Suicides, illness, broken families and ruined clients reveal true cost of Law Society's Master Policy which 'allows solicitors to sleep at night'

SLCC report headerOnly a few days after the release of the Scottish Legal Complaints Commission's investigation into the claims process against solicitors, harsh evidence is beginning to emerge of the human cost to clients, where suicides, illness (some resulting in death), family break ups and huge financial losses are the horrific consequences sustained by members of the public who have tried to make claims against the Law Society of Scotland's 'Master Policy' insurance scheme, touted by the legal profession as protecting lawyers and clients but which the ground breaking report released by Manchester University School of Law on Monday reveals “is simply designed to allow lawyers to sleep at night.”

During the research team's investigation of claims against the Master Policy, team members were told of suicides which had occurred due to the way in which clients of crooked lawyers had been treated by the Law Society of Scotland and the insurers who operate the Master Policy protection scheme for solicitors against negligence claims. Quoting the report : "Several claimants said that they had been diagnosed with depression; that they had high blood pressure; and several had their marriages fail due to their claim. Some had lost a lot of money, their homes, and we were told that one party litigant had committed suicide."

Law Society of ScotlandLaw Society officials linked to suicide of client who claimed against the Master Policy. The suicide of one client who had dealings with the Master Policy, is apparently linked to senior officials at the Law Society of Scotland itself, who, when approached by the client to handle a complaint against his solicitor who had made major errors in handling legal business, recommended to the now deceased client he approach a well known firm of solicitors to sue his original solicitor and pursue a claim against the Master Policy for negligence. However, what the client did not know was the law firm which the now promoted Director of a department at the Law Society had recommended he approach, actually represented the Legal Defence Union, which exists to defend solicitors against both claims & complaints from clients, and who are involved in defending solicitors against over two thirds of the thousands of complaints made annually against lawyers by members of the public in Scotland.

The client, a farmer and co owner of a business, went onto unknowingly engage the law firm recommended to him by the still serving senior Law Society official, however, unsurprisingly, little or no progress was made over a lengthy period of time on the client's claim against the Master Policy, which in itself, caused severe stress and depression to the client and his family.

Matters reached the stage where the law firm, recommended to the client by the Law Society itself had done little on the case, and offered no hope of a just & fair resolution to the huge losses caused by the client's original solicitor, one evening, not long after yet another unsuccessful meeting with his solicitors, the client in question had reached a point of such depression, he committed suicide at home using a shotgun, leaving his widow & children. Several days after the client’s suicide, the same Law Society official who had recommended the law firm which had done nothing to proceed the deceased client's claim and take the original 'crooked lawyer' to court, wrote to the widow of the victim and callously informed her she had two weeks to make a complaint to the Law Society or she would be time barred.

The case itself, was investigated by the then Scottish Legal Services Ombudsman Linda Costello Baker, in 2001, who found the Law Society of Scotland had failed the deceased client and ordered they re-investigate the complaint. The Law Society then proceeded to investigate the complaints again, however reaching the same conclusions, which prompted the widow of the deceased client to return to the SLSO, Ms Costello Baker, who again investigated in 2003 and judged the Law Society had failed once more.

At least two other suicides directly associated with clients dealings with the Master Policy are known, where in both cases, clients appeared to have been put under intolerable pressure, delay, deceit and intimidation by lawyers, the Law Society itself, and the insurers to the Master Policy, that the result of the entire process was to cause the claimants to end their lives after breaking under the strain of dealings with the apparently deadly Master Policy insurance scheme.

Further excerpts from the Manchester University report into the Law Society's Master Policy & Guarantee Fund show the intolerable strain clients who attempt to claim against their 'crooked' solicitor have to endure : Claimants "described being intimidated, being forced to settle rather than try to run a hearing without legal support, and all felt that their claims’ outcomes were not fair. Some claimants felt that they should have received more support, and that this lack was further evidence of actors within the legal system being “against” Master Policy claimants. Judges were described as being “former solicitors”, members of the Law Society – and thus, against claimants. Some described judges and other judicial officers as being very hostile to party litigants."

One direct quote from the report, depicts a claimant, who was forced to become a party litigant : "I keep fighting cases, and they keep coming at me, and now I have become ill. But they still keep coming at me. They threw me out onto the street, I couldn’t get my medication, I’ve got nothing, I was homeless, ill, sleeping in the car. Now I am appealing. But I can’t get a solicitor. They are just shutting me down…. My health has been damaged, they kill you off. It's a proven fact. All of us have stress related problems after years and years of stress."

One client who had fought a nine year battle with the Law Society of Scotland and the insurers to the Master Policy over a multi million pound negligence claim which ultimately failed said : "The way that claims against crooked lawyers are handled in Scotland is criminal. The Law Society and the insurers will stop at nothing to ruin a client's life if they dare try and raise a claim for damages against their lawyer."

He went on : "I lost my business and then my house after the legal firm which was supposed to be acting on my behalf against my original solicitor, sued me for legal costs of over £72,000 after nine years of allegedly trying to take the case to court and then the whole thing coming to nothing. I found out that the law firm I took on to represent me against my original solicitor who ruined my business, had been working against me from the very start and to make matters worse, they are I hear going to merge with the law firm of my original solicitor now that my case is out of the way."

"My wife left me, took my children, and I now have little hope of ever working again. I am shattered and have been diagnosed with depression, but the solicitor I originally complained against has a good life, is an outwardly respectable member of the community, but in reality is a thief who embezzled tens of thousands of pounds from my business, and ruined my business just to make sure he could buy up the bankrupt parts for himself which is what he actually did."

He ended by saying : "If anyone asked me for advice on how to deal with a solicitor in Scotland, I'd say stay the hell away from them and even if you have to use one, do not get into a trusting relationship with them simply because if anything goes wrong, as it probably will, they will end up as your opponent in the blink of an eye and from then on your life will be made a living hell."

A solicitor I asked for comment today said :”While I must express my sympathies to the families of clients who have apparently committed suicide over their dealings with the Law Society and the bad apples among us, we as solicitors are as much a victim of the Master Policy and the Law Society as are the clients. Not one solicitor to my knowledge has even seen a copy of the Master Policy but I do know someone who once asked for a copy and was refused, then was given a sharp rebuke for even asking to see it yet we are forced to pay annually into the Master Policy if we want to continue practising law in Scotland.”

