new’, ever-so-slightly expanded Scottish legal services market which will begin to take shape next year, 2011, after the passage of the Legal Services (Scotland) Act 2010 which came into being as a result of a less than successful consumer campaign to open up Scotland’s justice sector to allow wider access to justice for Scots who have until now, been forced to use the services of a solicitor (member of the Law Society of Scotland) or advocate (member of the Faculty of Advocates) to obtain legal services or access to justice.

The 4m Crooked Lawyer - Daily Record 1991You cant mention the Law Society without mentioning crooked lawyers. The video footage, apparently posted by legal insiders, also shows a stunning arrogance on the part of Law Society officials, who remain unrepentant about the way the organisation has treated everyone in the past. On-camera performances from the Law Society’s top officials may lead readers to wonder why even some solicitors accused the Law Society’s top brass of voting fiddles & much more in the ever so slightly overcooked debate on Alternative Business Structures (ABS) and the Legal Services Bill at the Scottish Parliament, accusations & squabbles which boiled over in the unforgettable televised interview with the Govan Law Centre’s Mike Dailly and the former Law Society of Scotland President, Ian Smart, HERE

Current Law Society President Jamie Millar introduces the meeting with a joke on abs & Toyota which goes down with the audience like an old British Leyland Morris Marina (click image below to view video)

Unfit for Consumer Consumption : Law Society of Scotland’s Director of Regulation Philip Yelland discusses the Law Society’s new regulatory role relating to the Legal Services (Scotland) Act 2010 (click image below to view video)

Practice Rules changes : Digital images, digital fiddles, a consultation & money laundering rule changes also announced by the Law Society’s Phillip Yelland (click image below to view video)

More video footage from the Law Society’s meeting can be viewed at Lawtalks including footage of the Law Society’s ‘current’ Chief Executive Lorna Jack & others discussing what are issues which will heavily affect Scots consumers of legal services.

Call me old fashioned, but I always thought Douglas Mill could give a better speech, and well .. a much more honest indication of just how honest the Law Society of Scotland really is when it comes to regulation of ‘crooked lawyers’ ..

Douglas Mill tells the Scottish Parliament he never became involved in crooked lawyers, while John Swinney reveals Mr Mill did exactly that … (click image below to view video)

Just why the Scottish Government would allow the historically crooked & unrepentant Law Society of Scotland a position as an “approved regulator” in the new post Legal Services Act expanded legal services marketplace in Scotland is beyond the realm of common sense, or concern for protection of consumers & fee paying clients who will again, suffer the Law Society of Scotland, and now the Scottish Legal Complaints Commission’s anti-client, anti-consumer attitudes on regulatory matters where protection of the public & fee paying clients should come first, not last.

  3. Self regulation by the legal profession has longsince been recognized by various informed commentators as a farce.

Allowing this excuse for a regulatory authority to expand its remit - I hear little or no mention of the Law Society of Scotland's duty to protect the public interest - would reduce the international standing of the Scottish Justice System even further, and reveal it to be nothing less than a travesty where the Scottish Public is routinely denied any meaningful or proper access to justice.

  5. I just watched the first two videos.
You are spot on about Jamie Millar. His joke went down like a lead balloon.
As for Philip Yelland well we all know why he has been the Law Society's chief complaints fixer for the past two decades.

The Scottish government are every bit as corrupt as the Commission & Law Society. Devolution, a disaster for Scotland.

  9. The National Auditing Office needs to take a hold of this lot and once again shame on David Cameron who knows all about their crimes and does nothing, some prime minister this and when the lid blows off and angry Scots campaign in the streets of London will he take the blame for all the years of corruption or will he say it is all our fault like he did with the students.

  12. Rights are won through power. The fundamental notion of a right - something which ultimately cannot be denied or withdrawn - is that those to whom rights accrue have their own means for securing them. Even the most cursory study of the history of human politics and law shows that rights are gained by emergent power groups forcing the reluctant hands of incumbent powers, not by acts of paternalistic generosity.

The Law Society & Commission demonstrate omnipotent power. Where the latter exists, injustice is the inevitable result.

    Long live dissent.

  13. You are missing Douglas Mill ?

Well you could be right after all his replacement is well how can I say it so you will publish this comment ****

  14. It is an outrage these corrupt individual deals with complaints. Remember Mill spoke about the thorns in our flesh, a comment about clients. A statement with such poison regarding clients tells us how important Mill regards us.

What Mills group cannot face is the fact that clients are saying enough to Law Society criminals. This union is a protection racket for legal gangsters. They are rotten human beings devoid of balanced values.

It is due to the Law Society websites exposing corruption have materialised. It is due to the Yelland's, Mills, Pritchard's no one trusts a lawyer.

Mill was forced out of the Law Society, for protecting lawyers. I am getting the words, Trust no Lawyer on my tombstone.

  15. Liars and self regulation go hand in hand. I know a doctor who was caught distorting patients medical records and she was not prosecuted. Why, self regulation. The health board knew she was a crook but did not tell other patients. So my friend did it for them. Lawyers, the defence was Qualified Priviledge. Just like Mr Mill protecting his colleagues it the Law Society. "When all roads to Rome close Mr Mill a change of strategy is required.

People do not realise their family doctor or lawyer can lie about them and get away with it. All you lawyers out there who think the average client cannot string a few words together, beware, Many are smarter than your realise.

