'Self regulation' system which destroyed Westminster reputation must now end for all professions, industry & public services

Westminster ParliamentWestminster Parliament used self regulation for decades to protect members unacceptable conduct on expenses. SELF REGULATION, the infamous liars charter which many professions and public services use to protect themselves against complaints from the general public, and even the law itself, is to end at Westminster, according to the Prime Minister, Gordon Brown, and the leader of the Conservative Party, David Cameron.

Prime Minister Gordon Brown speaks about the end of self regulation at Westminster after politicians from all parties were caught looting taxpayers money for personal expenses.

Conservative leader David Cameron also speaks about the end of self regulation at Westminster.

Yes, self regulation must now be ended in the UK political system, as it had utterly destroyed the public's faith & trust in the Westminster Parliament.

However, self regulation as we all know is a popular facility which many professions & industries and public services within the UK also use to protect themselves against public complaints of bad conduct, poor service, lack of honesty, theft & embezzlement of client & public funds, and in the case of Doctors, even negligent medical decisions which lead to the deaths of patients.

A roll call of self regulation and how it has affected all our lives :

Sir_Fred_GoodwinSelf regulation of bankers ensured lack of independent scrutiny of Sir Fred Goodwin's actions at Royal Bank of Scotland. Self regulation of the Banking & Finance sector has cost the UK dearly, and virtually brought public finances to the brink of bankruptcy, as bankers such as Sir Fred Goodwin's over zealous takeovers while in charge of the Royal Bank of Scotland have plunged the UK Banking sector into collapse and worldwide disrepute.

GMC LOGODoctors are self regulated by the General Medial Council, where complaints get less than a fair hearing according to many patients. If you have ever tried to complain against a Doctor, or medical facility such as a hospital, you will find that self regulation plays an extensive part in ensuring patients complaints are kept within the medical profession, and never really achieve a fair hearing. For instance, many medical decisions which could be called negligent, resulting in the deaths of patients, for example, either through lack of treatment or administering of the wrong medicine, are also covered up by self regulation.

Just look how self regulation of the UK medical profession has protected those who allowed the use of contaminated blood products which infected many haemophiliacs with Hepatitis C and even HIV infections, killing many and leaving thousands suffering from incurable diseases. David Mcletchie taxiFormer Scottish Conservative leader David McLetchie lied over taxi expenses & journeys. Scottish Parliament has its own share of expenses scandals and self regulation has seen that no MSPs get prosecuted. Our dearly beloved Scottish Parliament at Holyrood, which some have been holding up as a model of expenses reform against the recent scandals at Westminster, has also had its fair share of expenses fiddling, with MSPs milking their expenses accounts to pay off mortgages, non existent travel, and even taxi fares.

No prosecutions or de-selections of MSPs have ever taken place at Holyrood despite all the expenses fiddling there, because of course, self regulation has allowed the Parliament to keep decisions on punishment and standards to itself. SLCC membersScottish Legal Complaints Commission was an attempt at independent regulation but was 'taken over’ by legal profession before it even existed. Despite attempts to create an independent regulator of the legal profession in Scotland by the previous Scottish Executive, the current Scottish Government stood by and allowed the legal profession to take over the 'independent' Scottish Legal Complaints Commission, ensuring once again, that 'virtual self regulation', as some at the Law Society of Scotland now call the SLCC remains the order of the day for complaints against solicitors in Scotland, and that even today, complaints by the public against crooked lawyers do not get a fair hearing, because too many lawyers and Law Society members were parachuted into the 'independent' SLCC via deals between the Law Society and the Scottish Government

ICAS LOGO 2Scottish accountants have used self regulation to hide corruption complaints against members. The Institute of Chartered Accountants of Scotland (ICAS) is one of a number of organisations which self regulate its members, however the style of self regulation at ICAS has led to the cover up of some of the worst conduct of accountants in the UK, where fraud, embezzlement of client funds, even criminal activity by members, and many other types of complaints have been swept under the carpet of self regulation by the body which prides itself in having extensive political connections throughout the UK, including even members of the Privy Council which ICAS have used to prevent changes to independent regulation of accountants from taking place.

An example of how accountants self regulation affected my own family (in complaints which are common to many ICAS investigate) :

Norman Howitt Accountant JRW Group Hawick Scottish BordersNorman Howitt, Borders Accountant with JRW Group was protected by self regulation of accountants. Norman Howitt, a Borders Accountant ruined my family's life, and got away with it because of self regulation at ICAS which even covered up the fact he gave false statements to Lothian & Borders Police to cover up his embezzlement of money into his accounting firm's accounts, from the sale of my late father's assets.