He ended by saying : “The Master Policy is all about giving the Law Society of Scotland control over the legal profession and the public. Get rid of the Master Policy and the Law Society while you’re at it, allow us as individual firms to arrange our own insurance cover, and you would see a very different, more positive legal services market in Scotland.”

Consumer Focus Scotland Consumer Focus Scotland welcomed the findings of Dr Melville & Professor Stephen’s report. Today, Consumer Focus Scotland issued a statement welcoming the findings of the report into the Master Policy & Guarantee Fund, saying : “We welcome this preliminary research into the Master Policy and Guarantee Fund. Although based on a small sample, it provides useful qualitative evidence that the current system lacks clarity for both consumers and the legal profession. We welcome the recommendation that additional research is required, which we hope can further explore and build upon the initial findings from this report.”

Page 8 - Consumer Focus Scotland refused cooperation from Law SocietyThe Law Society of Scotland refused to work with the Scottish Consumer Council on an investigation into the Master Policy in 2003 & 2004. However, it transpires from this week’s report that Consumer Focus Scotland in its previous incantation as the Scottish Consumer Council, who carried out several large investigations into problems with the Scottish legal profession, wanted to carry out an investigation into the Master Policy in 2003, however attempts were thwarted when the Law Society of Scotland refused to take part. An excerpt from Dr Melville & Professor Stephen’s report reads : “Consumer Focus in 2003 and 2004 wished to carry out desk-based research on the Master Policy. They sought the co-operation of the LSS of Scotland which was refused. Consequently the research was not undertaken.”

One large scale report undertaken by the Scottish Consumer Council took place in 1999 when the SCC’s Complaints Against Solicitors report was released. This week’s Manchester University report refers to the earlier SCC investigation as follows : “Consumer Focus Scotland has not specifically considered either the Master Policy or the Guarantee Fund, although it did state that professional indemnity insurance arrangements and complaints procedures needed to be put in place in order to facilitate the alternative business structures within the legal market. In 1999, Consumer Focus Scotland conducted a study on Complaints about Solicitors, which surveyed over 1200 people who had used the Law Society of Scotland’s complaints procedure during a one year period. During this research, Consumer Focus Scotland was contacted by a number of claimants who raised concerns about the Master Policy.”

Which logoWhich? also welcomed the research findings but expressed concern over the Insurers restrictions on the research team who were denied access to important data. Also today, a spokeswoman for Which? issued comment on the Manchester University report, and, while welcoming the findings of the research team, concern and criticism was expressed that the Law Society refused to hand over important data or a copy of the Master Policy itself to the research team. Which? said :“We welcome the research but are obviously disappointed that the Law Society did not provide the researchers with access to the Master Policy as part of their work. However hopefully what was gleaned will provide a platform for other work to come in this area.”

So, at the end of the day, as the Manchester University report of this week reveals, “Thus, the Master Policy is essentially an insurance scheme intended to provide professional indemnity insurance coverage for solicitors.The purpose of the Master Policy, the simple answer is to allow solicitors to sleep at night. It provides professional indemnity insurance cover for firms."

Jane IrvineSLCC’s Chair, Jane Irvine. What therefore, is the SLCC going to do about this and just how many members of the public have to get ill, or even die to protect a ‘crooked lawyer’ and the Master Policy, before something is done ? Jane Irvine, when asked for comment on these matters, said : “As you are aware, the research was commissioned by the SLCC and carried out by Manchester University School of Law. One of their undertakings was to conduct key informant interviews and the people who came forward were assured their own details would be treated in confidence by the researchers. These conditions have not changed.”

Ms Irvine continued : ”The SLCC is unable to comment on the individual interviews. However, the independent research is central to defining how we develop our role of oversight of the Master Policy and Guarantee Fund. In terms of the report, the experiences of the people who came forward to be interviewed were significant to the quality of the research. The information given by all those who assisted the researchers is valued by the SLCC and it is essential to the development of our oversight role.”

Justice Secretary Kenny MacAskill has so far not returned requests for comment on Monday’s report …

One day I will switch on the television and some ruined victim of the law society will have murdered lawyers, I have no doubt because the injustice here is a modern day type of slavery, to protect corrupt professionals and money. I hate lawyers, and doctors as much as the Nazi's hated their enemies.

I do sympathise with the strong feelings on these issues, where yes, innocent people have taken their own lives due to the way they have been treated by the legal profession, but we must all be careful of what we write ...

  9. Justice Secretary Kenny MacAskill has so far not returned requests for comment on Monday’s report------Well Mr MacAskill time to act or resign. The legal dictatorship must be crushed, if the complaints system was totally independent lawyers would be committing suicide.

  15. All jurors in Scotland must have the right to know the background of legal professionals in the courts.

    How many have been involved in corruption and had the Law Society mafia cover everything up. A banana republic indeed with the Law Society dictatorship in control. Time to end self regulation and let the lawyers blow their brains out. Douglas Mill talks about the human rights of lawyers, I do not expect you to understand or care Douglas about these suicides, because I am sure you will have caused some yourself. But you are mentally unreachable with your attitudes, entrenched in the lawyer protection mode. So are your staff at the Law Society, criminals all of you with blood on your hands.

    Even if these poor people could get a lawyer, doctors would never say the depression, high blood pressure, or suicide was caused by the ill treatment of the Law Society. They are all insured by Royal Sun Alliance, so they will make sure damages are never paid. They have it all their own way, lawyers, doctors, the Law Society, the master fund, the insurers. A reputation and therefore money protection racket that is a face for a body that by statute must protect clients, but in reality only cares about lawyers careers.
    Any member of the public who trusts any of these professions after reading this must be insane.

  22. To the solicitor who contributed to your report, and who together with many others is I suspect clearly aware of the corruption at the heart of his profession ;

    You and your colleagues have a duty to defend the subject you are presnetly privileged to represent -'the buck stops there'.

    Did Consumer Focus Scotland ever report the Law Society to the OFT for its stubborn refusal to co-operate and effectively prevent its proposed research in 2003 and 2004, and if not, why not?