  17. The Law Society hate you Peter, we hate them too. Christ these people are meant to be intelligent. I mean your family has the misfortune to deal with criminals and the Law Society do not prosecute Penman. Send a psychiatrist over there to see them, their hatred of your is a reflection of their warped intellects. I know the Law Society are not stupid but they are seriously prejudiced against those who criticise lawyers.

I wonder what they would do if they were treated this way. Warped minds indeed.

  18. This lot Yelland's, Mills, Pritchard's human vermin preying on vulnerable clients. I wonder how many clients have been ruined by these crooks on their way up the ladder?

  19. And not so much as a peep from John Swinney about this. Perhaps he feels he can afford to conveniently forget the many failures of the Law Society of Scotland he previously listed now that he enjoys the comfort of a Cabinet Office.

Everyone it seems has their price.

  20. Several more revealing videos and several more very good reasons to tell everyone to sign the petition seeking the repeal of the Solicitors Scotland Act 1980 at;

  21. The three stooges, I would jail all of them. I would not be surprised if they have an incinerator behind the Law Society for burning client complaints. They would burn clients if they could get away with it.

  22. Distort, twist, lie, do anything to protect the profession. The culture of The Law Society of Scotland. I do not think anyone could convince these three crooks clients need protection, clients to these people are money.

Austin Lafferty summed up lawyers psyche when he said his best client was a wealthy old lady. Don't worry Austin if you have ruined a few old ladies financially your friends in these videos will cover everything up. Bad people, bad to the bone.

Let us be realistic, self regulation is automatic exoneration because lawyers are a brotherhood of ruthless criminals who cover each others crimes. I have never hated a group of people in my life but you people are the exception.

  23. Repeal of the Solicitors (Scotland) Act 1980, The last time I looked at the signatures 127 people had Signed it. Now it is 122, when did the 5 disappear.

I wonder how their victims feel when they meet them in the street ?

Millar Yelland and Mill, are you intelligent? Each of you is now Peter cherbi, you would be looking for a public hanging. It is that old human problem, you only care when it affects you: Corrupt Bastards.

  26. Austin Lafferty - who said - his ideal client would be an old lady who came along to sell her house for £100,000 or something like that ... of course .. Garry Robertson quickly picked up on Lafferty's comment which sounded ..... shall we say .. stupid ?I thought ... along with, probably the whole audience, sure - an old lady with £100,000 to a Scottish lawyer is an easy target because Millar, Yelland and Mill would do their cover up bit and probably get a few bob for their help. Lafferty was the crook in the television at lunchtime years ago.

  27. Andrew Penman defrauded my family of an inheritance, faked up papers and file notes, was found guilty by the Law Society of Scotland, but senior Law Society officials intervened in the case to save him and killed the case.

The Law Society of Scotland then made sure I could'n`t sue him in the Courts by killing my legal aid. The case made the press and television and is also featured at the Scottish Parliament Justice Committee website.

THIS IS THE NORM WITH THE LAW SOCIETY OF SCOTLAND, LEGAL THIEFS.
MILLAR, YELLAND AND MILL THINK THIS IT THE CORRECT WAY TO TREAT A CLIENT. SELF REGULATION, THE PLUNDERING OF CLIENTS ASSETS WITH IMPUNITY. MSP's MUST END THIS LEGAL CORRUPTION NOW. ANY MEMBER OF THE PUBLIC WHO STOLE FROM A BANK OR THE TAXPAYER WOULD GO TO JAIL. THEY DO NOT HAVE THE COVER OF SELF REGULATION TO HIDE THEIR CRIMES. THE LAW SOCIETY IS A CRIMINAL ORGANISATION PROTECTED BY A CRIMINAL SETUP OF LAWYER INVESTIGATING (MEANING PROTECTING) LAWYER. THIS IS WHY MR MILL HAD TO RESIGN. THE ISSUE IS POLITICAL. THE TREATMENT ISSUED BY THE LEGAL SYSTEM DEPENDS ON WHO YOU ARE.

THE PUBLIC GET TRIED IN A PUBLIC COURT.

THE LAW SOCIETY KEEP ITS CRIMINALS OUT OF COURT BECAUSE THE VICTIM CAN NEVER GET A LAWYER.

END SELF REGULATION NOW. END LAWYER CRIMINALLITY NOW.

  28. Thanks for all your comments and emails on this article.

For those who enquired wondering why I apparently publicised the Law Society's own point of view, well .. balance is a part of reporting a subject, and I feel it is very important people who must approach or deal with the Law Society of Scotland over the poor legal services provided to them by their legal agents should know the persons they will end up dealing with ...

A comment left on this article earlier today mentioning Cameron Fyfe ... could this person please post further details in a comment marked "not for publication" as the case could well be of media interest ...

  30. On-camera performances from the Law Society’s top officials may lead readers to wonder why even some solicitors accused the Law Society’s top brass of voting fiddles.

Peter what I find with so called professional people when the evidence condemns them their actions portray them as perfectly honest. I sat in front of a GP where there was written evidence in his letters condemning him and he still tried to argue he was innocent. Logic states that these Law Society officials believe they are honest, or on the contrary they know they are crooks and they should be in Hollywood.

Personally if they believe they are honest they must have mental health problems. I believe self regulation manifests itself as you cannot touch me, I am legally above you, the same sort of arrogance as Shipman, these people believe clients are subhuman. They are criminal actors who have much to lose but without their reputations they are nothing. These people are destroying public trust in their membership. Regulation Peter is what your are doing, that is why they hate you. If the Law Society did this the way you do, the reputation of lawyers would be better for it.

All the best to you and your family for Christmas and 2011.