Scotsman coverage of some of the stories relating to Andrew PenmanScotsman newspaper led a campaign in the 90’s to end self regulation of Scots lawyers. The Scotsman newspaper reported on many occasions, the corruption of self regulation at the Law Society of Scotland which protected complaints against crooked Borders lawyer Andrew Penman of Stormonth Darling Solicitors, Kelso. No effort was spared by the Law Society of Scotland’s most senior officials to corrupt the investigation and derail any prosecution against Penman who also deceived the Royal Bank of Scotland and the Inland Revenue.

Philip YellandPhilip Yelland, Law Society’s self regulation chief ordered solicitors to ignore clients instructions in cases against crooked lawyers. What we as the public have had to endure for far too long in Scotland, England & Wales, is a Crooked Curtain of self regulation that has been held firmly in place by the professions, many UK industries, public services, politics and Government (local & national), simply to protect those same professions, industries, public services and politicians from public accountability and transparency, which can only be achieved through fully independent regulation.

As we can see from the above examples, it is time to end self regulation for anyone & all public services, industry and professions in the UK, now.

    Cameron warns 'jealousy' MP Steen

    David Cameron says he has warned Conservative MP Anthony Steen he will be expelled from the Parliamentary party if he steps out of line again.

    Mr Steen has apologised for an interview in which he said critics of his expenses claims were simply "jealous" of his country house.

    Tory leader Mr Cameron told BBC Radio 4 it was "an appalling thing to say".

    He said the Totnes MP - who has said he is standing down at the next election - was on a final warning.

    "I gave him a very clear instruction after that interview - one more squeak like that and he will have the whip taken away from him so fast his feet won't touch the ground," Mr Cameron told BBC Radio 4's Today programme.

    "It was a completely unacceptable interview. It was a completely unacceptable thing to say. He's announced his retirement from Parliament."

  8. I've just finished watching the 2 video clips.

    1.I do not believe MPs can reform themselves no matter who says what.

    2.Lawyers Doctors Accountants and every other profession will never reform themselves unless it is forced upon them but that has to be done by means of Parliament and it so happens the same lawyers Doctors Accountants and the rest dominate Parliament too.

    What we really need is a fresh start Peter and if someone has any sense they will drag you kicking and screaming (if need be) into Parliament along with Joanna Lumley and Martin Bell.

I agree that self regulation is only in the interests of crooks.I also put a complaint in to the Law Society years ago and got nowhere.All they did was tell me there was no evidence to do anything yet I provided every single document to show my solicitor had overcharged us,taken money under false pretences and lied the whole time he said he was working on our case when he did nothing.

  14. THE LAW SOCIETY/SLCC, ARE CRIMINALS WHO WILL RESIST INDEPENDENT REGULATION AT ALL COSTS. THEY ARE IN A WEAKER POSITION TODAY, ESPECIALLY WITH THE REVELATIONS AT WESTMINSTER.

    SELF REGULATION ENCOURAGES CORRUPTION, THAT IS WHY THERE IS SO MUCH RESISTANCE TO CHANGE. MP'S AND THE PROFESSIONS HAVE MUCH TO LOSE. BUT LOSE THEY WILL.

    I have been through the mill myself with the medical profession over the death of my mother through a lack of care at a Borders Hospital.

    The NHS trust management lied the whole way through the complaint.

    I agree with your comments and I too doubt this Parliament, as discredited as it now is, can clean itself up in the eyes of the public, and completely eradicate self regulation from the halls of Westminster.

    As for your comment about me & politics, I'm not really one for public office - I would find it too hard to sit back and say nothing when scandals such as tainted blood products, expenses milking and bare faced lying by politicians were going on around me.

    However, I do remember watching Joanna Lumley in "The New Avengers" all those years ago .. anyway ... she would make a fine MP given her marvellous campaigning on behalf of the Ghurkas.

    I hope Martin Bell heads back to Parliament too. He was good on "Question Time" last night.

    Note Salmond's recent threat to resign along with the rest of his minority government if the Parliament passed a vote of no confidence in MacAskill - hardly a reasonable response to justified criticism.

    Remember everyone its the lawyers who help banks repossess homes off people and toss them onto the street.

    Funnily enough I was speaking to an SNP insider (he's been a member for many years, knows Alex quite well) but this man told me the party feels like a dictatorship now, and with Ministers bullying and blackmailing to keep their portfolios, well .. it almost sounds a bit like something from 1930's Germany, as some comments occasional point out.

    MacAskill is hardly worth resigning over, let alone even adding a stamp to an envelope to what has now become a rather twisted, racist, and foul mouthed Justice Department at the Scottish Government.

    Conservative MP Andrew MacKay has announced he is to step down at the next general election.

    It comes after the MP for Bracknell, Berkshire, had a conversation with the Conservative leader, David Cameron.