    Meanwhile Jane Irvine greets the research with vague generalisations and no committment to clean up the corrupt self regulating Law Society of Scotland - waffle which confirms that neither she nor the SLCC are fit for purpose.

  29. Do not ever expect the truth from an accountant, doctor or lawyer if money or reputations are at risk. The people who work in these professions are the most deviant people in society.

    I warn all of you people out there, the Law Society is a letter writing organisation, letters will go from client to society, even for years but the lawyer in question will be protected to the hilt. You have no chance of justice with this organisation, because they are all like Pritchard, Yelland, Mill, criminals who are above the law. They don't care about client suicides, they cause them. Satan's representatives, the antithesis of decency, honour and honesty. The legal professions Nazi elite, but they are not invincible. I have never in my life been more dedicated to a cause that ending self regulation. These people are fools. If I was doing what they are doing I would expect to get wasted.
    You fools keep treating people like shit, ruining lives and one day you will meet your nemesis. People will not keep taking this treatment, regardless of politicians loyalties.

  31. Thanks for those links of the reports Mr Cherbi.The 1999 SCC report is very interesting indeed and one wonders why it took until 2003/2004 for the SCC to follow up issues concerning the Master Policy.
    Having read all that you wrote I conclude that lawyers are the enemy of the people not their friends.The good they may do is firmly outweighed by the bad and deaths linked to their negligence insurance can never be justified.

  35. As a solicitor myself I feel somewhat bemused at the Law Society's replies to the Manchester Uni team.

    The way the LSS handles the Master Policy should now be up for debate and personally I believe the local bar associations should take over responsibility for insurance in the time being while individual arrangements are put in place.

    I am of course very sorry to hear that some claimants have committed suicide and share your view on this Peter that the MP is not worth the lives of clients.

  38. These suicides are tragic, and are not surprising because the evil bastards that are the Law Society do not care about anything other than lawyers and insurance companies. They are Scotland's dictators.

    If the farmer who took his own life was doing what happened to him to a lawyer, he would quickly be threatened with court action for harassment. The legal defence union would threaten him, but the lawyers can harass a man so much he took his own life. No one will pay for this, this legal system is all one way, total protection for lawyers, none for clients.

    This case is a stain on the Law Society of Scotland as a protection racket and client torture centre at the same time. No wonder they were alarmed at the report findings.

    There power must be smashed, because people can be sure of one thing, if self regulation continues there will be more suicides. I have no doubt the farmers GP will be in cahoots with the lawyers, and state he had mental health problems which drove him to suicide. The doctor will never back the family, I know what these doctor bastards are too. I mean no disrespect to the family, I know from personal experience what they were dealing with. Professionals with a license to torture, because they are only answerable to their own. If I had my way criminal charges would be brought in this case. But the Crown Office the GP and the Procurator Fiscal will also be insured by the same insurers as the law society lawyers, Royal Sun Alliance. Like I said a protection racket. Shame on Kenny MacAskill and Alex Salmond for sitting on the lawyers side of the fence, criminals all of them.

    If they do then this is the same as Dr Goebbles in Germany contolling the press, and crushing free speech.

    The man who committed suicide was tortured to death. Lawyers, doctors, all self regulators can control a persons life in a horrific way and the victim has no one to turn to. They can cut your money supply off, refuse to represent you, leave you to the mercy of their colleagues. In this country there is nowhere to turn when these professions have a grip on your life. It is a devastating, lonely position to be in, and this situation must change at all costs.

  40. Kenny MacAskill, a member of the public asking the Law Society of Scotland to investigate a lawyers integrity, is no different to asking the Nazi's to investigate the holocaust. Totally pointless.

    The once Scottish Legal Services Ombudsman Linda Costello Baker, stated that a complaints handling body must be free of lawyers for it to work. I totally agree with her and it is time this was set up. You know if this happens we will see a lot of lawyer suicides, because of the mess they have left.

    Mr lawyer, I do not believe you. If suicidal clients came to you for help would you expose the corruption in the Law Society, to protect those clients? Not a chance in hell. A client trusting you would be like allowing the Nazi's to investigate the holocaust.

  42. This comment is aimed at readers who are calling for prosecutions for the suicides of clients.

    I am no lawyer so I hope Peter can correct me if I am wrong. Evidence would be needed from Consultant Psychiatrists, who have legal privilidge (they cannot be sued for giving a medical opinion as an expert witness) stating the harassment these people suffered from lawyers drove them to suicide. Now, any doctor will always put money above life, so even if they knew the Law Society drove these people to suicide the medical reports would never say that.

    People need to realize doctors are every bit as crooked as these lawyer bastards, and money and reputations is what they care about, nothing else. So prosecutions of Law Society members, I would love that to happen but, IT WILL NEVER HAPPEN.

    The Consultant psychiatrists would be appointed for both parties, if the suicide victims families could get a lawyer in the first place. Lawyers of Scotland, do any of you have the decency to help these poor people? Clearly the legal establishment are evil people. I will watch this space.

    Yes my friend Peter is brave, but I am sure he is also driven by the firm conviction as I am, that all pressure groups have right on their side. Mentally you will never reach a lawyer, they are locked into self protect mode.

    They can never see two sides of a debate if that will lead to a diminishing of their powers. What we can and must do is warn everyone what they are up against. I believe we will get independent complaints handling, and that is the only way we can clean this filthy profession up. They need to be forced, and MacAskill is the wrong man to do this.     Lawyers put human life above money.

    Lawyers were not bound together by a code of loyalty.

    Insurance companies were prepared to compensate victims of lawyers.

    These bastards do this. They go home to their families, have dinner, relax and they are ruining peoples lives when they are at work. All protected by their colleagues to ensure they can keep ruining lives for profit. A wonderful business model I do not think. They sleep easy because they believe this is morally right.     But he claims Fraser did not file his Legal Aid application in time and "deliberately misled" him to cover his tracks. He is also accused of losing or binning vital files.

    Alexander's case eventually became timebarred and he had to settle for just s3000. ALL LITIGATION LAWYERS DO THIS, THEY STRING CASES OUT, MILK THE LEGAL AID AND LET THE CLAIM RUN OVER THE THREE YEARS ALLOWED BY THE LIMITATION ACT. THIS IS WHAT MR CAMERON FYFE DID TO ME, AND HE WILL KEEP DOING IT.

    He said: "Fraser has torn my life apart." MR ALEXANDER ALL LITIGATION LAWYERS AND DOCTORS DO THIS, THEY ARE EVIL PEOPLE.

    The Law Society of Scotland ruled his actions "could amount to professional misconduct" and referred the case to the Scottish Solicitors' Discipline Tribunal but a report has still not been filed. They also ordered Fraser to pay Alexander s1000. STRANGE THEY REFUSED TO INVESTIGATE CAMERON FYFE FOR ME.

    Philip Yelland, Law Society of Scotland director of regulation, said: "Complaints against Adrian Fraser are being investigated." YELLAND THE MASTER OF THE COVER UP.

    Fraser became a fiscal in Edinburgh in 2004. His cases include that of former Labour MSP Watson, who was jailed in 2005 for fire-raising.

  53. Judge Smith found Shipman's "non-violent" killing almost incredible. "The way in which Shipman could kill, face the relatives and walk away unsuspected would be dismissed as fanciful if described in a work of fiction." Even more incredible was that his murders of so many people did not arouse suspicion for decades, even though there were supposedly safeguards in place at that time.

    Clearly new safeguards are needed and a number of them are now in the works in Britain. For example, after he murdered a victim, Dr. Shipman would often arrange for the body to be cremated if the family did not object, thereby destroying evidence of his crime. Judge Smith points out that new pre-cremation procedures are needed to prevent future abuse. Also, the system failed tragically when Shipman, after being convicted of drug abuse in 1975, (DID PRIMARY CARE MANAGERS OF THE GENERAL MEDICAL COUNCIL KNOW ABOUT THIS)? was allowed to obtain enormous quantities of painkilling drugs. For example, in the name of a dying patient, Dr. Shipman obtained enough of the painkiller diamorphine to kill 360 people.

    Is Shipman a one-off monster as some have suggested? There is growing evidence that he is not as rare as one hopes him to be. Disguised in the aura of respectability that normally surrounds medical professionals, (THEY ARE NOT RESPECTABLE) a number of monsters like Shipman have gradually been unmasked, but only after numerous deaths have taken place. These "angels of death" are not only doctors, but nurses, therapists, hospital workers and proprietors of care facilities for the sick and the elderly. Dr. Michael Swango killed his patients because it gave him a thrill and a feeling of power; Beverley Allitt and Genene Jones, pediatric nurses, killed their young patients to get more attention for themselves; Dr. Marcel Petiot and Dr. H.H. Holmes killed for money; Dr. Josef Mengele killed for political beliefs, and so on. The medical profession clearly needs more oversight if the world is to rid itself of this problem.

    MORE OVERSIGHT ACTUALLY MEANS PATIENTS MUST BE INFORMED WHEN INFORMATION COMES TO LIGHT ABOUT ANYONE WITH ACCESS TO MEDICINES WHO CAN ADMINISTER THEM.     Personally I would not be surprised if lawyers murdered clients. Crushing clients by advising them to go to law firms linked to the legal defence union is state sponsored murder. MacAskill take note.

    Self regulation gave the lawyers all of the power. Independent complaints handling is the only way to protect clients. I do not believe there is a lawyer anywhere who would care about a client killing himself, I do not see any lawyers taking legal action against other lawyers to protect clients.

    Lawyers and their insurers would rather have a pile of clients corpses, like Auchwitz than expose a colleague or compensate a client.   59. If lawyers as a whole do not help clients the profession is heading for the abyss. People will be frightened to trust a lawyer (rightly so).

    I am a Chartered Surveyor. If I lost a lot of money on a construction contract, I would not go to the departure lounge, I would be out the door. But lawyers can lose, embezzle, clients money and their masters protect them. The law and the culture have to change for the good of clients and the legal profession. Clients driven to take their own lives cannot continue. Clearly these people were put through hell. Professional Bodies, corrupt to the core.

    Dictatorships can never deal with claims against their members.

    One final point, the RICS is overated too.

    I would like to warn readers of the dangers of using the services of a lawyer in Scotland. Peter Cherbi who campaigns on ending self regulation, has highlighted through his web site the horrendous consequences when lawyers fail clients. His latest article dated Wednesday July 15th has the heading "Suicides, illness, broken families and ruined clients reveal true cost of Law Societies Master Policy which 'allows solicitors to sleep at night'. The Master Policy is the Law Society of Scotland's compensation scheme, meant to remunerate the victims of crooked lawyers.

    Peter states "Law Society officials linked to suicide of client who claimed against the Master Policy.

    The suicide of one client who had dealings with the Master Policy, is apparently linked to senior officials at the Law Society of Scotland itself, who, when approached by the client to handle a complaint against his solicitor who had made major errors in handling legal business, recommended to the now deceased client he approach a well known firm of solicitors to sue his original solicitor and pursue a claim against the Master Policy for negligence. However, what the client did not know was the law firm which the now promoted Director of a department at the Law Society had recommended he approach, actually represented the Legal Defence Union, which exists to defend solicitors against both claims & complaints from clients, and who are involved in defending solicitors against over two thirds of the thousands of complaints made annually against lawyers by members of the public in Scotland, the victims of crooked lawyers".

    So the Law Society advised the client to go to a law firm linked to the defence union for lawyers. This is a tragic example of the power of self regulators, and is not an isolated incident. Clients cannot find out if their potential lawyer has a criminal record in Scotland either. I challenge any reader to go into a law firms office, and ask them to take a crooked lawyer to court. It will not happen.

    I hate lawyers and the medical profession. My sister had a strong family behind her or she could have ended her life. We understand what these families went and are still going through.

    Lawyers, they are as decent as the Masters of Auchwitz, Birkenau, Treblinka. Make no mistake they would put us in gas chambers. I hate lawyers with a passion, family law, litigation, conveyencing the branch does not matter, they are all the same, bad to the bone who will and do destroy lives for profit.

    This is a war the clients will not lost. Please do advise the congregation at your place of worship about the evil perpetrated by the Law Society of Scotland and their angels of death.