    Mr MacKay had already resigned as Mr Cameron's aide because he and his wife, Julie Kirkbride, MP for Bromsgrove, both claimed second home allowances.

    She is now having to defend herself against newspaper claims her brother lives rent-free in one of the homes.

    In a statement, Mr MacKay said: "Following a conversation with David Cameron this morning I have decided to step down as candidate for Bracknell at the next general election.

    THIS IS WHAT HAPPENS WHEN THE FOI ACT APPLIES TO MP'S EXPENSES. LAW SOCIETY YOU ARE NEXT, GORDON BROWN DO YOU THINK A LAWYER SHOULD BE THE SCOTTISH JUSTICE MINISTER? WE DO NOT.

    They tabled a list of seven measures they claim he must act on, including stricter criteria for sending prisoners to open jails. (WHAT ABOUT FOI ACT APPLYING TO THE CRIMINAL LAW SOCIETY OF SCOTLAND)?

    Legal aid rip-off probe lawyer keeps job. (RESPONDENTS COMMENTS IN BRACKETS).

    A LAWYER being probed over alleged legal aid fraud escaped being struck off despite ripping off a client.

    Iain Robertson was able to continue practising because the incident was a "one-off". (MR O'DONNELL'S CASE WAS NOT A ONE OFF BUT HE DID NOT GET STRUCK OFF).

    He has now been accused of fraud in a separate investigation.

    The Scottish Solicitors' Discipline Tribunal found Robertson pocketed £21,308 from a woman client while getting legal aid cash for the work. (LEGALISED THEFT).

    They fined him £5000 after finding him guilty of professional misconduct. (SSDT DO THIS PROFESSION NO GOOD AT ALL. A GREEN LIGHT TO KEEP BEING CROOKED).

    But they decided not to strike him off, (NO SURPRISE THERE) ruling it "appeared to be a one-off" and concluding: "What happened was due to incompetence rather than anything more sinister." (WE BELIEVE YOU SSDT).

    But Robertson has been reported to the procurator fiscal after a police probe into an alleged legal aid fraud worth up to £350,000.

  34. A lawyer in trouble always has a lawyer to represent them in court. Not so for lawyers victims who are barred from the courts.
    This is why the monopoly of the legal profession must end. Criminals protected by criminals, with injustice for their victims.
    Then the Law Society/SLCC/SSDT either cover everything up or slap the solicitor with a meagre fine, and let them keep working. SOME JUSTICE SYSTEM. NO WONDER THE PUBLIC THINK SOLICITORS ARE TRASH.

  37. I dont believe self regulation will ever be ended for the likes of lawyers or accountants or doctors.There is just too many criminal within those professions to protect.

    Another one you failed to mention is the Police.The biggest self regulators of them all and high time the Police were not allowed to self regulate.

  38. I was talking to someone at the weekend who told me the only reason the insurers challenge against the Damages Scotland Act re Asbesxtos claims will fail "is because Peter Cherbi wrote about it and put up the video testimony of some of the solicitors representing the insurers".

    As for all those idiots screaming for an election just now - if we get one all those crooks who claimed for cleaning their moats and towel rails will get away with it.

    Readers strength of feeling is noted on the issue of self regulation ... and the more we can do to end it, in all areas of public life, and public services, the better for all of us.

    There was a posting regarding doctors, a hospital and medical negligence, which I have passed on to contacts in the media rather than publish. To the poster of that comment, you can rest assured I will look into this matter further.

    I have read in earlier comments you helped asbestos victims against insurers who dont want to pay out compensation.

    Today (Tuesday) on BBC there is a story about the Insurers going back to the Court of Session and trying to overturn the new law on damages.

    Please help asbestos victims and make sure these evil law firms and insurers dont succeed.

Yes I agree self regulation must end but look at what is going on with the London parties.Nothing but talk talk talk and a few crooked mps standing down in 12 months time but they will pick up another 200K before they go.Robbery and I bet there are some rat lawyers just waiting to raise challenges on behalf of their robbing mp clients to stop everything in its tracks.

    It all sounds familiar doesnt it Peter ? Its the same as you have been fighting with the crooks at the Law Society and bent lawyers for years !

  47. Scottish Legal Complaints Commission was an attempt at independent regulation but was 'taken over’ by legal profession before it even existed.

    CLEARLY INDEPENDENT REGULATION WOULD CLOSE MANY LEGAL FIRMS BECAUSE THEY ARE ALL CORRUPT.

    PEOPLE OF SCOTLAND. LAWYERS DEALING WITH COMPLAINTS AGAINST LAWYERS MEANS,

    COVER UPS.

    NO JUSTICE FOR YOU.