    What is happening here is no different to someone in 1942 phoning Adolf Hitler complaining about the conduct of Eichmann, Himmler, Heidrich. We are fighting ruthless evil, but honesty and right will always crush dishonesty, and day by day their power is diminishing through the medium of warning others.

    The pressure groups will not fail. I think who do these bastards think they are, what gives them the right to ruin peoples lives? What gives them the right to steal a living by crushing other people who cannot work because of what happened to them. The truth is omnipotent, that is why lawyers cannot clear their names.     Dr Chahal worked at Ormskirk Hospital from August 2006 to July 2007

    A doctor who inhaled "laughing gas" while on duty at a children's ward can continue to practise, the General Medical Council (GMC) has ruled.

    The GMC panel ruled Dr Jonathan Chahal's fitness to practise was "impaired by reason of misconduct" at Ormskirk Hospital, where he worked.

    The senior house officer used medical anaesthetic Entonox from a gas canister on four occasions in summer 2007.

    He must abide by GMC conditions for the next year in order to practise.

    The hearing in Manchester included a promise that Dr Chahal will confine himself to NHS hospital posts and must be supervised by a named consultant for the next 12 months.

    Many people trust the medical profession. I do not, many of them are compulsive liars, evil, and ruthless. They are not worthy of respect either. There is much truth in the saying regarding medics "It is the one who you trust the most that will betray you". I look at them and think, What does another Shipman, Allitt or Jones look like? These people are the ones who would claim patients had mental health problems. Evil freaks that is what they are, and there are more of them out there now.
    A doctor countersigning a firearm application form cannot be sure the patient will not shoot someone. The converse is also true, how can a patient be sure a medic is of sound mind and judgement. The person with the syringe is harder to detect. It makes you think.

  68. I see John Swinney also demonstrated Kenneth Pritchard, like Douglas Mill protected lawyers by instructing law firms not to represent clients who wanted to claim for negligence.

    These men are criminals themselves, Pritchard is overseeing court proceedings. How many other sheriffs, high court judges, advocates have been involved in protecting their own colleagues. What this demonstrates is that self regulation itself, is a criminal set up, and these people are masters of the cover up. How can any legal system operate fairly when the legal professionals morals should put them behind bars, not dealing with the public. Does MacAskill support this? Clearly he does. What I have noticed about these people, they share the same mental state as doctors and accountants in that they refuse to acknowledge any possibility of wrong doing in themselves or their colleagues. The only explanation for this is that they too share the same values, MacAskill would clearly order law firms not to represent lawyers victims. This set up is a total barrier to clients obtaining justice, and the Law Society of Scotland's and Marsh UK's culture of secrecy is sinister.

    Independent regulation of the legal profession is the only solution to this most serious of problems.

    "The Scottish Solicitors' Guarantee Fund protects those who have lost money because of the dishonesty of a solicitor or a member of their staff. It is a fund of last resort, which means it can only compensate those who have exhausted all other options, such as suing the solicitor for professional negligence. PEOPLE CANNOT SUE THEIR SOLICITOR. HOW CAN A CLIENT SUE THEIR SOLICITOR WHEN ALL OTHER SOLICITORS REFUSE TO TAKE THE CASE, OR AS IN THE FARMERS CASE THE LAW SOCIETY TELL HIM TO GO TO A LAW FIRM WHO REPRESENT THE LEGAL DEFENCE UNION, THEY ARE SICK EVIL PEOPLE. THE LAW SOCIETY CLEARLY DO NOT WANT TO FAIL SOLICITORS, THEY ARE NOT INTERESTED IN HELPING CLIENTS. Payments are discretionary and all legal firms in Scotland contribute annually to the fund".   70. I have identified with much of this report Peter, not a victim directly but rather indirectly as I was the spouse of "the victim",
    the spouse however, has suffered the same angst as the victim in our case,
    property stolen, liviliehoods stolen, future stolen from lawyers who were supposed to protecting our interests instead of which they protected our opponents interests and their own!
    After years and years of "forced litigation" we are homeless and penniless.
    Complaints got us nowhere, and the stress and anxiety felt continues even today.

  71. Lawyers string out cases, which are not in their interests to take to court. But the Paul McBrides of this world act quickly to defend the bum boy Haggarty, or Angela the drug dealing lawyer.

    A lawyers mission statement should be "Milk the legal aid, kill the client". If a client could get to court with a case against their negligent lawyer, what would happen if Sheriff Kenneth Pritchard was overseeing court proceedings? This is one of the men John Swinney demonstrated was corrupt. Pritchard can sit in a court of law, and deal with cases when he has no decency in him. No doubt there will be a law firm who will offer Prtichard a job just like Sheriff Hugh Neilson who was caught by police in a massage parlour. Neilson said he was "only in for a shave".

    This man states that his lawyer has "a good life, is an outward respectable member of the community", just like my GP in Hamilton.
    These professionals will always have good lives after ruining clients and patients, because their colleagues protect them and to hell with the victim. When reputations are at risk, there is no such thing as a fair complaints system if that system self regulates. One day, I have predicted this, a victim will take the law into his own hands. I am surprised it has not happened to date, because these people trash lives for reputations and money.

At least two other suicides directly associated with clients dealings with the Master Policy are known, where in both cases, clients appeared to have been put under intolerable pressure, delay, deceit and intimidation by lawyers, the Law Society itself, and the insurers to the Master Policy, that the result of the entire process was to cause the claimants to end their lives after breaking under the strain of dealings with the apparently deadly Master Policy insurance scheme.

    If not I have to ask the question why are papers blind siding a story about people dying to allow lawyers to sleep at night ?

  80. Strong comments from some, although I can understand the strength of feeling due to the issue of clients of 'crooked lawyers' being driven to suicide simply because they try to secure a fair hearing in Scots law which Scots law itself is denying all of us.

    I am quite supportive of campaigns and protests against the workings of the Law Society, the SLCC, the Faculty of Advocates & the Master Policy. What is going on, particularly with the Master Policy affects us all .. and it should not be forgotten that millions of pounds of taxpayers money also goes to the insurers who are part of the Master Policy, in terms of Government contracts, in Scotland and the rest of the UK.

    In my view, and I dare say many others ... it must be morally wrong to be a part of an insurance scheme which thrives on the demise (even death) of claimants & awards bonuses to negligent or 'crooked' lawyers for their efforts in destroying a client's case.

    I agree with you Peter and I am sure all decent people will agree also. However, we are dealing with evil people who clearly do not care and they think this setup is morally right. They rip your soul to shreds, and want forgiveness, GP's are the same. The self regulators are all the same, they police their own conduct and that is why these tragedies are happening.

    One day a client will be tortured so much they will___. Then all lawyers and their doctor buddies will reject diminished responsibility, to deter other clients or patients. The self regulators hold all of the cards, and are totally ruthless people.

    I have a relative who works for a newspaper (I wont name which one but it was once regarded as a decent rag - not now) and he said anything to do with bad publicity towards the legal profession has to be handled with care or left out if no one else is running it.
    Freedom of the press is a myth at least in Scotland.

    I agree with you. In a so called democracy we need freedom of speech as our fundamental right. However if the press are wary of reporting negative issues regarding the legal profession then who is running the show. If the situation is developing where the legal establishment can prevent the press reporting an issue about legal corruption where are we heading. A dictatorship. Do we have a democracy or the thin end of a sinister wedge called the crushing of free speech, and expression. As soon as the lawyers and or parliament control the press we no longer have a democracy. In my opinion it is the duty of the press to report corruption, and those rags who fail us are not fit to be journalists.

    News needs to be reported good and bad and not reporting issues about legal corruption strengthens the Law Society, Crown Office, Faculty of Advocates etc.

    I wrote with supporting documentary evidence to the sheriff at Hamilton Sheriff Court. They told me the sheriff could not give a legal opinion (I still have the letter) but the sheriff clerk advised me to get a lawyer, this has been impossible no one law firm in Hamilton would help. I tried a law firm in Edinburgh, they would not help either. I gave up trying to get a lawyer, now I realise I needed a McKenzie Friend.

    If you want to take a crooked lawyer or doctor to court the (legal system shuts down on you). That is why lawyers cannot remain in charge of access to justice. You stand alone against the might of professionals who can and do, do what they want because there is no mechanism in Scots law to stop them. They use their loyalties to each other and their insurers to crush you, and it is a horrific traumatic experience. It really makes you think about the type of country you live in.

    We totally agree with you "complaints got us nowhere either" we found the harder we tried to expose our crooked lawyer the greater the resistance from the authorities. These people are all stealing from clients, and they can get away with it because of the self protectionism of self regulation.

    Let us put it this way, it clients could embezzle a law firms money, the procurator fiscals in Scotland would be sending us to face the wrath of the courts. Lawyers stealing money have resulted in suicides because, complaining to the Law Society results in the client being represented by the Legal Defence Union, who are there to protect the very Master Policy the poor client is trying to claim against. This setup actually encourages corruption, it is criminality at it's worst and the system is totally against the users of legal services.
    I have seen two comments thus,

    Complaints got us nowhere.

    They are closing me down.

    To all people who have not been the victim of a crooked lawyer, you have no chance. Everywhere you complain to close you down, law society, courts, law firms will not help you. People with no rights are slaves, you and I the people of Scotland are legal slaves, make no mistake, this profession take you back to the dark days of dictatorships. They can do what they want to you, because there is nothing in place to protect the client. My advice to you, the Law Society will crush you. That is also why the new Scottish Legal Complaints Commission will not investigate complaints before October 2008. That will get the director of the Law Society off the hook who sent the suicide victim to the Legal Defence Union to represent him against his crooked lawyer.
    This man and his family had no chance. Criminal charges should be applied to this director who works for an organisation who by statute, must protect clients from crooked lawyers. He should be charged with breaching this man's human rights because like Douglas Mill, and Kenneth Pritchard, he is a criminal.

    It is the duty of everyone in Scotland to tell everyone you know about this. You or someone you know, may be the next victim. Everyone is at risk from this totalitarian legal system, where clients are barred from a fair legal hearing because the powers that be are determined to protect the reputations of criminals with law degrees. It is a scandal that a system like this prevails in a democracy. But then is it a democracy? You decide?

    When you could not get your medication was a doctor involved in the corruption also? I know a doctor who lied in medical report to the court during a litigation case. He then stopped his patients incapacity benefit to starve her into submission. Why, because her documents had been sequestrated by the court, if the case went to trial she would have found out her GP was distorting her medical records. Her lawyer would not help her either. Her family supported her, but she had no money at all from September to January when her employer terminated her contract. She was staying with her mother at the time, so she had no rent or mortgage. We conclude as her employer, lawyer and GP were all insured by Royal & Sun Alliance the lawyer and GP cut off her money supply to starve her into submission. The written evidence shows that the court was told she had been seeing a psychiatrist for twenty years, but the same doctor told the benefits agency doctor the truth, she had no mental health problems.

    What the public are dealing with are clubs of powerful criminals, who use self regulation to cover their criminality. They are simply evil and totally ruthless. The courts, law firms, law society, general medical council, NHS primary care are totally supportive of these crooked professionals, that is why they still work today. I warn the public that it does not matter who you go to, the above will leave you powerless, and they can do what they want because the system is as corrupt as they are.

    I understand from sources there has been a great deal of debate about the academics report on the Master Policy & Guarantee Fund, and the Law Society are "unhappy with the findings", so much that some opposed publication.

    I doubt Professor Stephen & Dr Melville's report could have been carried out in Scotland - everyone up here is simply too afraid of losing their academic career to compile such an expose of the workings of the legal profession ... but there is much more to be discovered & published relating to how claims against solicitors are handled in Scotland.

    Once again, I would ask readers who make comments to moderate what they write, for your and my protection !..

    Doctors will criticise what I am about to write, but I am convinced that people are better avoiding GP's at all costs.

    In litigation you have no chance because even if your GP knows you have been injured at work, they will use and distort your medical records and cover it up. GP are as committed to stop you suing your employer as Shipman was to murdering his patients. When they cover it up and you cannot get a lawyer to act for you, the medical and legal defence unions spring into action to defend them.

    Everywhere you go does not want to know. It is a system where everyone is insured by Royal Sun Alliance, and the GP's would administer fatal drugs to you before they or consultants would say your employer caused your injuries.

    In the UK it costs employers time and money defending litigation. But do not be fooled, everyone except you is insured by the same company, so the doctors and lawyers are going to hurt you, to keep their insurance premiums increasing.

    It is an easy way around the Health & Safety Laws, and people are being injured and it is being covered up. It is a litigation SCAM so that lawyers and doctors can make money, from Legal Aid, and perhaps a bag of cash from their insurers.

    If reliable data was available I am convinced litigation of this kind has a 100% failure rate for the person suing for damages. The outcome of your case is decided before you sign legal aid forms.

    I have left similar messages on Peter's blog before, and I note that not one lawyer or doctor has challenged what I have said. If anyone has tried suing their employer for damages, and the case was decided on medical evidence (Always a medical cover-up) your lawyer and GP, the consultants have found out what really happened to you, then produced false reports to hide the injuries. Mr Cameron Fyfe of Ross Harper Solicitors is a master of this.

  102. There is one major difference between lawyers and the Nazi's, in most cases the Nazi's killed their victims quickly.

    Lawyers are masters of the sinister game, they leave clients like a ship with no engine, sail or rudder, powerless the ship does not get into port, the client will never get to court.

    These is one think I am sure of, The Law Society of Scotland will be buying new document shredders or tons of black ink to cover up their documents and sewer rat morals. We are not offensive Eileen Masterman, we are just fighting for a fail justice system where descrimination is outlawed.

    These should also be no redacting of documents. What is the point of FOI Laws if redacting of documents is allowed. It is argued redacting is used to protect personal information, bullshit any redaction means the lawyers are back to their old tricks.

    I agree with you Peter but what you say here is disturbing, because it speaks volumes about the power of The Law Society of Scotland. I am not surprised the latter are concerned by Professor Stephen & Dr Melville's report because there should be a public outcry about the power these people have. If more suicides are to be prevented, MacAskill must act or his position will be untenable. He cannot defend a system like this and call himself a justice minister.

    The people who know about this owe a great debt to members of the public, in that we must inform them of what is happening here. Because many people have not dealt with lawyers, does not mean they will never deal with lawyers. The day to day activities people are involved in, borrowing for a house, divorce, wills, all require lawyers at some point.

    Foolish is the individual who believes they will never need the services of a lawyer.

    Pritchard's covert attempt to defeat a perfectly valid solicitor negligence claim was recently exposed in parliament by John Swinney MSP. In his capacity as Law Society Secretary, Pritchard actively encouraged a firm of solicitors NOT to act for an individual whose life was effectively ruined by crooked lawyers. The victim, Iain McIntyre, was ultimately successful in his damages claim - a settlement that we cannot comment on for "legal reasons" i.e. Mr McIntyre was forced to remain silent about the legal crookery in order to receive just partial recompense".

  112. Brilliant work Peter, and it is wonderful to have the academics findings. Clearly the Law Society waiting over a month to supply key data to the report authors is very damaging for them.

    We can also conclude it must have been more damaging for the Law Society to supply data, when requested for inclusion in the report because if there was nothing to hide there would have been no delay. This Law Society is a criminal organisation, and their power must be curbed if people are to have any chance of justice. No doubt, as one lawyer recently stated "Saving Private Penmann has cost us dearly". Saving the director who advised the farmer, will cost the Law Society a lot more. The evidence is mounting of a totally corrupt regulator.

    Clearly Professor Stephen and Dr Melville have been free to reach their conclusions based on the evidence before them. This is what the people of Scotland require, not endemic cover up from an organisation who are duty bound by statute to protect clients, and regulate lawyers but do neither. They oppress clients and protect lawyers, that is what the Law Society of Scotland do, and they must lose the power to cover everything up as a matter of urgency.
    How these people can sleep at night is beyond me.

    I have not named the law firm or the Law Society official yet but they will be named ... and readers should be able to guess without too much trouble as I have featured that same Law Society official several times in articles, and I think anyone dealing with the Law Society will have had dealings with this particular official ...

    Incidentally Jane Irvine as former SLSO knows all about the case as her predecessor made two reports into the client's complaints against law firms and the Law Society ... but so far, no comment and no action on relieving individuals of their problems connected with the Master Policy.

    Perhaps the SLCC have simply become spectators to the continued persecution of clients of crooked lawyers ... or willing participants ?

    Considering the background I have been told of events, I'm surprised we ever got to see the final report.

    These people sleep at night because they admire causing the deaths of clients, for personal profit. If they didn't admire it, one of the 10,000 would have stood up, called the Master Policy corrupt, and done something about it .. no one has .. so what does that tell you about Scotland's 10,000 solicitors ...

Of course, everyone laughs at people who claim injustice, don't they ? its funny .. it didn’t happen to someone (yet) so they are not too bothered … but they stop laughing fast when they fall victim to an injustice that also cannot be put right because the same politicians of our present day who cry ‘Scotland ahoy’ and claim to represent our best interests, are too busy prostituting themselves generally to those who are causing the injustice, for top dollar.

    Inevitably local law firms do 'develop' links with some in authority, so clients who complain against their solicitors should be on the look out for trouble ahead ... and waste no time reporting such matters to the media, and myself.

    'Pressure Groups' are always at risk from the institutions they campaign against .. however campaigning against the legal system itself must certainly generate the most risks.

    Suffice to read my earlier reports on the conduct of the SLCC's lawyer members & Senior officials towards 'Pressure Groups' to show the attitude towards citizens who dare dispute the profession's line on things ... again, campaigners do need to be aware the Law Society is no friend of openness or transparency, as thousands of cases of 'crooked lawyers' getting away with it over the years have proved.

    A comment made late last night which I have not published, does identify the Law Society official who featured in my article to a legal firm which represented the Legal Defence Union.

    That identification was correct, although a more detailed report on the story will be run at a later date.

    Potential dictatorship or democracy?

    The press are frightened from the Law Society of Scotland, and this is dangerous. Perhaps if the police are in the pockets of solicitors, the latter will order murders of clients, and the police will fail to collect enough evidence. State controlled murderers, I believe anything is possible.

    The inquiry into a Lanarkshire nursing home fire in which 14 residents died will begin in November, the Crown Office has announced.

    The probe, which will investigate the circumstances surrounding the blaze, at the Rosepark Care Home in Uddingston in 2004, will be held in Motherwell.

    The fatal accident inquiry came after three failed attempts to prosecute the former owners of the care home.

    It is expected to last several months, Lord Advocate Elish Angiolini said.

    Sheriff Principal Brian Lockhart will preside over the fatal accident inquiry, due to start on 16 November at Motherwell's Gospel Literature Outreach Centre.

    It aims to determine the full circumstances of the fire, and to identify action to stop a similar incident happening again.

    In May, a judge threw out a prosecution against former Rosepark owners Tom Balmer, his wife Anne and son Alan, saying they could not be held responsible, as the Rosepark Care Home firm they ran had been dissolved.

    First Minister Alex Salmond said the case had raised a "genuine gap" in the law which must be addressed.

    Dissolve the partnership, the partners would still be liable for revenues owed to the Inland Revenue etc. So the message is clear, dissolve the partnership, extinguish liability if you are negligent.

    The Panel consists of six solicitors selected by the Society on the basis of their expertise in dealing with professional negligence claims to assist members of the public with advice about negligence claims against solicitors and, where appropriate, to assist solicitors already advising members of the public in connection with the handling of negligence claims against other solicitors.

    Each member of the Panel is available to deal with negligence claims against other solicitors on an individual basis. However, where a claimant is already represented by a solicitor in relation to a negligence claim against another solicitor, members of the Panel will not provide advice to or act for that claimant, unless the existing solicitor refers the matter to a member of the Panel. It should be emphasised that members of the Panel are happy to receive referrals from other solicitors, either to handle the whole claim, or to assist with advice in relation to any aspect of a claim.

  130. In a summary, if you make a claim against your solicitor, your solicitor is entitled to make a claim for indemnity from the Master Policy insurers. (OKAY) Provided it is established that you have a valid claim, the Master Policy insurers will meet the solicitor's liability to you to meet your claim. (OKAY) Not every claim will involve the insurers. Whether or not the Master Policy insurers become involved you still have to establish that your solicitor was negligent. (THIS IS IMPOSSIBLE. LAWYERS INVESTIGATING MY COMPLAINT CLIENTS YOU HAVE NO CHANCE). Depending on the circumstances, you may find that the Master Policy insurers (or solicitors instructed by them) become involved in responding to your claim. Where that happens, you will be sent a copy of the Master Policy Claims Handling Philosophy which is a statement of how the insurers seek to resolve claims. Further information on the Master Policy may be obtained by emailing David Cullen at the Law Society of Scotland.

    During war spies would have been put up against the wall and shot. I am not suggesting this should happen, but the commission was compromised from it's inception, by lawyers, yes spies there to protect the Law Society. How can politicians possibly have a complaints system with lawyers involved in the complaints process.

    My view is that Jane Irvine should be fighting more for clients. I urge all people who have lodged a complaint about their lawyer with the commission, to let Mr Cherbi know how it is going. I do not expect much because their refusal to investigate complaints before October 2008, is a cover up strategy from the start. How many complaints have they received from 20th October 2008 until now? What about the criminality of lawyers over the last 30, 40 years? That tells us where the politicians loyalties lie.

    If Scottish Lawyers can put an innocent man away for the Lockerbie Bombing, they can do anything they want. A terrorist trial with no jury, the Americans paid the maltise shop owner who said the bomber bought the clothing wrapped round the bomb, and all the other things, too much to list here, a miscarrage of justice if you ask me. A trial without jury is sinister too, dangerous. Has the man in Barlinnie been made a scapegoat, so the real bombers are still out there?

  146. I am pleased to know Margo MacDonald MSP, supports the introduction of McKenzie Friends in Scotland.

    This has been legal in England and Wales for 39 years. Discrimination is illegal and Alex Salmond wants to break up the union for sinister reasons, one of which is to allow the Law Society of Scotland total power over the citizens of Scotland. NO Salmond, no, no, no, end descrimination no matter the financial implications for lawyers. The Scottish people are safer with McKenzie Friends than the legally qualified riff raff, protected by the politicians and the Law Society.

    The lawyers mission statement, "Milk the Legal Aid, Kill the client". No Scottish lawyer acts in his clients best interests. Law firms do not exist, Law firms of criminals do.

    Justice against a member of the legal profession is impossible, because of the dirty fithy morals of people like Phillip Protect the Master Policy & lawyers Yelland. Well Yelland, how can you remain in your current role now, when you sent a man who had been ruined by one of your footsoldiers, to another criminal organisation The Legal Defence Union.

    There is some beauty in self regulation and it is this. Those protected by it become complacent and arrogant, and believe they are invincible. No one is invincible, and no one is omnipotent, and your day is coming Yelland, exposed for the criminal that you are, a man who belongs in the gutter with the morals of Adolf Hitler. You can sleep at night because you are an evil man, who will stop at nothing to protect your subscribers to the £650.00 keep the lawyer out of jail card. A system that protects legal practitioners, by self regulating them is a system that is doomed to failure, because public trust in such a system is impossible.

  148. The Rosepark fire, a dissolved partnership would still have to pay creditors, the Inland Revenue, but the causal link is broken by the courts to protect the insurers. Did the judge rule any monies owed to banks or the Inland Revenue had not to be paid? So the conclusion is simple, old people's lives are not important to the legal profession, end the partnership, and you end any possibility of the relatives being compensated.

    Just like litigation cases which rely on medical evidence, the causal link is hidden, by corrupt medical reports so that the insurers are protected.

    The medics and lawyers never fail to protect their insurers with the law of Delict by ensuring no link exists by,

    Dissolving the partnership.

    Ensuring medical reports never find employers liable for a breach of the duty of care. Criminals with stethoscopes and wigs. The lawmakers make laws which they can break with impunity, so people should remember that doctors. lawyers, judges, all share the same insurers as employers, so there should be no surprise to find out their primary motives are always to protect those insurers.

    In the Rosepark case the law needs changed, so that a dissolved partnership does not prevent criminal prosecutions where evidence supports that, and damages being paid where prosecutions occur.
